例文

While business decisions are up to managers at individual companies to make, basically, the Japanese government welcomes acquisitions made by financial institutions based on the judgment that the deals are necessary to expand international operations, and we are ready to support M&As related to resources, as I mentioned previously. In that sense, I am hoping that financial institutions will consider their position in the global market and work to better ensure the stability of their financial foundation by improving their international competitiveness and profitability based on business decisions made by their management teams.

There was indeed such a time, but what you just said is news to me, so we intend to properly deal with this matter by taking into account the fact that the Chief Cabinet Secretary had mentioned that an inquiry should properly be conducted by the Minister, Senior Vice Minister, and Parliamentary Secretary. The Incubator Bank issue is extremely regrettable, and I feel responsible for it as well. In that sense, we must regain public confidence and at the same time, draw a lesson from this issue and properly engage in financial regulation and supervision.

That being the case, the volume of public works is, as is evident from the state of the housing construction sector, for example, no longer as plentiful as in the past. Thanks to the SME Financing Facilitation Act, which was enacted when the effect of the largesse, in a sense, given by the LDP administration in its last days was gradually running out, the construction industry has managed to survive. Given the nation's debt that now amounts to 9 trillion (yen), however, I believe that no matter which political party takes the reins, it would just not be feasible to go with any policy measure involving a large increase in public works spending at the levels seen in the past.

As far as the revised Money Lending Act is concerned, to tell you the truth, I saw on TV that fulltime homemakers with no particular income are having great difficulties because they need to have a letter of consent from their respective spouses who have an income in order to get a loan. At the institutional level, the Act was passed unanimously by all the parties, so it may be essential for them to comply with the Act, but government administration needs to get an accurate grasp of whether the legislation is really functioning as intended according to the actual circumstances. I have been informed that about 15 million people are front-line users of money lending services. In that sense, I took the political initiative in creating the Follow-up Team. Your understanding will be highly appreciated in this regard.

However, of course, there is a possibility that the use of public funds could impose a burden on taxpayers, so we may say that this is a framework for risk-taking by taxpayers. In this sense, the application of the existing act was naturally conditioned on the viability of the collection of injected public funds. Generally speaking, when we design a framework for capital injection, the need to avoid creating a framework that may foster moral hazard is one of the matters we must consider.

As I commented last week, a consumer loan market that offers small, unsecured, unguaranteed loans is, in my view, something that society needs after all. In that sense, I do not think that there will be any urgent need to review the Money Lending Act as a result of Takefuji's filing for the commencement of corporate reorganization proceedings. However, given the existence of a market that I have just mentioned, and the fact that the multiple-debt problem developed into a very serious problem, the recent revision to the Money Lending Act, which represents a fundamental and comprehensive step to address the issue that includes lowering upper interest-rate limits and introducing a cap on the total amount of borrowing, was enacted with unanimous support from all parties. After I assumed office, the FSA has been working, mainly in its Revised Money Lending Act Follow-Up Team, to follow up on the situation after the revised Money Lending Act took full effect, including any moves made by money lending businesses.

That is what the strong yen does, and that is the kind of recession we are in. As I just mentioned, 99.7 percent of companies in Japan are SMEs, and more than 40 million people in fact work at SMEs. In that sense, I believe the SME Financing Facilitation Act is timely legislation. It is temporary legislation that is due to expire at the end of March, after covering the calendar year end and the fiscal year end-the end of the accounting term-twice. I have been told that it was made temporary legislation with a two-year timeframe based on the expectation that the economy would recover by then. Regrettably, however, the economy is currently in such a state. The deadline is fast approaching for us to take these circumstances into consideration, take a positive approach, and make the decision to postpone its expiration.

