(8) Where a domestic corporation, which was subject to the provisions of paragraph (1) for calculating the amount of income of the specified foreign subsidiary company, etc. in its settlement of accounts for the relevant business year, seeks the application of paragraph (2) for calculating the amount of income of the said specified foreign subsidiary company, etc. in its settlement of accounts for the relevant business year in business years following the one to which the provisions of paragraph (1) have been applied; or where a domestic corporation, which was subject to the provisions of paragraph (2) for calculating the amount of income of the specified foreign subsidiary company, etc. in its settlement of accounts for the relevant business year, seeks the application of paragraph (1) for calculating the amount of income of the specified foreign subsidiary company, etc. in its settlement of accounts for the relevant business year in business years following the one to which the provisions of paragraph (2) have been applied, it shall receive approval from the competent district director having jurisdiction over its place for tax payment, in advance.

Article 94 Where a Foreign Insurance Company, etc. Licensed under the Former Foreign Insurance Business Operators Act has applied, by the time when this Act enters into force, for the authorization of the competent minister pertaining to the modification of any of the matters prescribed in the documents listed in Article 4, paragraph (4), items (ii) to (v) inclusive of the Former Foreign Insurance Business Operators Act pursuant to the provision of Article 10, paragraph (1) of the Former Act as applied mutatis mutandis pursuant to Article 19 of the Former Foreign Insurance Business Operators Act, such application shall be deemed as an application for the authorization of the Minister of Finance set forth in Article 123, paragraph (1) of the Current Act as applied mutatis mutandis pursuant to Article 207 of the Current Act. 4. By derogation from Article 18.1(b), a collective mark may consist of signs or references which may serve in trade as a designation of the geographic origin of the goods or services. In such case, however, the Office may refuse a registration, by means of a decision stating its grounds, if the marks applied for could create a situation of unjustified privilege or be otherwise detrimental to the development of other similar initiatives in the region. The above-mentioned Office may solicit the opinion in such case of governmental bodies and interested or competent agencies and bodies. Once granted, the registration of a collective mark consisting of a geographic name shall not entitle the proprietor to prohibit others from using the same name in the course of trade, provided that such use is in accordance with honest practice and is therefore limited to the function of an indication of origin. 2. Where by reason of the provisions of paragraph 1, an individual is a resident of both Contracting Parties, then his status shall be determined as follows: (a) he shall be deemed to be a resident only of the Contracting Party in which he has a permanent home available to him; if he has a permanent home available to him in both Contracting Parties, he shall be deemed to be a resident only of the Contracting Party with which his personal and economic relations are closer (centre of vital interests); (b) if the Contracting Party in which he has his centre of vital interests cannot be determined, or if he has not a permanent home available to him in either Contracting Party, he shall be deemed to be a resident only of the Contracting Party in which he has an habitual abode; (c) if he has an habitual abode in both Contracting Parties or in neither of them, the competent authorities of the Contracting Parties shall settle the question by mutual agreement.

Article 7 (1) A nuclear operator shall, pursuant to the provisions of an ordinance of the competent ministry, prepare a nuclear operator emergency action plan with regard to its measures to prevent nuclear emergency, emergency response measures, and measures for restoration from nuclear emergency and other duties that are necessary for preventing the occurrence and progression (expansion) of a nuclear disaster and for promoting nuclear disaster recovery efforts, with respect to each of its nuclear sites, and review its nuclear operator emergency action plan every year and revise it if revision is found to be necessary. (8) To accelerate the patent granting procedure, the Federal Minister of Justice shall be empowered to direct by statutory order that 1. the search for the publications specified in subsection (1) be assigned to a division of the Patent Office other than the Examining Section (Section 27(1)) or to another national or international institution, either as a whole or for certain technical fields or certain languages, provided that the institution concerned appears competent to search for publications to be taken into consideration; 2. the Patent Office shall provide foreign or international authorities with data from the files of patent applications for reciprocal information on the results of examination procedures and searches of the state of the art when the applications concerned relate to inventions for which the grant of a patent has also been applied to such foreign or international authorities; 3. the examination of patent applications according to Section 42 and the supervision of fees and time limits shall be transferred in whole or in part to divisions of the Patent Office other than the Examining Sections or Patent Divisions (Section 27(1)).

