第四十条 実用新案及び意匠の特許出願に対して予備審査を行い、これを却下する理由が存在しない場合、国務院専利行政部門が実用新案特許権又は意匠特許権を付与する決定を下し、相応する特許証書を交付する。同時に登記して公告し、実用新案特許権及び意匠特許権は公告日から有効となる。例文帳に追加

Article 40 If no reason for rejection is discerned after preliminary examination of a utility model or design patent application, the patent administration department under the State Council shall make a decision on granting of the utility model or design patent right, issue a corresponding patent certificate, and meanwhile register and announce the same. 第四十一条 国務院専利行政部門は特許再審委員会を設置する。特許出願者は国務院専利行政部門の出願却下の決定に対して不服である場合、通知を受領した日から 3 カ月以内に、特許再審委員会に再審を請求することができる。特許再審査委員会は再審後に決定を下し、かつ特許出願者に通知する。例文帳に追加

Article 41 The patent administration department under the State Council shall establish a patent review board. If a patent applicant is dissatisfied with the decision made by the Patent Administration Department under the State Council on rejecting of the application, he may, within three months from the date of receipt of the notification, file a request with the patent review board for review. 第三十四条 国務院専利行政部門は発明特許の出願を受領後、予備審査により本法の要求に合致していると認めた場合、出願日から満 18 カ月後に公開する。国務院専利行政部門は出願者の請求に基づき、その出願を繰り上げて公開することができる。例文帳に追加

Article 34 Upon receipt of an invention patent application, if the patent administration department under the State Council, after preliminary examination, confirms that the application meets the requirements of this Law, it shall publish the application within 18 full months from the date of application.