Article 50 (1) Where a registered trademark (including a trademark deemed identical from common sense perspective with the registered trademark, including a trademark consisting of characters identical with the registered trademark but in different fonts, a trademark that is written in different characters, Hiragana characters, Katakana characters, or Latin alphabetic characters, from the registered trademark but identical with the registered trademark in terms of pronunciation and concept, and a trademark consisting of figures that are considered identical in terms of appearance as those of the registered trademark; hereinafter the same shall apply in this article) has not been used in Japan in connection with any of the designated goods and designated services for three consecutive years or longer by the holder of trademark right, the exclusive right to use or non-exclusive right to use, any person may file a request for a trial for rescission of such trademark registration in connection with the relevant designated goods or designated services.

A farewell party was given for me, who was going to study abroad, by my acquaintances and old friends, and a friend of mine in a group of young scholars who studied in the U.K. or France made a speech about a merit of wearing high collar clothes, and while I was studying abroad the word high collar (haikara) party started to appear in the newspapers after the party, used as a tool for attacking young scholars and when they were almost being knocked galley-west, Duke Saionji willingly declared himself before journalists as a don of the haikara party with a purpose of receiving all attacks against young scholars; I think that no one would dare to take his place as a don of the high collar party in an honest sense, and he, who is a match for Lord Rosebery in the U.K in that he has sympathy for the common people in spite of being a nobleman, has a noble character and excellent insights.

A.We will approve capital injection if applicants are judged to be eligible as a result of the screening of their business plans by a panel of third-party experts, and I hope that they will use the funds as the source of loans for the local economy and to small and medium-size enterprises (SMEs). Thus, these funds are not targeted at financial institutions but at local SMEs that need funds. In this sense, although we cannot force them to use public funds injected as capital, I would appreciate it if they actively use the funds.

Since advisory councils tend to be used as fronts for the bureaucracy, I will take care to avoid that. Moreover, if an expert sits on an advisory council for a very long time, the membership may become a vested right, creating a problem for political parties and government organizations. In that sense, a change of government is useful as an opportunity for the renewal of council members, although I greatly appreciate the significant contributions made by long-serving members.

Major national newspapers have written about the growing prominence of problems arising from the division into five companies. In that sense, the shelving of the postal reform bill undermines the people’s interests, and the size of post offices to be rebuilt in the disaster areas will depend on the fate of the bill. As was pointed out by some newspaper article or other, business sections such as the general affairs and planning sections can be unified into one if the three postal businesses are merged into one. However, if the five-way division is maintained, large post offices, such as the one in Ishinomaki, may need four separate office spaces to accommodate general affairs and accounting staff in some cases. You have written news articles about the struggle to plan for the future and rebuild post offices destroyed by the disaster, and I strongly hope that Diet deliberations will be quickly conducted

At any rate, neither the Prime Minister, the Minister for Financial Services nor the FSA Commissioner has the power to issue instructions to the SESC under laws, as I said earlier. The FSA has authority over the SESC only with regard to budgetary and organizational affairs. There must be a clear border between the power of state and the free market. In that sense, the appointment of SESC commissioners is subject to Diet approval, so this commission has a strong degree of independence. I expect that it will take necessary actions in this case as well.

As you know, it is unusual for Japan to exercise initiative and announce support for the IMF. Although Japan has various domestic problems, it is the world's third-largest country in terms of GDP. In addition, as I have sometimes mentioned, Japan is the only Asian country that has maintained a liberal economy and a free market since the latter half of the 19th century. Even though Japan lost 65% of its wealth because of World War II, it went on to recover from the loss. In that sense, it is very important for Japan to exercise initiative, on which the United States eventually showed an understanding from what I have heard informally.

In regard to meeting with officials of the supervisory authority of insurance in China, financial regulation and supervision encompasses banking, securities, and insurance as in the case of the FSA, as you know, and insurance is a significant sector in the financial field, as I have talked about insurance on various occasions in the United States. In that sense, while I do not have an exceptionally strong awareness of problems, insurance is a new market in China at present. For example, efforts to transform health insuranceby this I mean public health insurance—into universal health insurance began about two years ago. In this context, I have heard that there is a great deal of interest in insurance among the people, so I look forward to discussing insurance with them.

