  • 6. We commit to pursuing the reform of the financial sector. Despite good progress, significant work remains. We will implement fully the Basel III new standards for banks within the agreed timelines while taking due account of the agreed observation periods and review clauses in respect of the liquidity standards. Likewise, we will implement in an internationally consistent and non-discriminatory way the FSB's recommendations on OTC derivatives and on reducing reliance on credit rating agencies' ratings. We look forward to the completion by the next Leaders' Summit of the following ongoing work on systemically important financial institutions as scheduled in the FSB work program for 2011: determination of Global-systemically important financial institutions by FSB and national authorities based on indicative criteria, a comprehensive multi-pronged framework with more intensive supervisory oversight; effective resolution capacity including in a cross-border context; higher loss absorbency measures through a menu of viable alternatives that may include, depending on national circumstances, capital surcharges, contingent capital and bail-in instruments ; and other supplementary requirements as determined by the national authorities including systemic levies. Once the framework initially applicable to G-SIFIs is agreed, we will move expeditiously to cover all SIFIs. We look forward to the reports to be finalized by the BIS, IMF and FSB on macro-prudential frameworks and by the FSB, IMF and World Bank with input of national authorities on financial stability issues in emerging market and developing economies by our October meeting. We look forward to the recommendations that the FSB will prepare by mid-2011 on regulation and oversight of the shadow banking system to efficiently address the risks, notably of arbitrage, associated with shadow banking and its interactions with the regulated banking system. We call on IOSCO to develop by mid-2011 recommendations to promote markets' integrity and efficiency notably to mitigate the risks created by the latest technological developments. We also call on the FSB to bring forward for our next meeting comprehensive proposals to strengthen its governance, resources and outreach. We urge all jurisdictions to fully implement the FSB principles and standards on sounder compensation practices agreed by the G20 Leaders in Pittsburgh and call on the FSB to undertake ongoing monitoring in this area and look forward to receiving the results of a second thorough FSB peer review midyear to identify remaining gaps. We call on the OECD, the FSB and other relevant international organizations to develop common principles on consumer protection in the field of financial services by our October meeting. We reaffirm our commitment to more effective oversight and supervision, including regular stress testing of banks building on the Basel committee's principles.

  • I take it that you are asking about the proposed amendment to the Insurance Business Act that has been passed to the current session for continued deliberation. I assume that you are questioning the appropriateness of a mutual aid business of a public interest corporation or the arrangement in which a mutual aid business of a given public interest corporation is to be supervised by the former competent authorities, with an implication that the FSA should be responsible for supervision. Well, the fact is that the respective authorities, having the experience of supervising public interest corporations for a long time, are well-versed with specifics of their operation. On the subject of this Act, I believe that I named several examples the other day, such as the Japan Medical Association, which has always been supervised by the Ministry of Health, Labour and Welfare since the Meiji era, including the years of supervision by its predecessor, the Health and Medical Bureau of the Ministry of Internal Affairs. While circumstances vary from authority to authority, they know very extensively about internal affairs of those corporations and have exercised thorough supervision and, in that sense, have a set of knowledge of their operation and other information accumulated in the course of the work of supervision in the past, which accordingly makes them presumably capable of delivering more fine-tuned supervision than the FSA would be. Since the most important thing is policyholder protection, we believe that, from such a perspective, having the former authorities supervise them is an appropriate way to go. It is also in comprehensive consideration of overall circumstances, including the fact that this exemption of the Act is a provisional step, that we find it appropriate to have the former authorities continue to supervise those corporations.

  • Amid the current economic downturn, financial institutions are after all in a more advantageous position in relation to SMEs. This means that SMEs could not voice their opinion much. Thanks to the enactment of this law, they can now straightforwardly request a change of terms or other matters. Apparently, (former) Minister Kamei also proclaimed a transformation in attitude in the area of financial institution supervision as well. As banking is also a consultancy service, there must be a perspective of not just lending money and getting the money back, but of how to help industry survive and operate decently. That is why a sound and robust financial institution or a generous financial institution is needed and I, as the head of the FSA, pushed forward with conviction a policy for our work of inspections and supervision that is in line with that spirit.

