英国外の領域において納付される租税を英国の租税から控除することに関する英国の法令（その一般原則に影響を及ぼさないものに限る。）の規定に従い、(a)日本国内の源泉から生ずる所得、利得又は課税譲渡収益につき、日本国の法令及びこの条約の規定に従い直接に又は源泉徴収によって納付される日本国の租税（配当については、配当の支払の基因となった利得について納付される租税を除く。）は、当該日本国の租税の算定の基礎となった当該所得、利得又は課税譲渡収益について算定される英国の租税から控除する。(b)日本国の居住者である法人が、その議決権のある株式の十パーセント以上を直接又は間接に支配する英国の居住者である法人に支払う配当に関しては、英国の租税からの控除を行うに当たり、(a)の規定に基づいて控除される日本国の租税のほかに、当該日本国の居住者である法人が当該配当の支払の基因となった利得について納付する日本国の租税を考慮に入れるものとする。 - 財務省 - The term "royalties" as used in this Article means payments or credits, whether periodical or not, and however described or computed, to the extent to which they are made as consideration for: a) the use of, or the right to use, any copyright, patent, design or model, plan, secret formula or process, trademark or other like property or right; b) the supply of scientific, technical, industrial or commercial knowledge or information; c) the supply of any assistance that is ancillary and subsidiary to, and is furnished as a means of enabling the application or enjoyment of, any such property or right as is mentioned in subparagraph a) or any such knowledge or information as is mentioned in subparagraph b);
この条において、「使用料」とは、次の(a)から(e)までに掲げるものの対価としての支払金又は前渡金（定期的であるか否か及びその名称又は計算方法を問わない。）をいう。(a)著作権、特許権、意匠又は模型、図面、秘密方式又は秘密工程、商標権その他これらに類する財産又は権利の使用又は使用の権利(b)学術上、技術上、産業上又は商業上の知識又は情報の提供(c)(a)に規定する財産若しくは権利若しくは(b)に規定する知識若しくは情報に付随する支援又はこれらを活用し、若しくは享受するための支援の提供 - 財務省 - 1. Subject to the provisions of the laws of the Hong Kong Special Administrative Region relating to the allowance of a credit against Hong Kong Special Administrative Region tax of tax paid in a jurisdiction outside the Hong Kong Special Administrative Region (which shall not affect the general principle of this Article), Japanese tax paid under the laws of Japan and in accordance with this Agreement, whether directly or by deduction, in respect of income derived by a person who is a resident of the Hong Kong Special Administrative Region from sources in Japan, shall be allowed as a credit against Hong Kong Special Administrative Region tax payable in respect of that income, provided that the credit so allowed does not exceed the amount of Hong Kong Special Administrative Region tax computed in respect of that income in accordance with the tax laws of the Hong Kong Special Administrative Region.
１香港特別行政区外において納付される租税を香港特別行政区の租税から控除することに関する香港特別行政区の法令（この条に規定する一般原則に影響を及ぼさないものに限る。）の規定に従い、香港特別行政区の居住者である者が日本国内の源泉から取得する所得につき、日本国の法令及びこの協定の規定に従い直接に又は源泉徴収によって納付される日本国の租税は、当該所得について納付される香港特別行政区の租税から控除する。ただし、認められる控除の額は、香港特別行政区の租税に関する法令に従って当該所得について算定される香港特別行政区の租税の額を超えないものとする。 - 財務省 - In the first action on an application containing a generic claim and claims restricted separately to each of more than one species embraced thereby, the Examiner, if in his opinion, after a complete search, the generic claim presented is allowable, shall require the applicant in his response to that action to elect the species of his invention to which his claim shall be restricted, if no generic claim is finally held allowable. Claims directed neither to the species nor to the genus of the disclosed invention may be allowed. Markush type claims, i.e., claims which enumerate in alternative manner, members or variations which are properly claimable as species claims may likewise be allowed, provided that the amount of the fees payable by the applicant/s shall be computed depending on the number of members or variations enumerated in the Markush type claims.
出願が1の属クレーム，及び当該クレームが包含する複数の種の各々に別個に限定されているクレームを含む出願に関する第1回処分において，審査官が完全に調査した後の見解として，提示された当該属クレームは容認可能なものであるが，最終的には容認が維持されないときは，審査官は，出願人に対し，そのクレームが限定される発明の種を当該処分への応答において選択するよう要求する。 開示された発明の種概念にも属概念にも該当しないクレームは認めることができる。マーカッシュ型のクレーム，すなわち種概念のクレームとして適正にクレームし得る構成物又は変形を選択的な態様で列挙したクレームも，同様に認めることができる。ただし，出願人が納付すべき手数料の金額は，当該マーカッシュ型のクレームで列挙された構成物又は変形の数に基づいて計算される。 - 特許庁
