４　第一項ただし書及び第二項（第二号を除く。）の規定は、期間を定めて雇用される者であって、その締結する労働契約の期間の末日を介護休業終了予定日（第十三条において準用する第七条第三項の規定により当該介護休業終了予定日が変更された場合にあっては、その変更後の介護休業終了予定日とされた日）とする介護休業をしているものが、当該介護休業に係る対象家族について、当該労働契約の更新に伴い、当該更新後の労働契約の期間の初日を介護休業開始予定日とする介護休業申出をする場合には、これを適用しない。例文帳に追加
