    From August 16 to 21, I went on a business trip to the United States. As already reported in brief at the informal gathering with Cabinet ministers today, I visited Washington D.C. and New York, where I met with Federal Reserve Board (FRB) Chairman Ben Bernanke, Treasury Under Secretary Lael Brainard and the President’s economic advisor Paul Volcker, just to name a few. Paul Volcker, who served as FRB Chairman during the 1970s, is the economic advisor to President Barack Obama who created the so-called “Volcker Rule” in the recent financial reform legislation. In the United States, financial deregulation and economic and financial globalization had been a massive trend over the past two or three decades, basically, since the Great Depression in 1929. It was against such a backdrop in the United States that the first radical financial reform legislation in 80 years was established very recently. I asked others during my stay in the United States as to whether it amounted to a change comparable to the Copernican Revolution, and some Americans responded that it was indeed that kind of change. The major global financial trend is changing in the United States, the leading country of finance. I gained firsthand knowledge of this, having met with leading figures of the United States as the Minister for Financial Services and listened to their various opinions.  - 金融庁

    Article 8-3 The provisions of paragraphs 1, 3 to 5 inclusive, 7 to 13 inclusive, 17, 18 and 21 of Article 7-2 shall apply mutatis mutandis to cases where an act is committed in violation of the provisions of item 1 of paragraph 1 of Article 8 (limited to cases of committing an act which falls under unreasonable restraint of trade) or item 2 thereof (limited to cases of entering into an international agreement or an international contract which contains such matters as fall under unreasonable restraint of trade).     I do not think there are any inconsistencies in the logic. If my memory serves me correctly, the “pay-off” scheme was established around 1971—back then, many banks went bankrupt. In my personal experience, while I served as Minister in the Second Hashimoto Cabinet from 1997 to 1998, Hokkaido Takushoku Bank went bankrupt, Yamaichi Securities collapsed, and dozens of financial institutions failed in Japan at the time. As depositors were extremely anxious back then due to the collapse of many financial institutions, the government decided not to implement the “pay-off” scheme between 1996 and March 2002 despite the existence of legal provisions. Today, financial conditions have somewhat settled since the collapse of Ashikaga Bank, and Japan’s financial climate is calm on the whole, notwithstanding the Lehman Brothers shockwave on a global scale. At the end of the day, I believe depositors need to choose banks based on the principle of self-responsibility. At the same time, there is one thing I would like to emphasize especially to top management executives—the borrowers. They should feel very sorry to depositors if the “pay-off” scheme is implemented. Individuals with 10 million yen in deposits plus interest who are entitled to receive provisional payback under the Deposit Insurance Act will ultimately have the amount reduced to a certain extent, thereby causing substantial trouble to depositors. In that sense, all top management executives and others involved in the management of Japanese financial institutions should re-acknowledge the gravity of their management responsibility for financial business.  - 金融庁

