  • For another thing, derivatives products, which are new products based on financial engineering, have been sold around the world and the implosion of derivatives deals has had a significant impact on the real economy. Recently, such a situation occurred in the United States. By all means, the government must avoid a situation in which greed leads even innocent ordinary investors, who lack adequate knowledge, to suffer financial damage. The FSA (Financial Services Agency) has already been acting from that perspective. As you know, there are various ways of trading between many counterparties in the market. The FSA is considering if it is possible to set a central body that clears off all gains and losses made in the market through these trading. If a good proposal comes up in this respect, we may enact it into law. This is another matter we are now working on.

  • (14) A qualified foreign intermediary shall, for each person who has submitted a written application for tax exemption of book-entry transfer national government bonds or written application for tax exemption of book-entry transfer local government bonds, pursuant to the provision of a Cabinet Order, give notice of the day on which entries or records under the book-entry transfer system were made with regard to the book-entry transfer national government bonds or book-entry transfer local government bonds for which the person who has submitted the said written application for tax exemption of book-entry transfer national government bonds or written application for tax exemption of book-entry transfer local government bonds made entries or records under the book-entry transfer system through the said qualified foreign intermediary, and any other matters specified by an Ordinance of the Ministry of Finance, to the specified book-entry transfer institution, etc. through which the said qualified foreign intermediary made entries or records under the book-entry transfer system regarding the said book-entry transfer national government bonds or book-entry transfer local government bonds (in the case where the said qualified foreign intermediary is a foreign further indirect account management institution, notice shall be given to the specified book-entry transfer institution, etc. through which the foreign indirect account management institution pertaining to the entries or records under the book-entry transfer system regarding the said book-entry transfer national government bonds or book-entry transfer local government bonds made entries or records under the book-entry transfer system regarding the said book-entry transfer national government bonds or book-entry transfer local government bonds) by way of a document or any other means specified by a Cabinet Order. In this case, the said specified book-entry transfer institution, etc. shall keep books with regard to the said book-entry transfer national government bonds or book-entry transfer local government bonds, and shall state or record, pursuant to the provision of a Cabinet Order, these matters in such books for each person who has submitted the relevant written application.

  • (3) If (i) any Interested Partner fails to pay its taxes and other public duties in connection with the business of the Partnership without any justifiable reason, or (ii) the General Partner reasonably determines that the General Partner or the Partnership is required by applicable laws to withhold taxes with respect to any Interested Partner or pay any taxes and other public duties (including tax payments required by an amendment notice, determination notice, tax payment notice and any other tax assessment issued by a Japanese tax authority) on behalf of or with respect to any Interested Partner, the General Partner may, in making a distribution pursuant to Article 29, in its discretion, (x) deduct cash or property that is to be distributed to such Interested Partner by an amount equal to such unpaid amount or amount paid from the Partnership Assets to be distributed to such Interested Partner and (y) sell such property in such a manner as the General Partner in its discretion deems appropriate, and pay such taxes and other public duties. In such case, the General Partner may make such withholding or payment of taxes or other public duties and collect cash or property in the same manner. Upon request of the General Partner, the Interested Partner shall immediately pay to the General Partner (a) the amount necessary for payment of such taxes or other public duties or (b) if the General Partner has already made such payment, the amount paid by the General Partner, together with interest at [__]% per annum for the period from the date of payment by the General Partner until the date of actual payment by the Interested Partner prorated on the basis of a 365-day year. These payments shall not be treated as part of any contribution to the Partnership. The General Partner shall not be liable for its determinations under this paragraph (including the determination, manner or results of any sale).
