Where the decision on the objection under Section 64 has not been made within six months from the date of filing, and where, after the expiry of this time limit, the person filing the objection has filed a request for decision, the appeal from a decision of the Trade Mark Section or Trade Mark Division is directly admissible, in derogation of subsection (1), sentence 1, if the decision on the objection is not made within a period of two months from the receipt of the request.