In this case involving the Ashikaga Bank, the scheme for special crisis management was implemented, also under the Deposit Insurance Act, and all deposits were protected in full as a result. The total amount of deposits was, if my memory is correct, 4 trillion yen in the case of the Ashikaga Bank, while it is 400 billion yenone tenth, that isin the case before us of the Incubator Bank. In that sense, what caused the failure of the Incubator Bank of Japan is the very skewed makeup of the borrowers of the bank, as I have just mentioned. While the total deposits (of the Incubator Bank of Japan) amount to a little more than 400 billion yen and consist of approximately 29,000 accounts, over 80 percent of them, or approximately 350 billion yen, were concentrated with 120 companies belonging to its network of relationships, as it were. Its purchases of loan claims from money lending businesses in recent years were also among the causes, as you must know well. Additionally, the Bank allegedly purchased claims from businesses like SFCG, which was formerly known as Shoko Fund.

Lastly, I had a comment-for-the-Minister box set up. When I attended the National Securities Industry Convention yesterday, I took to marketing this initiative. As everyone asked me about this comment-for-the-Minister box, I answered, "Yes, I set it up. As the securities industry is working hard now amid the challenging recession, I would really encourage you not to hesitate to bring comments that come out of your sweat." To my surprise, a good number of people asked me about this. My decision to have the comment-for-the-Minister box set up is none other than my attempt to have a bird's eye in the sense that I have described, while I am also hoping to thoroughly take in unfiltered voices of each one of those people who are breathing in the securities industry.

Bearing those points in mind, I issued an instruction to extend the duration of the SME Financing Facilitation Act for one year and to simplify disclosure and reporting documentation in its implementation to a substantial degree. Notably, everywhere I went, I heard people talk about the substantial increase in the volume of reporting documents to submit to the FSA after the Financing Facilitation Act came into force. The other day, I instructed the FSA Commissioner to reduce the documentation by 20 percent. While what is necessary is just necessary, I concluded that it would be appropriate to improve the practice in that sense by taking steps like substantially simplifying the disclosure and reporting documentation and helping financial institutions exert their consultancy function.

I would like to ask about the Program for Financial Revival, the so-called Takenaka Plan, which gave a direct impetus for the creation of the Incubator Bank of Japan. What is more, it also led to the pouring-in of approximately 2 trillion yen of taxpayers' money to bail out the Resona Bank, which became de-facto bankrupt, as well as the failure of the Ashikaga Bank and the bailout merger of the former UJF Bank. In that sense, I consider the Plan to be one of the most impact-laden financial administration steps in the history of the FSA. This also somewhat relates to the question that Mr. Namikawa (from Toyo Keizai) asked during the previous conference, but are there any minutes of the proceedings made to document the development of this Takenaka Plan? Please give us your official view as the Minister.

In that sense, banks would indeed be more stable if they have more capital, but on the other hand, too much capital and hasty capital enhancements would lead to a credit crunch. This has been discussed repeatedly in the past at meetings of the Group of Governors and Heads of Supervision. I stated at a press conference that FSA Commissioner Katsunori Mikuniya and the Governor of the Bank of Japan had participated in the meetings of the Group of Governors and Heads of Supervision in July and September 2010, where they served as a consensus builder. Japan’s position is relatively close to France and Germany. The US and the UK were interested in Systemically Important Financial Institutions (SIFIs), so an agreement was reached on SIFIs separately. As Japan played a leading role in some areas based on its bitter experience of financial crisis, we believe the targets under the Basel Accord can be fulfilled within the scope of management efforts in the real economy.

I will talk about the personnel appointments first. As you know, the FSA (Financial Services Agency) has separate bureaus responsible for three functions, namely, planning of regulatory frameworks, inspection of financial institutions and monitoring of various market transactions-I think that the inspection and monitoring are very closely related - and supervision of financial institutions. I believe that it is increasingly important for these bureaus to enhance their cooperation and function in an integrated manner. In terms of organization, the FSA consists of the main body of the FSA in a narrow sense, which comprises the internal bureaus, and the Securities and Exchange Surveillance Commission (SESC). Cooperation between the internal bureaus and the SESC is also becoming increasingly important.