    3. 組合員等が正当な事由なく本組合の事業に関し各自が負担すべき公租公課を滞納した場合、又は無限責任組合員若しくは本組合が適用法令上組合員等に関連して源泉徴収を行い若しくは組合員等に代わり若しくは組合員等に関連して公租公課の納付(更正通知、決定通知、納税告知その他日本の税務当局によりなされた課税査定により必要とされる納税を含む。)を行うことが必要とされるものと無限責任組合員が合理的に判断する場合、無限責任組合員は、その裁量により、第29 条に基づく分配を行うに際し、当該組合員等に分配すべき組合財産の中から当該滞納額又は納付額に相当する現金又は現物を控除し、現物についてはその裁量により適切と認める方法によりこれを売却した上、当該公租公課を支払うことができるものとする。この場合、無限責任組合員は、かかる源泉徴収又は公租公課の納付を行った上で、かかる方法により現金又は現物を収受することもできる。組合員等は、かかる支払いに必要な金額又は支払った金額につき、無限責任組合員から請求があれば、無限責任組合員において既にかかる支払いを行った後であればかかる支払いの日から組合員等による現実の支払いがなされた日までの期間につき年[ ]%(年365 日の日割り計算とする。)の利息を付して、無限責任組合員に対し直ちにこれを支払うものとする。かかる支払いは本組合への出資とはみなされない。なお、無限責任組合員は、本項の判断(売却の決定、方法及び結果を含む。)につき、いかなる責任も負わないものとする。 - 経済産業省
  • (a) If an applicant fails to prosecute his application within the required time as provided in these Regulations, the application shall be deemed withdrawn. (b) The time for reply may be extended only for good and sufficient cause, and for a reasonable time specified. Any request for such extension must be filed on or before the day on which action by the applicant is due. The Examiner may grant a maximum of two extensions, provided that the aggregate period granted inclusive of the initial period allowed to file the response, shall not exceed six months from mailing date of the official action requiring such response. (c) Prosecution of an application to save it from withdrawal must include such complete and proper action as the condition of the case may require. Any amendment not responsive to the last official action shall not operate to save the application from being deemed withdrawn. (d) When action by the applicant is a bona fide attempt to advance the case to final action, and is substantially a complete response to the Examiner’s action, but consideration of some matter or compliance with some requirements has been inadvertently omitted, opportunity to explain and supply the omission may be given before the question of withdrawal is considered. (e) Prompt ratification or filing of a correctly signed copy may be accepted in case of an unsigned or improperly signed paper.

  • According to what I have heard from the administrative staff, the Incubator Bank of Japan was inspected twice before the latest inspection for the fiscal year ended March 31, 2009, as I just mentioned: the previous inspection was for the fiscal year ended March 31, 2007 and the one before that was for the fiscal year ended March 31, 2005. My understanding is that as at the end of the fiscal year subject to each of the previous two inspections, the Bank’s financial position was assets in excess of liabilities according to the results of these inspections. Also, my understanding is that there were no material violations of laws and regulations, inadequacies in systems or other such problems in its business operations that would lead to administrative actions as found in the latest inspection. As I have repeatedly stated, at the time of the first inspection, the Bank engaged in operations allegedly based on a new business model targeted at small and medium-sized enterprises (SMEs). The Lehman Brothers shockwave that struck at the time may have been one of the factors. That said, then-Chairman Takeshi Kimura is an extremely capable person, who, according to what I have been told, had an authoritarian management style, so I suspect overambitious business expansions gave rise to the present outcome.