For the purposes of this Article: (a) the term “disproportionate class of shares” means any class of shares of a company that is a resident of a Contracting State which is subject to terms or other arrangements that entitle the holders of that class of shares to a portion of the income of the company derived from the other Contracting State that is larger than the portion such holders would receive absent such terms or arrangements; (b) the term “recognized stock exchange” means: (i) any stock exchange established under the terms of the Securities and Exchange Law(Law No. 25 of 1948) of Japan; (ii) the NASDAQ System and any stock exchange registered with the Securities and Exchange Commission as a national securities exchange under the Securities Exchange Act of 1934 of the United States; and (iii) any other stock exchange agreed upon by the competent authorities; and (c) the term “gross income” means the total revenues derived by a resident of a Contracting State from its business, less the direct costs of obtaining such revenues.

Article 100-4 The matters specified by an ordinance of the competent ministry as prescribed in Article 10-2, item (i) of the Order shall be the amounts or the upper limits of the considerations to be paid by a customer with regard to a Brokerage Contract, whether they are known as fees, remunerations, expenses or by any other name (excluding values pertaining to receipt or delivery, the amount of the consideration for the transactions prescribed in Article 2, paragraph (8), item (iv) of the Act, and the amount of Clearing Margin, etc. [which means the Clearing Margin, etc. prescribed in Article 217, paragraph (1), item (i) of the Act; the same shall apply hereinafter]; referred to as "Fees, etc." in this Article and Article 100-6), by type of consideration, or the outline of their calculation method (including the percentage to the Amount of Transactions [which means the Amount of Transactions prescribed in Article 10-2, item (iii) of the Order] based on said Brokerage Contract), and the sum of such amounts, or the upper limit thereof or the outline of their calculation method; provided, however, that, in cases where it is not possible to indicate these, said matters shall be a statement to that effect and the reason therefor.

(3) The certification of the preceding two paragraphs shall be granted by evaluating whether or not the mineral or industrial product complies with the relevant Japanese Industrial Standards by conducting product testing (i.e. the test, analysis, or measurement as conducted in accordance with the provisions of the Japanese Industrial Standards; the same shall apply hereinafter) of a sample/samples of such mineral or industrial product that relates to the application by the manufacturer, importer or distributor of the mineral or industrial product (hereinafter referred to as the "Manufacturer, etc.") and also by evaluating whether or not the manufacturing quality management system (i.e. the technical production conditions required for maintaining quality of products including manufacturing facilities, inspection facilities, inspection methods, quality management methods, etc.; the same shall apply hereinafter) that relates to the application, by the Manufacturer, etc. complies with the criteria specified in the applicable Ordinance of the competent ministry. However, if the evaluation is conducted concerning whether or not the mineral or industrial product complies with the relevant Japanese Industrial Standards by conducting product testing for all of the mineral or industrial products related to said application, the evaluation of the manufacturing quality management system may be omitted.

Article 16-2 Where the competent minister has imposed the obligation to obtain permission pursuant to the provision of paragraph 1 of the preceding article, when he/she finds a risk that a person who has made payment, etc., for which the obligation to obtain the permission is imposed, without obtaining the permission will make payment, for which the obligation to obtain permission is imposed pursuant to the provision of the said paragraph, again without obtaining the permission, he/she may, for a period of not more than one year, prohibit the person from making, in whole or in part, payment from Japan to a foreign state (excluding payment through exchange transactions conducted by banks (meaning banks prescribed in Article 2, paragraph 1 of the Banking Act (Act No. 59 of 1981); the same shall apply hereinafter) or other financial institutions specified by Cabinet Order (hereinafter referred to as the "Banks, etc.") and payment, etc. made between a resident and a non-resident (excluding payment, etc. resulting from exchange transactions conducted by the Banks, etc. or other payment, etc. specified by Cabinet Order), or may impose, pursuant to the provisions of Cabinet Order, on the person, the obligation to obtain permission for such payment and payment, etc.