This uses a market value as the basis of evaluation when the trading volume of a specific financial product is sufficient to make the market price reliable - which represents a mark-to-market approach - while using a price calculated on the basis of rational estimation, or a theoretical value, when a reliable market price is not available for reasons such as market turmoil- which represents a mark-to-model approach. The set of these two approaches constitutes fair-value accounting, and "jika-kaikei" as used by accounting professionals usually means fair-value accounting in this sense. Meanwhile, I suppose that there are general misunderstandings that "jika-kaikei" refers only to the mark-to-market part of these two elements and universally applies market prices.

The subject of the financial regulatory reforms has already been a significant discussion topic in the past as well. I heard that during the Financial Ministers and Central Bank Governors meeting held from October 22 to 23 in Gyeongju, the proposed capital adequacy requirement for banks and a new liquidity framework, which were drawn up in a recent meeting of the Group of Governors and Heads of Supervision, were welcomed along with the commitment to having them come into full force by the prescribed due date, and an endorsement was given to the policy framework, work processes and timelines proposed by the Basel Committee on Banking, one of the subordinate organs of the Financial Stability Board, with respect to the issue of addressing systematically important financial institutions (SIFIs) that you have just raised. The meeting accordingly agreed to give priority to this initiative as an agenda item of the G20 Summit. In that sense, implementing international financial regulatory reforms will contribute to an enhanced financial system and improved soundness of financial institutions in the medium to long term. In the meantime, it is also extremely important to, among other things, make the set of requirements a well-balanced one that fully takes into account differences between countries in terms of the actual operation of their financial systems and to implement it over time by, for instance, allowing an ample planning time in adequate consideration of any impact on the real economy - this is also an approach that Japan applies in attending the ongoing Summit meeting.

Also, we must keep a watchful eye on the upsurge in prices of commodities, as was instructed today by Prime Minister Kan. As the establishment of a comprehensive exchange is included in the New Growth Strategy, it is important from the perspective of Japan’s economic growth. Problems of commodities exchanges have become a globally important challenge as they were taken up at the G20 meeting. Therefore, I believe that the establishment of a comprehensive exchange has grown in priority in my eyes as a politician. In that sense, although I understand that each ministry has its own tradition and history, we must study this matter. That the Prime Minister issued an instruction regarding this and it was discussed at the G-20 meeting means that it has paramount political importance globally. Therefore, we must study this matter while maintaining appropriate cooperation with relevant ministries and agencies.

As I frequently mention, after the Great Depression, which started in the United States in 1929, the world was divided into economic blocs, and that is regarded by historians of later generations as an indirect cause of World War II. It is a mark of human progress that after the Lehman Shock, countries around the world have actively cooperated, as shown by the discussions held at the G-7 and G-20 meetings, despite their divergent national interests. Regarding the international financial regulatory reform, which I mentioned now, central bank governors and the heads of financial supervisory organizations held numerous meetings and reached international agreements. The matters that have been agreed to will be finalized at the Cannes summit. In that sense, I feel that in the 21st century, mankind has made significant progress compared with 1929.

I take it that you are asking about the proposed amendment to the Insurance Business Act that has been passed to the current session for continued deliberation. I assume that you are questioning the appropriateness of a mutual aid business of a public interest corporation or the arrangement in which a mutual aid business of a given public interest corporation is to be supervised by the former competent authorities, with an implication that the FSA should be responsible for supervision. Well, the fact is that the respective authorities, having the experience of supervising public interest corporations for a long time, are well-versed with specifics of their operation. On the subject of this Act, I believe that I named several examples the other day, such as the Japan Medical Association, which has always been supervised by the Ministry of Health, Labour and Welfare since the Meiji era, including the years of supervision by its predecessor, the Health and Medical Bureau of the Ministry of Internal Affairs. While circumstances vary from authority to authority, they know very extensively about internal affairs of those corporations and have exercised thorough supervision and, in that sense, have a set of knowledge of their operation and other information accumulated in the course of the work of supervision in the past, which accordingly makes them presumably capable of delivering more fine-tuned supervision than the FSA would be. Since the most important thing is policyholder protection, we believe that, from such a perspective, having the former authorities supervise them is an appropriate way to go. It is also in comprehensive consideration of overall circumstances, including the fact that this exemption of the Act is a provisional step, that we find it appropriate to have the former authorities continue to supervise those corporations.

