利益審査委員会の英語

出願の審査にあたり審査委員会は，独自に創作された新規(又は独創的)な工業意匠及びひな形が保護による利益を享受し得ることを斟酌しつつ，本法第8条，第9条，第10条及び第11条の遵守状況を確認するものとする。審査委員会は，既知の工業意匠又はひな形と著しく性質を異にしない意匠及びひな形に新規性(又は独創性)がないことを確証する。審査委員会はまた，本質上技術的又は機能的な考慮により要求された意匠及びひな形には保護が及ばないことを確証する。例文帳に追加

When examining the application, the Examination Board shall check the observance of Articles 8, 9, 10 and 11 of the Law, taking into account that the industrial designs and models created in an independent manner, which are new (or original) may benefit from protection.The Board shall establish that the industrial designs and models are not new (or original) if they do not differ significantly from the known designs or models.The Board establishes that such protection shall not be extended to the designs and models dictated essentially by technical or functional considerations. - 特許庁

２　審査官は、前項の場合において、原処分の原因となる事実及び法令の適用（当該審判が第八条の四第一項に係る事件についての審判である場合にあつては、独占的状態に該当する事実）について変更（公正取引委員会規則で定める範囲のものに限る。）の必要があると認めるときは、これを主張することができる。ただし、被審人の利益を害することとなる場合は、この限りでない。例文帳に追加