(4) When the competent minister finds that if service transactions between a resident and a non-resident (excluding those pertaining to Specified Technology prescribed in paragraph 1, item 1 and those which fall under the conclusion of a technology introduction contract, etc. prescribed in Article 30, paragraph 1) or transactions related to the buying and selling of goods involving the movement of goods between foreign states (excluding those prescribed in paragraph 1, item 2) (hereinafter referred to as the "Service Transactions, etc.") are conducted without any restrictions, it will cause a situation that prevents Japan from sincerely fulfilling obligations under the treaties and other international agreements it has signed or from making its contribution to international efforts for achieving international peace, which will make it difficult to achieve the purpose of this Act, or when a cabinet decision set forth in Article 10, paragraph 1 has been made, he/she may impose, pursuant to the provisions of Cabinet Order, on a resident who intends to conduct the Service Transactions, etc., the obligation to obtain permission for the implementation of the Service Transactions, etc.
4 主務大臣は、居住者が非居住者との間で行う役務取引(第一項第一号に規定する特定技術に係るもの及び第三十条第一項に規定する技術導入契約の締結等に該当するものを除く。)又は外国相互間の貨物の移動を伴う貨物の売買に関する取引(第一項第二号に規定するものを除く。)(以下「役務取引等」という。)が何らの制限なしに行われた場合には、我が国が締結した条約その他の国際約束を誠実に履行することを妨げ、若しくは国際平和のための国際的な努力に我が国として寄与することを妨げることとなる事態を生じ、この法律の目的を達成することが困難になると認めるとき又は第十条第一項の閣議決定が行われたときは、政令で定めるところにより、当該役務取引等を行おうとする居住者に対し、当該役務取引等を行うことについて、許可を受ける義務を課することができる。 - 日本法令外国語訳データベースシステム
Article 54-2 (1) The Minister of Health, Labour and Welfare shall designate providers in charge of in-home care services, preparation of in-home care support plans, furnishing of welfare equipment, facility care services, care prevention services, preparation of care prevention support plans, or furnishing of welfare equipment for care prevention for long-term care assistance under this Act with regard to community-based long-term care welfare facilities for the elderly, long-term care welfare facilities for the elderly, or long-term care health facilities for the elderly established by the State by obtaining the consent of the competent minister, and a prefectural governor shall designate such providers with regard to any other community-based long-term care welfare facilities for the elderly, long-term care welfare facilities for the elderly or long-term care health facilities for the elderly, or persons who provide in-home care services as their business, persons who prepare in-home care support plans as their business, specified welfare equipment dealers, persons who provide care prevention services as their business, community comprehensive support centers or specified care prevention welfare equipment dealers by obtaining the consent of the founder, the person himself/herself, or the establisher.
第五十四条の二 厚生労働大臣は、国の開設した地域密着型介護老人福祉施設、介護老人福祉施設又は介護老人保健施設についてその主務大臣の同意を得て、都道府県知事は、その他の地域密着型介護老人福祉施設、介護老人福祉施設若しくは介護老人保健施設、その事業として居宅介護を行う者若しくはその事業として居宅介護支援計画を作成する者、特定福祉用具販売事業者、その事業として介護予防を行う者若しくは地域包括支援センター又は特定介護予防福祉用具販売事業者について開設者、本人又は設置者の同意を得て、この法律による介護扶助のための居宅介護若しくは居宅介護支援計画の作成、福祉用具の給付、施設介護、介護予防若しくは介護予防支援計画の作成又は介護予防福祉用具の給付を担当させる機関を指定する。 - 日本法令外国語訳データベースシステム
(3) A Futures Commission Merchant who has received a license under Article 41, paragraph (1) of the Act with regard to gold to be listed on a Commodity Market established by the Tokyo Gold Exchange (hereinafter referred to a "License with regard to Gold") at the time of the enforcement of this Cabinet Order shall be deemed to have received a license under Article 41, paragraph (1) of the Act with regard to precious metals (limited to gold) to be listed on a Commodity Market established by the Tokyo Gold Exchange, during the period from the day on which the Tokyo Gold Exchange received the approval of the competent minister under Article 20, paragraph (1) of the Act with regard to an amendment in its articles of incorporation for listing precious metals until the day preceding the day on which buying and selling transactions of silver of platinum commenced on the Tokyo Gold Exchange (hereinafter referred to as the "Commencement Date of Buying and Selling Transactions") (in the case where he/she received a license under Article 41, paragraph (1) of the Act with regard to precious metals to be listed on a Commodity Market established by the Tokyo Gold Exchange prior to this day, the day preceding the day on which he/she received said license).

(11) The Registrar shall consider the application with regard to the following matters, that is to say . I have been informed that all of Takefuji's loans are personal loans, of which approximately 10% are for individuals running their own businesses. I might also add that even after corporate rehabilitation procedures commence, borrowers should continue making repayments on agreed-on terms. I indeed commented on borrowers in my previous press conference but, at this point in time, I cannot make any clear reference as to any impact on SMEs, micro-enterprises and so on, except that, from the viewpoint of providing smooth financing for individuals, the Financial Services Agency (FSA) did request government-affiliated financial institutions and private financial institutions nationwide, through competent authorities and financial organizations, to respond attentively to any requests for financing consultation and other matters brought from Takefuji customers and anyone else with concerns. Having been requested by the FSA, the Ministry of Economy, Trade and Industry is in the process of taking relevant steps, including setting up special sections to serve SMEs, in response to Takefuji's filing for corporate reorganization proceedings.

