しかし、例えば、不動産物件情報の検索や中古車情報の検索結果などに基づき、個人情報を入力して特定の会社に資料請求を行う場合、商品検索後に個人情報を入力して商品を購入する場合、会員登録による個人情報と結びついたＩＤ及びパスワードを入力してログインした後に検索サイトを利用する場合などは、検索条件、検索ワードの履歴やコンテンツの閲覧履歴等と個人情報を照合して利用することも技術的には可能である。 - 経済産業省 - Other documents relating to the foreign application may consist of the following: (a) A copy of the search reports in English on the corresponding or related foreign application prepared by the European, Japanese or United States Patent Offices, searching authorities under the Patent Cooperation Treaty or by the office where the first patent application was filed. (4)登録官は出願人に対し，実体審査請求書を提出するときに次に掲げるものを提出するよう要求することができる。 (a)マレーシア以外において当該出願人又はその前権利者により，国内，地域又は国際の工業所有権官庁宛に提出された，特許若しくは工業所有権保護に関するその他の権利を求める出願に関する所定の情報又は所定の関係書類 (b)実体審査の請求対象とされている出願においてクレームされている発明と同一又は基本的に同一の発明に関し，特許協力条約に基づく国際調査機関により行われた調査又は審査の結果に関する所定の情報 - 特許庁 - The description shall (a) state the title of the invention, which shall be short and precise and shall not include a trade-mark, coined word or personal name; (b) specify the technical field to which the invention relates; (c) describe the background art that, as far as is known to the applicant, can be regarded as important for the understanding, searching and examination of the invention; (d) describe the invention in terms that allow the understanding of the technical problem, even if not expressly stated as such, and its solution; (e) briefly describe the figures in the drawings, if any; (f) set forth at least one mode contemplated by the inventor for carrying out the invention in terms of examples, where appropriate, and with reference to the drawings, if any; and (g) contain a sequence listing where required by subsection 111(1).
詳細な説明は，次の通りに作成しなければならない: (a) 発明の名称を表示し，それは商標，新造語又は個人の名称を含んではならない。 (b) その発明の関連する技術分野を特定し， (c) 出願人の知る限りにおいて，その発明の理解，調査及び審査に重要であるとみなすことができる背景技術を説明し， (d) 技術的課題及びその解決手段を明白にはそれと記述されていなくても理解することができる用語で発明を説明し， (e) 図面がある場合は，その中の図について簡単に説明し， (f) 発明を実施するための形態のうち発明者が考える少なくとも1形態について，適切なときは実施例を用い，かつ，図面があるときはその図面を引用して記載し，また (g) 第111条(1)により要求される場合は，配列一覧を含める。 - 特許庁 - (8) If international preliminary examination or international search is not performed with respect to a part of an international application on the grounds that the application is not in compliance with the requirement of unity of invention and the applicant has not paid the fee prescribed by the Patent Cooperation Treaty for additional international search or international preliminary examination, the Patent Office shall verify the correctness of the decision of the International Searching Authority or the International Preliminary Examining Authority not to perform international search or preliminary examination with respect to the part of the patent application. If the decision is correct, such parts of the international application which are not in compliance with the requirement of unity of invention are deemed to be withdrawn. Otherwise, the Patent Office shall continue the processing of the international application in full. The Patent Office shall notify the applicant of its decision in writing.
(8) 国際出願が発明の単一性の要件を遵守していないこと，及び出願人が追加の国際調査又は国際予備審査について特許協力条約によって規定されている手数料を納付していないことを理由として，国際出願の一部に関し，国際予備審査又は国際調査が行われていない場合は，特許庁は，国際出願の当該部分について，国際調査又は予備審査を行わないとする国際調査機関又は国際予備審査機関の決定が正しいか否かを検証しなければならない。決定が正しい場合は，国際出願の内，発明の単一性の要件を遵守していない部分は，取り下げられたとみなす。それに該当しない場合は，特許庁は，国際出願の全体について処理を継続しなければならない。特許庁は，その決定を出願人に書面で通知しなければならない。 - 特許庁 - (1) The description shall first state the title of the invention as appearing in the request and shall - (a) specify the technical field to which the invention relates; and (b) indicate the background art which, as far as known to the applicant, can be regarded as useful for the understanding, searching and examination of the invention, and, preferably, cite the documents reflecting such art; and (c) disclose the invention in such terms that it can be understood and state its advantageous effects, if any, with reference to the background art; and (d) briefly describe the figures in the drawings, if any; and (e) set forth at least one mode contemplated by the applicant for carrying out the invention and this shall be done in terms of examples, where appropriate, and with reference to the drawings, if any; and (f) indicate explicitly, when it is not obvious from the description or nature of the invention, the way in which the invention is industrially applicable and the way in which it can be made and used, or, if it can only be used, the way in which it can be used.
(1) 明細書においては，願書に記載されている発明の名称を記載し，かつ (a) 発明が関係する技術分野を明記し， (b) 出願人の知る限りで発明の理解，調査及び審査に役立つと考えられる背景技術を表示し，また，望ましくは当該技術を示す書類を引用し， (c) 理解可能な用語により発明を開示し，また，存在する場合は発明の利点について背景技術に言及しつつ記載し， (d) 存在する場合は図面中の図について簡潔に説明し， (e) 発明を実施するために出願人が考えた少なくとも1の方法を記載し，その場合は，該当するときは実例に基づいて，また，存在する場合は図面に言及して記載するものとし，かつ (f) 明細書又は発明の内容からそれが自明でない場合は，発明を産業上利用できる方法，並びに発明を製造及び使用できる方法，又は使用のみ可能な場合は使用できる方法を明瞭に表示するものとする。 - 特許庁 - (5) The description shall first state the title of the invention as appearing in the request and shall -- (a) specify the technical field to which the invention relates; (b) indicate the background art which, as far as it is known to the applicant, can be regarded as useful for the understanding, searching and examination of the invention; (c) disclose the invention as claimed in such terms that the technical problem, even if not expressly stated as such, and its solution can be understood, and shall state the advantageous effects, if any, of the invention with reference to the background art; (d) briefly describe the figures in the drawings, if any; (e) set forth at least one mode for carrying out the invention claimed, with examples where appropriate, and with reference to the drawings, if any; and (f) indicate explicitly, when it is not otherwise obvious from the description or the nature of the invention, the way or ways in which the invention satisfies the condition in section 13(1)(c) of being capable of industrial application.
(5) 特許出願書類に含む発明の説明は，その冒頭に発明の名称を記載し，次の各号に従うものとする。 (a) 当該発明が関係する技術分野を明記すること (b) 出願人の知る限りにおいて，当該発明の理解，調査及び審査に有用であるとみなすことができる背景技術を明記すること (c) 技術的課題について，そのように明示していない場合を含め，課題及びその解決方法を理解することができるような表現で，クレームする発明を開示すること，並びに，もしあれば，当該発明の有利な効果をその背景技術との関連で述べること (d) もしあれば，図面中の図について簡潔に説明すること (e) クレームする発明を実施するための態様について，適宜実施例を挙げ，かつ，もしあれば図面を引用して，少なくとも1以上記述すること，及び (f) 当該発明が産業上の利用可能性に関する第13条(1)(c)の条件を満たす方法が，当該発明の説明又は内容から明白でない場合は，明確に表示すること - 特許庁
