２１　地方公務員法第六条第一項に規定する任命権者又はその委任を受けた者（地方教育行政の組織及び運営に関する法律（昭和三十一年法律第百六十二号）第三十七条第一項に規定する県費負担教職員については、市町村の教育委員会）は、地方公務員法第四条第一項に規定する職員について労働基準法第三十六条第一項本文の規定により同項に規定する労働時間を延長することができる場合において、当該地方公務員法第四条第一項に規定する職員であって小学校就学の始期に達するまでの子を養育するもの（第十七条第一項の規定を適用するとしたならば同項各号のいずれにも該当しないものに限る。）が当該子を養育するために請求した場合で公務の運営に支障がないと認めるときは、その者について、制限時間を超えて当該労働時間を延長して勤務しないことを承認しなければならない。 - 日本法令外国語訳データベースシステム
