(5) No trademark shall be registered in respect of goods or services if it is well-known and registered in Bangladesh for goods or services which are not identical or similar to those in respect of which registration 15 is applied for, if- (a) the trademark is used in such a way that may create a false conception that there is a connection between those goods or services and the owner of the registered trademark; and (b) the interests of the registered trademark are likely to be damaged by such use.