    (6) The provisions of Article 868(3) (Jurisdiction over Non-Contentious Cases), Article 871 (Appending of the Reason), Article 874 (limited to the portion pertaining to item (i)) (Restrictions on Appeal), Article 875 (Exclusion from Application of the Provisions of the Non-Contentious Cases Procedures Act), and Article 876 (Supreme Court Rules) of the Companies Act shall apply mutatis mutandis to appointment of a special agent set forth in Article 707 of the Companies Act as applied mutatis mutandis pursuant to the preceding paragraph, the provisions of Article 868(3) (Jurisdiction over Non-Contentious Cases), Article 869 (Prima Facie Showing), Article 871 (Appending of the Reason), Article 874 (limited to the portion pertaining to item (iv)) (Restrictions on Appeal), Article 875 (Exclusion from Application of the Provisions of the Non-Contentious Cases Procedures Act), and Article 876 (Supreme Court Rules) of that Act shall apply mutatis mutandis to the resignation of a Specified Trust Administrator under Article 711(3) of that Act as applied mutatis mutandis pursuant to the preceding paragraph, and the provisions of Article 868(3) (Jurisdiction over Non-Contentious Cases), Article 870 (limited to the portion pertaining to item (iii)) (Hearing of Statements), the main clause of Article 871 (Appending of the Reason), Article 872 (limited to the portion pertaining to item (iv)) (Immediate Appeal), Article 875 (Exclusion from Application of the Provisions of the Non-Contentious Cases Procedures Act), and Article 876 (Supreme Court Rules) of that Act shall apply mutatis mutandis to the dismissal of a Specified Trust Administrator under Article 713 of that Act as applied mutatis mutandis pursuant to the preceding paragraph.     (2) When an official leaves government position, upon the request of an appointer to be a national public servant in the special service, a local public officer, or an employee of a public financial corporation as provided for in Article 1 of the Act on Budget and Settlement of Public Financial Corporations (Act No. 99 of 1951), or any other juridical person provided for by rules of the National Personnel Authority among those whose business is related closely to national affairs or undertakings (hereinafter referred to as "a national public servant in the special service, etc." in this paragraph), and then, after holding office without interruption as a national public servant in the special service, etc., is employed without interruption as an official on premise of the said leaving of government position (including the case of an official who holds one or more offices without interruption as a national public servant in the special service, etc. after holding another office as a national public servant in the special service, etc., and then is employed as an official on the premise of the said leaving of government position), in the cases where, during the continuous period of holding office as an official up to the said leaving of government position (in the case of an official who leaves government position similarly (hereinafter referred to as "the previous leaving of government position" in this paragraph) before the said leaving of government position, holds office as a national public servant in the special service, etc., and is employed as an official, including the continuous period of holding office as an official up to the previous leaving of government position, hereinafter referred to as "the period of holding office before leaving of government position responding to the request" in this paragraph), he/she falls under any of the items in the preceding paragraph, any of the disciplinary actions provided for in the same paragraph may be taken.     Article 115-16 (1) A mayor of a Municipality, when it is determined that a Designated Provider of Community-Based Service for Preventive Long-Term Care does not act in compliance with the provision provided when providing said appointment as service provider pursuant to the provisions of Article 115-11, paragraph (5), does not meet the standards as determined by an Ordinance of the Ministry of Health, Labour, and Welfare as set forth in Article 115-13, paragraph (1) or the fixed minimum number of employees as determined by an Ordinance of the Ministry of Health, Labour, and Welfare as set forth in the same paragraph or standards concerning employees that engage in Designated Community-Based Preventive Service of Long-Term Care provided by paragraph (4) of the same Article, with regard to knowledge, skill, or number of employees of the Business Office pertaining to said appointment as service provider, or when it is determined that said Community-Based Preventive Long-Term Care Service does not operate an appropriate Designated Community-Based Preventive Service of Long-Term Care in accordance with standards concerning effective support methods for Prevention of Long-Term Care pertaining to a Designated Provider of Community-Based Service for Preventive Long-Term Care and standards concerning facilities and management of the business of Designated Community-Based Preventive Service of Long-Term Care as prescribed in paragraph (2) or paragraph (4) of the same Article, may specify a due date and recommend to said Designated Provider of Community-Based Service for Preventive Long-Term Care to act in compliance with the provisions provided when determining said appointment as service provider pursuant to the provisions of Article 115-11, paragraph (5), to comply with the standards as determined by an Ordinance of the Ministry of Health, Labour, and Welfare as set forth in Article 115-13, paragraph (1), to employ the number of employees as determined by an Ordinance of the Ministry of Health, Labour, and Welfare as set forth in the same paragraph, to comply with standards concerning employees that engage in Designated Community-Based Preventive Service of Long-Term Care as prescribed in paragraph (4) of the same Article, and to comply with standards concerning effective support methods for Prevention of Long-Term Care pertaining to a Designated Provider of Community-Based Service for Preventive Long-Term Care and standards concerning facilities and management of the business of Designated Community-Based Preventive Service of Long-Term Care as prescribed by paragraph (2) and paragraph (4) of the same Article.  - 日本法令外国語訳データベースシステム

    I have jurisdiction over private financial institutions, so the FSA has put into force the Act on Special Measures for Strengthening Financial Functions, which contains provisions for disaster-related special measures, so as to ensure that finance firmly supports recovery efforts. Unusually for a financial act, this act provides a framework under which Deposit Insurance Corporation takes over non-performing loans that are held by Shinkin banks and credit cooperatives after the passage of a certain period of time. Therefore, this act naturally calls on the managers of financial institutions to build up capital based on their own judgment. We enacted the Act on Special Measures for Strengthening Financial Functions, which contains provisions for disaster-related special measures, with the support of all political parties and groups, and also drew up the Guidelines of Workout for Restructuring Debt Owed by Individual Debtors. In addition, prefectural industrial reconstruction organizations and Rehabilitation Support Organization for Companies Damaged by the Great East Japan Earthquake were established in order to resolve the double loan problem, which has become a major issue in the Diet. Many members of the latter organization's secretariat come from the FSA. In that sense, I believe that the FSA is making every possible effort toward restoration and recovery. The FSA will continue to do its utmost to support the recovery of the disaster-stricken areas through such activities as encouraging the active and effective use of various recovery support measures. At the same time, I would like to stress that financial institutions have provided very vigorous cooperation.  - 金融庁
