Article 10 (1) Notwithstanding Article 9(1) or (2), an applicant for design registration may obtain design registration of a design that is similar to another design selected from the applicant's own designs either for which an application for design registration has been filed or for which design registration has been granted (hereinafter the selected design is referred to as the "Principal Design" and a design similar to it is referred to as a "Related Design"), if the filing date of the application for design registration of the Related Design (or when the application for design registration of the Related Design contains a priority claim under Article 43(1), 43-2(1) or 43-2(2) of the Patent Act (Act No. 121 of 1959) as applied mutatis mutandis under Article 15 of this Act, the filing date of the earliest application, the filing date of an application that is deemed to be the earliest application under Article 4.C(4) of the Paris Convention for the Protection of Industrial Property of March 20, 1883, as revised at Brussels on December 14, 1900, at Washington on June 2, 1911, at Hague on November 6, 1925, at London on June 2, 1934, at Lisbon on October 31, 1958, and at Stockholm on July 14, 1967, or the filing date of an application that is recognized as the earliest application under Article 4.(A)2 of the Paris Convention, hereinafter the same shall apply in this paragraph) is on or after the filing date of the application for design registration of the Principal Design and before the date when the design bulletin in which the application for design registration of the Principal Design is published under Article 20(3) (except for a design bulletin in which the matters listed in Article 20(3)(iv) were published under Article 20(4)) is issued.

(24) Where a person in charge of handling custody and payment is entrusted by subcontract with custody of other specified foreign private bonds with the same issue as that of the specified foreign private bonds of which the person is directly entrusted with custody, when the person has received notice, as the relay point via which the notice shall be given pursuant to the provisions of Article 6, paragraph (7) of the Act, with regard to the interest recipient information for the interest from said other specified foreign private bonds, the person may, pursuant to the provisions of Ordinance of the Ministry of Finance, give notice to provide the interest recipient information for the specified foreign private bonds of which the person is directly entrusted with custody together with the interest recipient information of which the person has received notice as such relay point, to the person who pays the interest (in the case where the interest is delivered via any other person in charge of handling payment with whom said person in charge of handling custody and payment has further entrusted custody, notice shall be given to the person who pays the interest via such other person in charge of handling payment). In this case, said notice shall be deemed to be notice of the interest recipient information given pursuant to the provisions of paragraph (7) of said Article.

(1) When an accused charge with an offence under section 73 or section 74 of this Actin relation to a registered trademark pleads that the registration of the trademarks is invalid, the following procedures shall be followed- (a) if the Magistrate is satisfied that such defense is prima facie tenable, he shall not proceed with the charge but shall adjourn the proceeding for three months from the date on which the plea of the accused is recorded to enable the accused to file an application before the High Court Division under this Act, for the rectification of the Register on the ground that the registration is invalid. (9) When an entrepreneur of juridical person, the appointment and dismissal of officers or the conduct or existence in business of which is controlled by another entrepreneur of juridical person whose capital or total contributions exceeds 10 million yen, receives a manufacturing or other contract from the said entrepreneur and subcontracts of all or a considerable part of the act of manufacture, repair, creation or provision pertaining to such manufacturing or other contract with a third entrepreneur (excluding the cases where a person coming under items (i) or (ii) of Paragraph 7 above concludes the manufacturing or other contract with another person who falls under items (i) or (ii) respectively of the preceding paragraph and cases where a person falling under items (iii) and (iv) of the paragraph above concludes an information-based product creation contract or a service contract with another person who falls under items (iii) and (iv) respectively of the preceding paragraph), and when the entrepreneur who receives such subcontract would fall under the items of the preceding paragraph if he were to receive the said manufacturing or other contract directly from the said entrepreneur who controls the appointment and dismissal of officers, or conduct or existence in the business, the entrepreneur who concludes such subcontract shall be deemed, in the application of this Act, to be a main subcontracting entrepreneur and the entrepreneur who receives such subcontract shall be deemed to be a subcontractor.

Article 115-16 (1) A mayor of a Municipality, when it is determined that a Designated Provider of Community-Based Service for Preventive Long-Term Care does not actin compliance with the provision provided when providing said appointment as service provider pursuant to the provisions of Article 115-11, paragraph (5), does not meet the standards as determined by an Ordinance of the Ministry of Health, Labour, and Welfare as set forth in Article 115-13, paragraph (1) or the fixed minimum number of employees as determined by an Ordinance of the Ministry of Health, Labour, and Welfare as set forth in the same paragraph or standards concerning employees that engage in Designated Community-Based Preventive Service of Long-Term Care provided by paragraph (4) of the same Article, with regard to knowledge, skill, or number of employees of the Business Office pertaining to said appointment as service provider, or when it is determined that said Community-Based Preventive Long-Term Care Service does not operate an appropriate Designated Community-Based Preventive Service of Long-Term Care in accordance with standards concerning effective support methods for Prevention of Long-Term Care pertaining to a Designated Provider of Community-Based Service for Preventive Long-Term Care and standards concerning facilities and management of the business of Designated Community-Based Preventive Service of Long-Term Care as prescribed in paragraph (2) or paragraph (4) of the same Article, may specify a due date and recommend to said Designated Provider of Community-Based Service for Preventive Long-Term Care to actin compliance with the provisions provided when determining said appointment as service provider pursuant to the provisions of Article 115-11, paragraph (5), to comply with the standards as determined by an Ordinance of the Ministry of Health, Labour, and Welfare as set forth in Article 115-13, paragraph (1), to employ the number of employees as determined by an Ordinance of the Ministry of Health, Labour, and Welfare as set forth in the same paragraph, to comply with standards concerning employees that engage in Designated Community-Based Preventive Service of Long-Term Care as prescribed in paragraph (4) of the same Article, and to comply with standards concerning effective support methods for Prevention of Long-Term Care pertaining to a Designated Provider of Community-Based Service for Preventive Long-Term Care and standards concerning facilities and management of the business of Designated Community-Based Preventive Service of Long-Term Care as prescribed by paragraph (2) and paragraph (4) of the same Article.