While I am not an expert in finance, I am aware that the global economy has drastically changed in some ways since the Lehman Brothers shockwave, and that each country truly has its own problems. Over the past three decades, especially since the collapse of the Soviet Union, the United States has been extremely powerful in economic, political and military terms as the single most dominant country, and my understanding is that so-called financial capital has played a central role. I believe the Lehman Brothers shockwave was a major turning point for American-style finance-oriented capitalism, leaving it no alternative but to undergo transformation. As you are well aware, the financial capital had the political backup of former U.S. Republican President George W. Bush. Nevertheless, even the United States had its President changed to Barack Obama. If you take a look around the world, events like the Greek shock are making newspapers headlines nowadays. In that sense, economic policies including financial regulation and supervision are currently at a major juncture on an international scale.

In that sense, the Financial Services Agency (FSA) hopes that the strengthening of the margin regulation will help to protect investors and enhance the soundness of FX trading in Japan. As I already mentioned, FX trading using high leverages may cause customers to incur unexpected losses as a result of even minor movements in exchange rates.Regarding the margin regulation, the protection of investors has emerged as a greater challenge globally because of the Lehman shock of three years ago. As I stated in the Diet, this regulation is a democratic control of speculative money in a democratic country. While the economy contributes to the well-being of human beings, it tends to go out of their control, so it is necessary to protect investors and, depending on circumstances, even protect a country’s economy.I think that this regulation is necessary as part of the broad economic and fiscal policy that is emerging after the Lehman shock.

In particular, the fact that economic and financial fields have become highly globalized is common knowledge to all of you, so globalized that even 100 million dollars can be moved in a flash by means of computers. In times like this, it is, put simply and as far as I see it, a challenge to humanity in the 21st century to deal with the question of how to democratically control the advancement of financial engineering, or the economic globalization and financial globalization, and we are indeed in the process of tackling it, but imposing excessively harsh regulations on markets might cause them to shrink. Government control may pose another issue in that process, but the lack of it, which means applying a laissez-faire or no-restriction approach, might impose one negative effect after another on manufacturing and other industries, as was the case in the economic recession two years ago. In that sense, unlike the 1929 Great Depression, what I think the recent crisis is making us face is a challenge to human wisdom.

As you may be aware, the BOJ is extremely independent. Nevertheless, the government and the BOJ need to communicate closely with each other in implementing monetary policies. The BOJ’s primary mission is, basically, to curb inflation while exercising its independence. At present, Japan is experiencing deflation, and the international community is becoming increasingly aware that it would be extremely difficult to break away from deflation. The soundness of banks will constantly be under the surveillance of the FSA, as a matter of course. Banks are businesses licensed by the Prime Minister, not to mention that they form the core of the economy, so in that sense, it is good that banks are making contributions to stimulate the economy by using the BOJ’s system. I hope they do a good job.

The most important thing is that financial institutions, mainly regional ones, properly and actively exercise their financial intermediary function for SMEs. In this sense, we would like to continue requesting an active exercise of the financial intermediary function while remaining conscious of the end of the fiscal year as you mentioned in your question. Banks should use the Act on Special Measures for Strengthening Financial Functions based on their own management judgment if they find their capital bases inadequate as a result of efforts to actively exercise their financial intermediary function or when they are about to make such efforts and if they have difficulty in raising necessary capital from the market or on a commercial basis alone or face very tough terms.