  • The subject of the financial regulatory reforms has already been a significant discussion topic in the past as well. I heard that during the Financial Ministers and Central Bank Governors meeting held from October 22 to 23 in Gyeongju, the proposed capital adequacy requirement for banks and a new liquidity framework, which were drawn up in a recent meeting of the Group of Governors and Heads of Supervision, were welcomed along with the commitment to having them come into full force by the prescribed due date, and an endorsement was given to the policy framework, work processes and timelines proposed by the Basel Committee on Banking, one of the subordinate organs of the Financial Stability Board, with respect to the issue of addressing systematically important financial institutions (SIFIs) that you have just raised. The meeting accordingly agreed to give priority to this initiative as an agenda item of the G20 Summit. In that sense, implementing international financial regulatory reforms will contribute to an enhanced financial system and improved soundness of financial institutions in the medium to long term. In the meantime, it is also extremely important to, among other things, make the set of requirements a well-balanced one that fully takes into account differences between countries in terms of the actual operation of their financial systems and to implement it over time by, for instance, allowing an ample planning time in adequate consideration of any impact on the real economy - this is also an approach that Japan applies in attending the ongoing Summit meeting.
    金融規制改革に関しましては、以前にも大きな話題になりました10月22日から23日は慶州でありました財務大臣・中央銀行総裁会議において、先般の中央銀行総裁・銀行監督当局長官との会合で作成された銀行の自己資本、それから流動性の新たな枠組みを歓迎し、期限内に完全に実施することにコミットすること、また今お話がございましたシステム上重要な金融機関(SIFIs)については、FSB(金融安定理事会)、この下部機関の一つにバーゼル銀行監督委員会がありますが、これが提案する政策の枠組み及び作業手順及び日程を承認することを聞いておりまして、G20サミットの議題として、そのことを優先することを合意したところでございまして、そういった意味で国際的な金融規制の改革については、中長期的に金融システムの強化及び金融機関の健全性の向上に資するものとなる一方、各国の金融システムの実情の違いを十分に踏まえたバランスのとれたものにすること、実体経済への影響に十分配慮し、十分な計画期間を設けるなど、時間をかけて実施していくことなどが極めて重要であり、今回のサミットにおいてもこうした姿勢で臨んでいます。 - 金融庁
  • (12) With regard to the special application of the Pneumoconiosis Act under the provisions of each of the preceding paragraphs, the following provisions (including penal provisions relating to these provisions) shall be applied by replacing the following terms in the respective manners set forth below: the term "the business operator" in paragraph (1) of Article 32 of the same Act shall be deemed to be replaced with "the business operator (including a person deemed to be the business operator under the provisions of Article 46 of the Act for Securing Proper Operation of Worker Dispatching Undertakings and Improved Working Conditions for Dispatched Workers (hereinafter referred to as "the Worker Dispatching Act"); referred to as "the business operator and the equivalent" in paragraph (2) of Article 43-2 and Article 44)"; the term "This Act" in paragraphs (2) and (3) of Article 39 shall be deemed to be replaced with "This Act (including cases where the provisions of this Act are applied under the provisions of Article 46 of the Worker Dispatching Act)"; the term "paragraph (4) of Article 21" in paragraph (3) of the same Article shall be deemed to be replaced with "paragraph (4) of Article 21 (including cases where these provisions are applied under the provisions of paragraph (4) of Article 46 of the Worker Dispatching Act)"; the term "the place of business where dust work is performed" in paragraph (1) of Article 40 shall be deemed to be replaced with "the place of business where dust work is performed (including the place of business of a person deemed to be the business operator under the provisions of Article 46 of the Worker Dispatching Act; the same shall apply in paragraph (1) of Article 42)"; the term "this Act" in Article 41 and paragraph (1) of Article 42 shall be deemed to be replaced with "this Act and the provisions of Article 46 of the Worker Dispatching Act"; the term "a violation of the provisions of this Act" in Article 43 shall be deemed to be replaced with "a violation of the provisions of this Act (including cases where these provisions are applied under the provisions of Article 46 of the Worker Dispatching Act) and the crimes referred to in paragraphs (10) and (11) of the same Article"; the term "the provisions of this Act or of orders based on this Act" in paragraph (1) of Article 43-2 shall be deemed to be replaced with "the provisions of this Act or of orders based on this Act (including cases where these provisions are applied under the provisions of Article 46 of the Worker Dispatching Act), or the provisions of paragraphs (7) to (9) inclusive of the same Article or the provisions of orders based on these provisions"; and the term "the business operator" in paragraph (2) of the same Article and Article 44 shall be deemed to be replaced with "the business operator and equivalent".