(5) The normal profit margin specified by a Cabinet Order prescribed in Article 68-88(2)(i)(b) of the Act shall be the ratio of the amount of gross profits gained by a person who purchased the same or similar inventory assets as those for a foreign affiliated transaction prescribed in paragraph (1) of the said Article (hereinafter referred to as a "foreign affiliated transaction" in this Article) from a person who is not in a special relationship (meaning a special relationship prescribed in the said paragraph) (hereinafter such person who is not in such special relationship shall be referred to as a "non-affiliated person" through to paragraph (7) and such person who purchased such inventory assets shall be referred to as a "reseller" in this paragraph and paragraph (7)(ii)) through a transaction to sell the said same or similar inventory assets to a non-affiliated person (hereinafter referred to as a "comparison purpose transaction" in this paragraph) (such gross profits shall mean the amount obtained by deducting the sum of the costs of the said inventory assets for a comparison purpose transaction from the total revenue arising from the sale of the said inventory assets for a comparison purpose transaction) against the sum of the said revenue; provided, however, that where functions performed by the selling side or any other matters differ between a comparison purpose transaction and a transaction in which the purchasing side of the said inventory assets for a foreign affiliated transaction sold the inventory assets to a non-affiliated person, such normal profit margin shall be the ratio after making the necessary adjustment for the differences in ratios caused by such disparity.

(4) Where the Registrar is of the opinion that any document submitted to him - (a) contains any matter contrary to law; or (b) by reason of any omission or misdescription has not been duly completed; or (c) does not comply with the requirements of this Act; or (d) contains any error, alteration or erasure, he may refuse to receive or register the document and request that the document be appropriately amended or completed or re-submitted, or that a fresh document be submitted in its place. (5) On request, as many annual fees shall be included in the legal aid as are necessary to avoid a limitation opposing a grant of legal aid under Section 115(3) of the Code of Civil Procedure. The installments paid shall be set off against the annual fees only when the costs of the patent-granting procedure, including costs possibly arising for an assigned representative, are covered by the payment of the installments. Where the annual fees can be considered as paid by the payment of the installments, Section 5(2) of the Patent Cost Act shall apply mutatis mutandis.

(3) Notwithstanding anything contained in sub-section (1), where an offence under this Act has been committed by a company and it is proved that the offence has been committed with consent or connivance of, or that the commission of the offence is attributable to any neglect on the part of, any director, manager, secretary or other officer of the company, such director, manager, secretary or other officer of the company shall also be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly.

Where a representation is made to the Central Government by or on behalf of any trade or industry that in the interest of the trade or industry it is expedient to dispense with or modify as regards any class or description of articles any of the requirements of this section as to marking, the Central Government may, if it thinks fit, by rule under this Act, dispense with or modify such requirements as regards any such class or description of articles to such extent and subject to such conditions as it thinks fit. 業界又は産業の利益のために,何らかの区分又は種類の物品について,標章に関する本条の何れかの要件を免除又は修正することが便宜である旨の陳情が,業界又は産業の立場から中央政府に対してされる場合において,中央政府は,適当と認めるときは,本法に基づく規則により,適当と認める範囲で,かつ,適当と認める条件を付して,当該区分又は種類の物品について,当該要件を免除又は修正することができる。 - 特許庁
An application that has been rejected by an examiner shall not be amended after the expiry of the time for responding to the examiner’s requisition, made pursuant to subsection 30(4), except (a) where the rejection is withdrawn in accordance with subsection 30(5); (b) where the Commissioner is satisfied after review that the rejection is not justified and the applicant has been so informed; (c) where the Commissioner has informed the applicant that the amendment is necessary for compliance with the Act and these Rules; or (d) by order of the Federal Court or the Supreme Court of Canada.

In considering the amount of any compensation for Government use of an invention after publication of an application for a standard patent for the invention and before such a patent is granted, the court shall consider whether or not it would have been reasonable to expect, from a consideration of the application as published that a patent would be granted conferring on the proprietor of the patent protection for an act of the same description as that found to constitute that use, and if the court finds that it would not have been reasonable, it shall reduce the compensation to such amount as it thinks just.