While deposits may have increased as an ultimate result of the payment of insurance claims, financial institutions have a very significant role to play in protecting the people's lives and industries in the Tohoku region in the wake of the once-in-a-millennium tsunami disaster, so keeping that in mind, we have been working hard since March 11 with a sense of obligation to exercise the FSA's powers to the maximum on behalf of disaster victims. Various reviews have been conducted on financial institutions engaging in policy-based finance, which have been under the jurisdiction of different ministries. Policies concerning financing for small and medium-size enterprises used to be under the jurisdiction of the former Ministry of International Trade and Industry. Meanwhile, other financial matters were under the jurisdiction of the Finance Ministry alone or together with other ministries, as the Financial Services Agency (FSA) did not exist before the authority over fiscal matters was separated from that over financial matters. The reviews covered matters like this. As DBJ is a financial institution, it is naturally under the jurisdiction of the FSA in a broad sense. However, regardless of the ministerial jurisdiction, it is important to deal with financial institutions from the perspective of striking the optimum balance between the public and private sectors.

In any case, as I have said over and over again, loan repayment in the disaster areas is a matter that cannot be dealt with within the scope of private financial institutions' activities alone. The day before yesterday, the House of Councillors unanimously passed the bill to amend the Act on Special Measures for Strengthening Financial Functions. I am grateful for the passage, as this will strengthen the financial functions in a comprehensive manner and reassure depositors in the disaster areas. Although the Diet has undergone an upheaval, as the minister in charge, I am very grateful to the political parties and parliamentary groups in both the House of Representatives and the House of Councillors for passing this bill based on common sense for the sake of people in the disaster areas. Strengthening the financial functions and reassuring depositors is important in times like these.

For me, or for Japan, this is the second crisis in a decade, rather than a once in a century crisis. As you know, Japan experienced a serious financial crisis in the late 1990s, and in my opinion, the previous crisis was more serious than the current one. The previous crisis resulted from the economic bubble created by Japan itself. Banks were deeply involved in the creation of the bubble. Complicated webs of credit-debt relationship, including an arrangement called “tobashi,” were formed. From the viewpoint of borrowers, the bad-loan problem was a problem of excessive debts. In this sense, that crisis was an internally-generated one.

I believe the financial regulatory reform legislation passed by President Barack Obama in the United States is indeed a turnaround comparable to the Copernican Revolution since 1929. With the establishment of the Volcker rule, investment banks and conventional American banks, especially Western banks centering on the United States can no longer perform high-risk, high-return trades on their own accounts except when requested to perform such trades by customers. Relatively speaking, Japanese banks did not excel and engage in such trades. In that sense, the financial sector has experienced dramatic changes, and the real economy has been heavily affected since the Lehman Brothers shockwaveeven in Japan, production at Toyota Motor Corporation dropped by as much as 40 percent at one point.

Furthermore, if the contractual terms of a transaction which are described on the Website Terms of Use are considered common-sense in light of the established business practice, the consent of the user may be deemed to be present relatively easily. However, the consent of the user would have to be explicitly proven with respect to provisions (such as a provision on international arbitration or a provision that withholds the unilateral termination right of the seller (business entity; "jigyo-sha") in internet trading) which may impose disadvantages on the user and which the user normally expects not to be present (as described below, if the user is a consumer, such illegitimate provisions may be deemed invalid in some cases under the Consumer Contract Act).

There is disagreement, about whether listing examinations are actually getting more rigorous nowadays or they are merely adhering to the same criteria but becoming “deeper.” If, however, an exchange’s stance on implementation of listing examinations were largely swayed by several cases of breaches of the law or the mood prevailing in the market, this would not be desirable to promote growth of start-ups in the sense that it would ruin predictability about listing. Larger swings or unpredictability with implementation policies would ultimately hamper venture capitals from supplying capital to start-ups, which might impact the whole venture capitals financing system.

As the issue of financing is involved, the most important thing to do with regard to this bill is to provide appropriate damage compensation to local residents. Also important is the stable supply of electricity, which is essential to industrial activity. Unless the stable supply of electricity is ensured - Tokyo Electric Power is calling for a 15 % cut in electricity usage - GDP will decline considerably. In that sense, from my experience of serving as Parliamentary Vice Minister for International Trade and Industry about 21 years ago, I know that the stable supply of electricity is very important. In particular, the semiconductor industry, which consumes a huge amount of electricity, uses clean rooms that would malfunction if the supply of electricity is suspended even for eight hours. There are many industries like this. Once the supply of electricity is suspended, it may take a very long time to start up again in some cases. In the semiconductor industry, if clean rooms become dirty, tiny circuits on semiconductor chips would short-circuit. Then, they would become useless.

