２　前項に規定するもののほか、債務者について破産手続開始の決定がされ、又は保全管理命令が発せられたことを認識しながら、債権者を害する目的で、破産管財人の承諾その他の正当な理由がなく、その債務者の財産を取得し、又は第三者に取得させた者も、同項と同様とする。例文帳に追加

４　前三項の規定にかかわらず、次の各号に掲げる者は、当該各号に定める命令、保全処分又は裁判のいずれかがあるまでの間は、前三項の規定による請求をすることができない。ただし、当該者が破産手続開始の申立人である場合は、この限りでない。例文帳に追加