  • (2) With regard to dispatch work performed by a worker under dispatching, the provisions of Article 7, Article 32, paragraph (1) of Article 32-2, Article 32-3, paragraphs (1) to (3) inclusive of Article 32-4, Articles 33 to 35 inclusive, paragraph (1) of Article 36, Article 40, Article 41, Articles 60 to 63 inclusive, Article 64-2, Article 64-3 and Articles 66 to 68 inclusive of the Labor Standards Act and the provisions of orders based on said provisions (including penal provisions pertaining to these provisions) shall apply only to the client undertaking, by deeming it to be an undertaking employing a worker under dispatching. In this case, the term "at the workplace" in paragraph (1) of Article 32-2 of the same Act shall be deemed to be replaced with "at the workplace of a business of the dispatching undertaking (which means the dispatching undertaking prescribed in the same paragraph; the same shall apply hereinafter), where an employer of the dispatching undertaking prescribed in paragraph (3) of Article 44 of the Act for Securing the Proper Operation of Worker Dispatching Undertakings and Improved Working Conditions for Dispatched Workers (hereinafter referred to as "the Worker Dispatching Act") (hereinafter such employer shall be simply referred to as a "dispatching employer")"; the term "pursuant to rules of employment or the equivalent thereof" in Article 32-3 of the same Act shall be deemed to be replaced with "pursuant to rules of employment or the equivalent, a dispatching employer"; the term "a worker for whom" in the same Article shall be deemed to be replaced with "a worker who can be made to work for working hours under the provisions of Article 26 of the Worker Dispatching Act, based on the worker dispatch contract with regard to the worker concerned under paragraph (1) of the same Article"; the term "at the workplace concerned" in the same Article shall be deemed to be replaced with "at the workplace of a business of the dispatching undertaking, where the dispatching employer"; the term "at the workplace " in paragraphs (1) and (2) of Article 32-4 of the same Act shall be deemed to be replaced with "at the workplace of a business of the dispatching undertaking, where the dispatching employer"; the term "at the workplace" in paragraph (1) of Article 36 of the same Act shall be deemed to be replaced with" at the workplace of a business of the dispatching undertaking, where the dispatching employer"; and the term "this to the relevant government agency " in the same Article shall be deemed to be replaced with "and this to the relevant government agency".

  • (7) Where a nonresident or foreign corporation receives payment of interest on general foreign-issued company bonds issued during the period from April 1, 1998, to March 31, 2008, which fall under the category of specified foreign-issued company bonds and for which the nonresident or foreign corporation has, pursuant to the provision of a Cabinet Order, entrusted custody with the person in charge of handling payment, if [1] the said person in charge of handling payment thus entrusted with custody (hereinafter referred to in this paragraph as the "person in charge of handling custody and payment") who provides intermediary, brokerage or agent services (hereinafter referred to in this paragraph as the "intermediary services, etc.") for the receipt of interest on the said specified foreign-issued company bonds has, before receiving the delivery of such interest in the course of the intermediary services, etc., given notice of the matters specified in each of the following items for the category listed in the relevant item and any other matters specified by an Ordinance of the Ministry of Finance with respect to the person who is to receive the interest (excluding interest subject to the provision of Article 3-3(3) or (6); hereinafter the same shall apply in this paragraph) (these matters hereinafter referred to in this paragraph and paragraph (14) as "interest recipient information"), to the person who pays the interest (in the case where the interest is delivered via another person in charge of handling payment with whom the said person in charge of handling custody and payment has further entrusted custody, notice shall be given to the person who pays the interest via such other person in charge