In that sense, I believe the SME Financing Facilitation Act is timely legislation. I have been told that it was made temporary legislation with a two-year timeframe based on the expectation that the economy would recover by then. Regrettably, however, the economy is currently in such a state. The deadline is fast approaching for us to take these circumstances into consideration, take a positive approach, and make the decision to postpone its expiration.

In such a case, the "one-third" in Article 28 of the Penal Code shall be, "one-third (including the number of days an incoming sentenced person has been detained in the enforcement of the foreign punishment as defined in Article 2, item (i) of the Act on the Transnational Transfer of Sentenced Persons (hereinafter referred to as the "foreign punishment"), rendered in the final and binding decision with regard to the offense that is the premise of the incoming transfer as defined in Article 2, item (xi) of the same act (hereinafter referred to as the "offense that is the premise of the incoming transfer") in a sentencing state as defined in Article 2, item (vii) of the same act (hereinafter referred to as the "sentencing state"))"; "10 years" shall be "10 years (including the number of days an incoming sentenced person has been detained in the enforcement of the foreign punishment rendered in the final and binding decision with regard to the offense that is the premise of the incoming transfer in the sentencing state)"; "after a sentence has become final and binding" in Article 32 of the same code shall be "after the surrender by a sentencing state in accordance with the order prescribed in Article 13 of the Act on the Transnational Transfer of Sentenced Persons"; "two or more" and "the greatest among the punishments" in Article 474 of the Code of Criminal Procedure shall be "assistance punishment as defined in Article 2, item (ii) of the Act on the Transnational Transfer of Sentenced Persons (hereinafter referred to as the "assistance punishment")"; "the other punishment" in the same Article shall be "the principal punishment"; "the public prosecutors office responding to the court that has rendered the punishment" in Article 480 and Article 482 of the same code shall be "the Tokyo District Public Prosecutors Office"; "category of punishment" in Article 487 of the same code shall be "types of assistance punishment"; "a person upon whom a decision is to be enforced" in Article 502 in the same code shall be "a person upon whom the assistance punishment is to be enforced"; "the court that rendered such decision" in the same Article shall be "the Tokyo District Court"; and "a judgment of guilty has become final and binding against an individual in the course of enforcement of a protective measure" in Article 27, paragraph (1) of the Juvenile Act and "a sentence of imprisonment with or without work, or of penal detention has become final and binding in the course of enforcement of a protective measure" in Article 57 in the same code shall be "a person with regard to whom assistance punishment as defined in item (ii) of Article 2 of the Act on the Transnational Transfer of Sentenced Persons is to be enforced and who is currently undergoing a protective measure"; additional technicalities requiring alternative readings in connection with the application of these provisions shall be determined by a Cabinet order.

In this case, the term "the provisions of this Act or Order issued thereunder" in paragraph (1) of Article 29 of said Act shall be deemed to be replaced with "the provisions of this Act or orders issued based on this Act (including cases where these provisions are applied under the provisions of Article 45 of the Act for Securing Proper Operation of Worker Dispatching Undertakings and Improved Working Conditions for Dispatched Workers (hereinafter referred to as "the Worker Dispatching Act)"), or the provisions of paragraph (10) of the same Article or orders based on the provisions of the same paragraph"; the term "the provisions of this Act or Order issued thereunder" in paragraph (2) of the same Article shall be deemed to be replaced with "the provisions of this Act or orders issued based on this Act (including cases where these provisions are applied under the provisions of Article 45 of the Worker Dispatching Act), or the provisions of paragraph (10) of the same Article or orders based on the provisions of the same paragraph"; the term "this Act and the provisions of ordinances based thereon" in item (v) of paragraph (1) of Article 30 and in paragraph (7) of Article 88 shall be deemed to be replaced with "the provisions of this Act or orders based on this Act (including cases where these provisions are applied under the provisions of Article 45 of the Worker Dispatching Act)"; and the term "paragraph (1) through (4) of Article 66, proviso in paragraph (5) or Article 66-2" in Article 66-4 shall be deemed to be replaced with "the first sentence or the second sentence of paragraph (2) of Article 66 (limited to those parts pertaining to workers whom a person carrying out a client undertaking has caused to be engaged in the work specified by a Cabinet Order referred to in the second sentence of the same paragraph (including workers under dispatching prescribed in paragraph (1) of Article 44 of the Worker Dispatching Act); hereinafter the same shall apply in this Article), paragraph (3) of Article 66, paragraph (4) of Article 66 (limited to those parts pertaining to the provisions of the first sentence and the second sentence of paragraph (2) and paragraph (3) of Article 66; hereinafter the same shall apply in this Article) or the proviso to paragraph (5) of Article 66 (limited to those parts pertaining to the provisions of the first sentence and the second sentence of paragraph (2), paragraph (3) and paragraph (4) of Article 66)".

