For example, in December 2005, U.S. Overseas Bechtel Incorporated filed a complaint involving construction of company apartments by the East Japan Railway Company. The complaint committee investigated the case following the aforementioned procedures and rejected the complaint in January 2006. The committee stated: “The relevant procurement organization (JR-East) has already become a completely private company and should be excluded from this Agreement. However, it should be considered as subject to this Agreement, as long as it is included in the Agreement ANNEX”.