of handling payment), and [2] the person who pays the interest has, upon payment of the interest, prepared a document stating the matters concerning the person who is to receive the interest and any other matters specified by an Ordinance of the Ministry of Finance (limited to a document prepared based on the information on the interest recipient provided by the said person in charge of handling custody and payment; referred to in paragraph (9) and paragraph (14) as the "interest recipient confirmation document"), and submitted it to the competent district director having jurisdiction over the place for tax payment prescribed in Article 17 of the Income Tax Act which pertains to the person who makes payment in terms of the said interest (in the case where another place has been designated pursuant to the provision of Article 18(2) of the said Act: the designated place for tax payment), the said nonresident or foreign corporation shall be deemed to have submitted a written application for tax exemption pursuant to the provision of paragraph (4) with respect to the interest receivable thereby:

  • (3) The provision of Article 52-6(1) of the New Banking Act (including the cases where it is applied mutatis mutandis pursuant to Article 17 of the New Long-Term Credit Bank Act; hereinafter the same shall apply in this paragraph) shall not apply, until the day on which one year has elapsed from the Effective Date, to granting of credit, etc. (meaning granting of credit, etc. as defined by Article 52-6(1) of the New Banking Act; hereinafter the same shall apply in this paragraph) by a Bank Holding Company as defined by Article 2(11) of the New Banking Act (hereinafter referred to as a "Bank Holding Company" in this paragraph) and/or its Subsidiary Companies, etc. (meaning Subsidiary Companies, etc. as defined by 52-6(1) of the New Banking Act; hereinafter the same shall apply in this paragraph), or by a Long-Term Credit Bank Holding Company as defined by Article 16-4(1) of the New Long-Term Credit Bank Act (hereinafter referred to as a "Long-Term Credit Bank Holding Company" in this paragraph) and/or its Subsidiary Companies, etc., to one person as defined by Article 52-6(1) of the New Banking Act of which the total amount exceeds the Limit of Granting of Credit, etc. by Bank Holding Company (meaning Limit of Granting of Credit, etc. by Bank Holding Company as defined by Article 52-6(1) of the New Banking Act; hereinafter the same shall apply in this paragraph) at the time when this Act comes into effect, if the Bank Holding Company or the Long-Term Credit Bank Holding Company (hereinafter collectively referred to as a "Bank Holding Company, etc." in this paragraph and Article 105 of these Supplementary Provisions) notifies thereof to the Financial Reconstruction Commission by the day on which three months have elapsed from the Effective Date. In this case, where it is likely that if the Bank Holding Company and/or its Subsidiary Companies, etc., or Long-Term Credit Bank Holding Company and/or its Subsidiary Companies, etc., do not continue granting of credit, etc. of which the total amount exceeds the Limit of Granting of Credit, etc. by Bank Holding Company to the one person even after the day on which one year has elapsed from the Effective Date, it would significantly hinder the continuation of the business of the one person, or where there is other compelling reason, and when the Bank Holding Company, etc. obtains an approval from the Prime Minister before that day, the Bank Holding Company, etc. shall be deemed to have obtained the approval referred to in the proviso to Article 52-6(1) of the New Banking Act on the day after that day.
    3 新銀行法第五十二条の六第一項(新長期信用銀行法第十七条において準用する場合を含む。以下この項において同じ。)の規定は、この法律の施行の際現に新銀行法第五十二条の六第一項に規定する同一人に対する信用の供与等(同項に規定する信用の供与等をいう。以下この項において同じ。)の額が合算して銀行持株会社に係る信用供与等限度額(同条第一項に規定する銀行持株会社に係る信用供与等限度額をいう。以下この項において同じ。)を超えている新銀行法第二条第十一項に規定する銀行持株会社(以下この項において「銀行持株会社」という。)若しくはその子会社等(新銀行法第五十二条の六第一項に規定する子会社等をいう。以下この項において同じ。)又は新長期信用銀行法第十六条の四第一項に規定する長期信用銀行持株会社(以下この項において「長期信用銀行持株会社」という。)若しくはその子会社等の当該同一人に対する信用の供与等については、当該銀行持株会社又は当該長期信用銀行持株会社(以下この項及び附則第百五条において「銀行持株会社等」という。)が施行日から起算して三月を経過する日までにその旨を金融再生委員会に届け出たときは、施行日から起算して一年を経過する日までの間は、適用しない。この場合において、当該銀行持株会社若しくはその子会社等又は当該長期信用銀行持株会社若しくはその子会社等が合算して当該同一人に対して同日後も引き続き銀行持株会社に係る信用供与等限度額を超えて当該信用の供与等をしないこととすれば当該同一人の事業の継続に著しい支障を生ずるおそれがある場合その他のやむを得ない理由がある場合において当該銀行持株会社等が同日までに内閣総理大臣の承認を受けたときは、当該銀行持株会社等は、同日の翌日において新銀行法第五十二条の六第一項ただし書の規定による承認を受けたものとみなす。 - 日本法令外国語訳データベースシステム