  • 3. We reaffirm our commitment to coordinated policy action by all G20 members to achieve strong, sustainable and balanced growth. Our main priority actions include implementing medium term fiscal consolidation plans differentiated according to national circumstances in line with our Toronto commitment, pursuing appropriate monetary policy, enhancing exchange rate flexibility to better reflect underlying economic fundamentals and structural reforms, to sustain global demand, increase potential growth, foster job creation and contribute to global rebalancing. We discussed progress made since the Seoul Summit and stressed the need to reduce excessive imbalances and maintain current account imbalances at sustainable levels by strengthening multilateral cooperation. We agreed on a set of indicators that will allow us to focus, through an integrated two-step process, on those persistently large imbalances which require policy actions. To complete the work required for the first step, our aim is to agree, by our next meeting in April, on indicative guidelines against which each of these indicators will be assessed, recognizing the need to take into account national or regional circumstances, including large commodity producers. While not targets, these indicative guidelines will be used to assess the following indicators: (i) public debt and fiscal deficits; and private savings rate and private debt (ii) and the external imbalance composed of the trade balance and net investment income flows and transfers, taking due consideration of exchange rate, fiscal, monetary and other policies. We also adopted a timetable for developing the 2011 action plan that will implement our Framework for Strong, Sustainable and Balanced Growth and monitor the commitments already made. As agreed in Seoul, we call on the IMF to provide an assessment as part of the Mutual Assessment Process on progress towards external sustainability and consistency of policies at our October meeting. At that time, we will also review a report on the MAP including an action plan informed by the analysis on the root causes of persistently large imbalances based on the agreed guidelines. We will also review an assessment of progress made in meeting commitments made in Seoul.

  • When deliberating the circulation of securities and, at the same time, taxation on those financial instruments, we are planning to reflect on the past development involving, as you know, a wide variety of tax revisions, including the now-abolished securities transaction tax, that were formulated in the light of trends in a higher dimension, such as the shifts from saving to investment and from indirect finance to direct finance, and will also examine in a comprehensive fashion any potential impacts of tax revisions, which we will work on to reach a final conclusion in time for the tax system request deadline at the end of August. The FSA also intends to consider the current economic situation and the historical development in Japan, where indirect finance has traditionally been more prevalent than in the U.S., where direct finance is very dominant, while also attaching importance to smooth financial functions and simple and fair taxation, with the intention of officially submitting our request to the (Government) Tax Commission by the end of August following our comprehensive deliberations.
    金融と税制というのは極めて大事ですし、同時に証券、あれは流通せねばなりませんから、同時にそういった金融商品に対する課税、あるいは昔は有価証券取引税という税金がございましたけれども、できるだけ証券、大きく言えば貯蓄から投資へというのは、間接金融から直接金融へというような大きな流れがございますので、そんなことを含めながらいろいろ税制改正を過去やってきた経緯があるということはご存じだと思いますが、なかなか税制を扱っただけではその所期の目的は、確かに効果はあるんでしょうけれども、達し得ないような部分もございますから、そういったことを総合的に勘案しながら、これは8月の末までに各省の税制要求というのは、最終的には出すということでございますから、そこら辺を踏まえて勘案しながら、また今の景気の状態、それから日本の置かれた、アメリカは非常に直接金融が多いのでございますが、日本は昔から伝統的に間接金融が多いというふうな長い間の歴史的経緯がございますから、そういったことを踏まえながら、なおかつ金融は円滑に機能するということが非常に大事でございまして、なおかつ税というものでございますから簡素公平ということも大事でございますから、そういったことを総合的に勘案しながら8月の末までにきちっと金融庁としては正式に税制調査会の方に出させていただきたいというふうに考えております。 - 金融庁