(4) The Order Concerning Reports of Foreign Exchange Banks and Money Exchangers, the Export Trade Control Order, the Import Trade Control Order, the Foreign Exchange Control Order, or the Foreign Exchange Control Commission Rules, Ordinance of the Prime Minister's Office, Ordinance of the Ministry of Finance or Ordinance of the Ministry of International Trade and Industry based on the Cabinet Order Concerning Temporary Special Provisions of the Foreign Exchange Control Order, etc., upon Implementation of the Administrative Agreement under Article III of the Security Treaty between Japan and the United States of America, or an Ordinance of the Prime Minister's Office or Ordinance of the Ministry of International Trade and Industry, all of which are effective at the time of enforcement of this Cabinet Order and have not yet been revised, shall be effective, after the enforcement of this Cabinet Order, as the Order Concerning Reports of Foreign Exchange Banks and Money Exchangers, the Export Trade Control Order, the Import Trade Control Order, the Foreign Exchange Control Order, or the relevant ordinance of the competent ministry, Ordinance of the Ministry of Finance or Ordinance of the Ministry of International Trade and Industry based on the Cabinet Order Concerning Temporary Special Provisions of the Foreign Exchange Control Order, etc. upon Implementation of the Administrative Agreement under Article III of the Security Treaty between Japan and the United States of America, or an Ordinance of the Ministry of Finance or Ordinance of the Ministry of International Trade and Industry, all of which have been revised.

In this case, the phrase "paragraph (1) of the preceding Article" in Article 424 of the same Act shall be deemed to be replaced with "Article 53, paragraph (1) of the Commodity Exchange Act," the term "an officer, etc." in Article 430 of the same Act shall be deemed to be replaced with "the president or a director," the term "another officer, etc." in the same Article shall be deemed to be replaced with "also an auditor," the term "an Ordinance of the Ministry of Finance" in Article 847, paragraphs (1) and (4) of the same Act shall be deemed to be replaced with "an ordinance of the competent ministry" and any other technical replacement shall be specified by a Cabinet Order.

(3) Where an application for the approval under paragraph (1) of the preceding Article has been filed in which case the term of existence of a Commodity Exchange (in the case of a Incorporated Commodity Exchange, the term of existence as an Incorporated Commodity Exchange) or the expiration date of a Commodity Market is stated in the articles of incorporation, the competent minister shall, in lieu of the criterion set forth in paragraph (1), item (ii), consider the criterion under the same paragraph to be that there will be no shortfall in the volume of transactions for carrying out Futures Transactions of the Listed Commodity or Listed Commodity Index pertaining to the application fairly and smoothly and that, in light of the status of the transactions of the Listed Commodity Component Products, etc., survival of a Commodity Exchange for carrying out said Futures Transactions through a merger or the establishment of a Commodity Exchange for carrying out said Futures Transactions by a merger does not or is not likely to cause extreme hindrance to the production and distribution of the Listed Commodity Component Products, etc., and he/she shall apply such criterion and the criteria under items (iii) and (iv) of the same paragraph by making a determination for said term of existence or for the period until said expiration date.

Article 39 (1) Where a Supervisor violates any of the provisions of Article 33-2, Article 34 (1), (3), or (4), Article 35, Article 36, Article 36-3, or Article 37 or conducts any of the acts listed in the respective items of Article 38 (1), or where a solicitor violates any of the provisions of Article 33-2, Article 34 (1), (3), or (4), Article 35, Article 36, or Article 36-3 or conducts any of the acts listed in Article 38 (1) (ii) to (iv), if the competent minister finds the act to involve the risk of impairing the fairness of the Multilevel Marketing Transactions or harming the interests of the counterparty of the Multilevel Marketing Transactions or if the Supervisor does not follow the order under the provision of Article 38 (1), he/she may order the Supervisor to suspend from soliciting or having a solicitor solicit said Multilevel Marketing Transactions pertaining to Multilevel Marketing or to suspend the Supervisor's Multilevel Marketing Transactions in whole or in part by specifying a time limit of no longer than one year.