In this context, if we are to proceed with postponing the expiration of the Act, we will properly request various organizations to submit data or conduct interviews with them. When I served as Parliamentary Vice-Minister of International Trade and Industry twenty years ago, I was in charge of SMEs as required as the Parliamentary Vice-Minister of International Trade and Industry appointed from the House of Representatives back then for one year and three months under (former) Minister of International Trade and Industry Eiichi Nakao. Based on such experience, I have been told by SMEs how extremely helpful the Act has been. I may have also told you previously that according to what I have been informed by bureaucrats, a megabank attended a gathering of various financial institutions-a gathering of shinkin banks and credit unions at one of the financial bureaus-for the first time ever since the establishment of the Act. In that sense, my intuition as a politician is that the Act is proving to be extremely effective against the backdrop of the strong yen at this stage when we are considering the possibility of postponing its expiration.

As for the second question regarding what I currently think about such consumer finance companies, generally speaking, my understanding is that although the current business climate for consumer finance companies is harsh, there is still much healthy demand for funds in the consumer finance market. According to one theory I have heard, there are about 15 million users of consumer finance. As there are, of course, sound borrowers in that sense, some financial institutions in other industries such as banks are making aggressive efforts in the field of consumer finance, and in banks and other financial institutions in foreign countries, consumer finance has become a significant business segment. Bearing this in mind, Japan's consumer finance market is a promising market, and moneylenders are expected to take on a significant role in this market. Accordingly, the FSA hopes that moneylenders will become a significant player in the consumer finance market through their own management efforts, according to the objectives of the amended Money Lending Act.

In the course of examination the Patent Office shall: refuse to recognize the subject matter of the application as an invention, in particular where the Office reveals that it does not concern any tangible creation susceptible of application, determined by means of technical features relating to its structure or composition, nor any particular technical way in which it affects a material, nor new use of a substance comprised in the state of the art; (ii)refuse to recognize the subject matter of the application as a new invention, where it may prove that all the technical features of the technical solution or of a variation of the technical solution contained in the application, taken together, are comprised in the state of the art and are not characterized by the production of unexpected effects; recognize the claimed invention that meets the criterion of novelty as a technical solution not involving an inventive step, where the Office may cite those documents from the state of the art, on the basis of which it may reasonably claim that the invention's capability of being carried out or applied is clearly implied by that state of the art, when taking into account average skills of a person skilled in the art; refuse to recognize the subject matter of the application as a technical solution susceptible of industrial application, in particular when it finds that it is infeasible for that solution to be used for manufacturing of the product or for the claimed process to be used in a technical sense.

I spoke with FRB (Federal Reserve Board) Chairman Bernanke two weeks ago and also had a chance to speak with People's Bank of China Governor Zhou Xiaochuan this week. Frankly speaking, this is, as a matter of fact, a kind of issue to be decided on by the global forum of the G20, as it relates to stability of financial institutions worldwide and, at the same time, the definition of capital adequacy, and the quality and quantity debate, among other things. A dozen years or so ago, Japan was hit by a financial crisis. When I was previously a minister, I witnessed something similar – the failure of the Hokkaido Takushoku Bank – which resulted in a credit crunch and credit withdrawal that, as many of you must remember, indeed caused a large number of companies to go under one after another. In that sense, it is not necessarily a positive thing to make a capital adequacy ratio higher and higher.

