(2) In patent litigation, provisional measures ?until the contrary is rendered probable ? shall be considered necessary to protect the plaintiff's rights deserving special appreciation if the plaintiff proves that the invention is patented, and he is the patentee or an exploiter entitled to institute proceedings for infringement in his own name.