In this case, in paragraph (1) of Article 10 of the same Act, the term "paragraph (2) of Article 25-2" shall be deemed to be replaced with "paragraph (2) of Article 25-2 (including cases where the provisions of said paragraph are applied under the provisions of paragraph (3) of Article 45 of the Act for Securing Proper Operation of Worker Dispatching Undertakings and Improved Working Conditions for Dispatched Workers (hereinafter referred to as "the Worker Dispatching Act")), and the term "the following matters" shall be deemed to be replaced with "the following matters (with regard to a worker under dispatching prescribed in paragraph (1) of Article 44 of the Worker Dispatching Act (hereinafter referred to simply as a "worker under dispatching"), the matters referred to in item (ii) (excluding those pertaining to special education on safety and/or health prescribed in paragraph (3) of Article 59), the matters referred to in item (iii) (limited to those matters pertaining to medical examinations under the provisions of paragraph (1) of Article 66 (including medical examinations under the provisions of the second sentence of paragraph (2) of the same Article which are specified by an Ordinance of the Ministry of Health, Labour and Welfare), medical examinations pertaining to said medical examinations, under the provisions of paragraph (4) of the same Article, and medical examinations pertaining to those medical examinations under the provisions of the proviso to paragraph (5) of the same Article) and the matters referred to in item (v) (limited to those matters specified by an Ordinance of the Ministry of Health, Labour and Welfare ) shall be excluded; such matters shall be referred to as "safety and health management at the client's place of business" in paragraph (1) of Article 12 and Article 12-2)"; in paragraph (1) of Article 12 and in Article 12-2, the term "the matters listed in each item of paragraph (1) of Article 10" shall be deemed to be replaced with "safety and health management at the client's place of business," the term "paragraph (2) of Article 25-2" shall be deemed to be replaced with "paragraph (2) of Article 25-2 (including cases where the provisions of said paragraph are applied under the provisions of paragraph (3) of Article 45 of the Worker Dispatching Act)" and the term "in each item of paragraph (1) of said Article" shall be deemed to be replaced with "in each item of paragraph (1) of Article 25-2"; in paragraph (1) of Article 13, the term "health care for workers and (carry out) other matters provided for by the Ordinance of the Ministry of Health, Labour and Welfare (hereinafter" shall be deemed to be replaced with "health care for workers and (carry out) other matters specified by an Ordinance of the Ministry of Health, Labour and Welfare (with regard to workers under dispatching, matters specified by an Ordinance of the Ministry of Health, Labour and Welfare shall be excluded from the matters concerned; in paragraph (3) and in the following Article"; and in paragraph (1) of Article 18, the term "the following matters" shall be deemed to be replaced with "the following matters (with regard to workers under dispatching, matters specified by an Ordinance of the Ministry of Health, Labour and Welfare shall be excluded from the matters concerned)".

  • I made a comment at the informal ministerial gathering today, which was obviously not a comment from the head of the administration, but I am Vice-Chief of the People's New Party (PNP), and the current government is, as you know, a coalition of the Democratic Party of Japan (DPJ) and the PNP. Accordingly, Prime Minister Kan, right after he assumed office, met with (PNP) Chief Shizuka Kamei to discuss how the two parties would cooperate in policymaking, at which meeting I was also present as the PNP Secretary-General at that time. Under the three-party coalition that preceded the current one, there was a committee called the Ministerial Committee on Basic Policies, which was set up as a forum for the parties to coordinate or match their policies, but then the Social Democratic Party left the coalition. That is why how the remaining parties should cooperate in policymaking afterwards was a subject of discussion at the party leader meeting right after Prime Minister Kan became the new Prime Minister, during which both leaders agreed to go about it properly. Then as it turned out, as you know, we had a House of Councilors election and the same subject also just came up again during the recent meeting of the two party leaders, who supposedly agreed to "do it (policy cooperation)." That is why I decided to make an elaborate comment on this subject to Prime Minister Kan at today's informal ministerial gathering, to which Prime Minister Kan responded by telling Mr. Gemba, who is a state minister and is also DPJ's Policy Research Committee Chair, to work on policy cooperation with the PNP in the proper way - therefore, Policy Research Committee Chair Gemba and I proceeded to discuss how it should be done, a task that I presume will basically be handled mainly by policy research committee chairs.