As we have done every year, we selected cases from the inspection results reported from July of last year to June of this year and published them in the form of the latest Compilation of Problem Cases Raised in Financial Inspections for the 2009 program year, as you've just pointed out, which I expect each financial institution to refer to when formulating its future internal control system. With the successful enactment of the SME Financing Facilitation Act when former Minister Kamei was in office, it is now ensured, as you know, that in times of an economic downturn like the one we currently find ourselves in, financial institutions should adequately address requests for easing lending terms or changing housing loan terms, etc. In a sense, this has achieved a substantial change, if not quite a sea change, from the way financial administration was run in the past, and we need to keep that in mind. I know an SME owner in my hometown who employs about 100 people, about 50 of them being permanent employees and the rest working on a non-permanent basis, and who says that he is able to barely survive thanks to the establishment of the SME Financing Facilitation Act but also speaks out, "Mr. Jimi, we are now desperate for more work." He also goes on to say that "I personally feel that I could close down the business, but I am hanging on, struggling with all my might - because every one of my 100 workers has a family."

Regrettably, more than 5,000 people are still missing, and one year is too long a time to wait for the adjudication of disappearance due to emergency. Therefore, the FSA's director-general in charge held very tough negotiations with the Ministry of Justice, which is responsible for matters related to the certification of the death of missing people. As a result, it has been agreed to allow the death of missing people to be certified three months after their disappearance based on a notification submitted to municipal governments through a simplified procedure. While an arrangement like that is made behind the scenes, life insurance sales women are going from mortuary to mortuary with the relatives of missing people. As I am a doctor by profession, I know well what a great mental shock it is for ordinary people to see the body of a person killed in a disaster like that, but insurance sales women are going as far as to do that. As I told you previously, Ishinomaki Shoko Shinkumi, which could not be contacted for four days after the earthquake, continued to provide loans, with employees working by candle light. In that sense, I am very grateful to various people in the financial sector, including financial institutions, life and non-life insurance companies and securities companies, for dealing with the unprecedented earthquake and tsunami disaster through private-public collaboration. However, I am not so complacent as to believe that we have done enough.

I have jurisdiction over private financial institutions, so the FSA has put into force the Act on Special Measures for Strengthening Financial Functions, which contains provisions for disaster-related special measures, so as to ensure that finance firmly supports recovery efforts. Unusually for a financial act, this act provides a framework under which Deposit Insurance Corporation takes over non-performing loans that are held by Shinkin banks and credit cooperatives after the passage of a certain period of time. Therefore, this act naturally calls on the managers of financial institutions to build up capital based on their own judgment. We enacted the Act on Special Measures for Strengthening Financial Functions, which contains provisions for disaster-related special measures, with the support of all political parties and groups, and also drew up the Guidelines of Workout for Restructuring Debt Owed by Individual Debtors. In addition, prefectural industrial reconstruction organizations and Rehabilitation Support Organization for Companies Damaged by the Great East Japan Earthquake were established in order to resolve the double loan problem, which has become a major issue in the Diet. Many members of the latter organization's secretariat come from the FSA. In that sense, I believe that the FSA is making every possible effort toward restoration and recovery. The FSA will continue to do its utmost to support the recovery of the disaster-stricken areas through such activities as encouraging the active and effective use of various recovery support measures. At the same time, I would like to stress that financial institutions have provided very vigorous cooperation.

Simultaneously, how should insurance be regulated and supervised from now on? I believe insurance in China is not as advanced as in Japan yet. But then again, Japan’s insurance industry has experienced falling stock prices and interest rates over the past decade and suffered a long period of winter-like hardship: the insurance sector, where they have something calledexpense profits”, “interest gain” and “mortality profits”, the interest gain was so squeezed that at one point, negative carry was more than 1 trillion yen. In the United States, the federal government will be establishing a division in charge of insurance for the first time within the federal government organization under the financial reform legislation. As you know, basic supervision of insurance in the United States is conducted on a state-by-state basis. Despite the fact that AIUthe world’s biggest private insurance company—was effectively nationalized in the United States, the insurance industry has been a bit of a blind spot in that any attempts in the past to negotiate with the central government often resulted in being told that it was a matter for the state government. The United States is a federal republic comprised of states, so in that sense, insurance varies from state to state in tax and other aspects.
