The following acts, in particular, shall be deemed to constitute acts of unfair competition: a. all acts of such a nature as to create confusion by any means whatever with the establishment, the goods, or the industrial, commercial or service activities of a competitor; b. false allegations in the course of trade of such a nature as to discredit the establishment, the goods, or the industrial, commercial or service activities of a competitor. c. indications or allegations the use of which in the course of trade is liable to mislead the public as to the nature, the manufacturing process, the characteristics, the suitability for their purpose, or the quantity of the goods.
次の行為は，特に，不正競争行為を構成するものとみなす: (a) 何らかの手段により，競争者の営業所，商品，又は工業的，商業的若しくはサービス的活動と混同を生じさせる性質のすべての行為, (b) 競争者の営業所，商品，又は工業的，商業的若しくはサービス的活動の信用を失墜させる性質を有する業としての虚偽の主張, (c) 表示又は主張であって，その業としての使用が商品の性質，製造方法，特徴，それらの目的に対する適合性又は数量について，公衆に誤認を生じさせる虞があるもの - 特許庁
