属概念のクレームの英語

出願が1の属クレーム，及び当該クレームが包含する複数の種の各々に別個に限定されているクレームを含む出願に関する第1回処分において，審査官が完全に調査した後の見解として，提示された当該属クレームは容認可能なものであるが，最終的には容認が維持されないときは，審査官は，出願人に対し，そのクレームが限定される発明の種を当該処分への応答において選択するよう要求する。 開示された発明の種概念にも属概念にも該当しないクレームは認めることができる。マーカッシュ型のクレーム，すなわち種概念のクレームとして適正にクレームし得る構成物又は変形を選択的な態様で列挙したクレームも，同様に認めることができる。ただし，出願人が納付すべき手数料の金額は，当該マーカッシュ型のクレームで列挙された構成物又は変形の数に基づいて計算される。例文帳に追加

In the first action on an application containing a generic claim and claims restricted separately to each of more than one species embraced thereby, the Examiner, if in his opinion, after a complete search, the generic claim presented is allowable, shall require the applicant in his response to that action to elect the species of his invention to which his claim shall be restricted, if no generic claim is finally held allowable.
