２　前項に規定する「みなし利息」とは、礼金、割引金、手数料、調査料その他いかなる名義をもつてするかを問わず、金銭の貸付けに関し債権者の受ける元本以外の金銭（契約の締結及び債務の弁済の費用であつて、次に掲げるものを除く。）のうち、金銭の貸付け及び弁済に用いるため債務者に交付されたカードの再発行の手数料その他の債務者の要請により債権者が行う事務の費用として政令で定めるものを除いたものをいう。例文帳に追加

５　貸金業者は、貸付けに係る契約の締結に際し、その相手方又は相手方となろうとする者に対し、債務履行担保措置（当該契約に基づく債務の履行を担保するための保証、保険その他これらに類するものとして内閣府令で定めるものをいう。以下この項において同じ。）に係る契約（当該債務履行担保措置の対価として支払われる金銭の額が当該金銭の額を利息制限法第八条第一項に規定する保証料の額とみなして同条の規定を適用したときに同条の規定により無効とされることとなる部分を含むものに限る。）を、債務履行担保措置を業として営む者と締結することを当該貸付けに係る契約の締結の条件としてはならない。例文帳に追加

４　前項において準用する第百五条第二項に規定する期間内に第一項の規定による異議の主張又は第二項の規定による受継がされなかった場合には、異議者等が再生債権者であるときは第百二条第一項又は第百三条第四項の異議はなかったものとみなし、異議者等が再生債務者等であるときは再生債務者等においてその再生債権を認めたものとみなす。例文帳に追加
