(1) 逸失利益の額を決定するに当たり，被害者が前条(2)(a)又は(b)に定める基準の1つを選択した場合は，当該逸失利益の計算には，当該特許発明が商業上の観点から本質的部分を構成する他の目的を実施することから得た利益も裁判官が合理的とみなす程度まで考慮することができる。例文帳に追加
