第19 条のいかなる規定にもかかわらず、特許の侵害訴訟において、裁判所が侵害を主張される明細書の請求項の1 以上が有効であると判断する場合、費用及び損害を起算すべき日付に関して裁判所の裁量を前提として、又、裁判所が望ましいとみなす補正に係る条件を前提として、明細書における他の請求項の無効性を考慮することなく侵害された請求項のいずれについても救済を付与することができる。当該裁量の行使において、裁判所は、当事者らが無効な当該請求項を当該明細書へ挿入した、又は当該明細書中に放置した行為を参酌することができる。例文帳に追加

Notwithstanding anything contained in section 19, if the Court in any action for infringement of a patent finds that any one or more of the claims in the specification in respect of which the infringement is alleged are valid, it may, subject to its discretion as to costs and as to the date from which damages should be reckoned and to such terms as to amendment as it may deem desirable, grant relief in respect of any of such claims which are infringed without regard to the invalidity of any other claim in the specification. Article 46 (1) In the case where a final and binding judgment, etc., to which another qualified consumer organization is a party, has been already issued pursuant to the main clause of item (ii) of para.
