(3) As a rule, only a person who in Germany has passed a final state or academic examination in a technical or scientific subject at a university, a university of applied science or agricultural university or a mining academy, who has worked professionally for at least five years thereafter in a scientific or technical field and who is in possession of the requisite legal knowledge shall be appointed a technical member.
