４　この法律において「入札談合等」とは、国、地方公共団体又は特定法人（以下「国等」という。）が入札、競り売りその他競争により相手方を選定する方法（以下「入札等」という。）により行う売買、貸借、請負その他の契約の締結に関し、当該入札に参加しようとする事業者が他の事業者と共同して落札すべき者若しくは落札すべき価格を決定し、又は事業者団体が当該入札に参加しようとする事業者に当該行為を行わせること等により、私的独占の禁止及び公正取引の確保に関する法律（昭和二十二年法律第五十四号）第三条又は第八条第一項第一号の規定に違反する行為をいう。例文帳に追加
