一　外部通勤作業の場合において、そのための通勤の日を過ぎて刑事施設に帰着しないとき。例文帳に追加

３　受刑者に外部通勤作業を行わせる場合には、刑事施設の長は、法務省令で定めるところにより、当該外部事業所の事業主（以下この条において「外部事業主」という。）との間において、受刑者の行う作業の種類、作業時間、受刑者の安全及び衛生を確保するため必要な措置その他外部通勤作業の実施に関し必要な事項について、取決めを行わなければならない。例文帳に追加