  • Article 31 (1) When a registered foreign conformity assessment body (limited to those who have been registered in each of the same classifications of business specified by an Ordinance of the Ministry of Internal Affairs and Communications set forth in Article 86 paragraph (1) of the Telecommunications Business Act as a person to approve conformity with the technical standards specified by an Ordinance of the Ministry of Internal Affairs and Communications set forth in Article 52 paragraph (1) of the same act; hereinafter the same shall apply in this Article) issues a technical standards conformity approval (technical standards conformity approval prescribed in Article 53 paragraph (1) of the same act; the same shall apply hereinafter in this paragraph) in respect of the terminal equipment (terminal equipment prescribed in Article 53 paragraph (1) of the same act, provided that such terminal equipment pertains to the classification in which the registered conformity assessment body has been registered; the same shall apply in paragraph (2)), the provisions of Article 53 paragraph (2), Article 54, Article 55 paragraph (1), Article 62 paragraph (1), Article 166 paragraph (2) and Article 167 paragraph (1), paragraph (2) and paragraph (5) (including the penal provisions pertaining to these provisions) shall be applied by regarding the technical standards conformity approval as a technical standards conformity approval issued by a registered approval body (registered approval body prescribed in Article 53 paragraph (1) of the same act; hereinafter the same shall apply in this Article) and the person who has obtained the technical standards conformity approval from the registered foreign conformity assessment body as a person who has obtained a technical standards conformity approval from a registered approval body. In this case, the term "registered approval body" and the term "shall affix" in Article 53 paragraph (2) of the same act shall be deemed to be replaced with "registered foreign conformity assessment body prescribed in the first sentence in Article 31 paragraph (1) of the Act for Implementation of the Mutual Recognition between Japan and Foreign States in Relation to Results of Conformity Assessment Procedures of Specified Equipment (Act No. 111, 2001)" and "may affix," respectively. In this case, the term "registered certification body" and the term "shall affix" in Article 38-7 paragraph (1) of the same act shall be deemed to be replaced with "registered foreign conformity assessment body prescribed in the first sentence in Article 33 paragraph (1) of the Act for Implementation of the Mutual Recognition between Japan and Foreign States in Relation to Results of Conformity Assessment Procedures of Specified Equipment (Act No. 111, 2001)" and "may affix," respectively. As you may already know, the Act concerning Temporary Measures to Facilitate Financing for SMEs, etc. was established based on the agreement among the three ruling parties when Shizuka Kamei served as Minister for Financial Services. I am paying very close attention to the Act, which covers a period of two years including two year ends and two fiscal year ends; I believe this is groundbreaking legislation in Japan. The perspectives of megabanks seems to have somewhat changed, as I have been told by a staff member at one of the local financial bureaus that a megabank started participating in conventions of shinkin banks and credit unions since the establishment of the Act for the first time ever. It may be common knowledge, but 99.7% of companies in Japan are SMEs, and 42 million people work for SMEs. SMEs are rather agile, flexible and extremely precious. As I may have mentioned previously, in my hometown Kitakyushu City, which is a city dominated by SMEs, I have been told by businesspeople that their companies have actually managed to survive due to the establishment of the Act.     第五十二条の二の五 金融商品取引法第三章第一節第五款(第三十四条の二第六項から第八項まで(特定投資家が特定投資家以外の顧客とみなされる場合)並びに第三十四条の三第五項及び第六項(特定投資家以外の顧客である法人が特定投資家とみなされる場合)を除く。)(特定投資家)、同章第二節第一款(第三十五条から第三十六条の四まで(第一種金融商品取引業又は投資運用業を行う者の業務の範囲、第二種金融商品取引業又は投資助言・代理業のみを行う者の兼業の範囲、顧客に対する誠実義務、標識の掲示、名義貸しの禁止、社債の管理の禁止等)、第三十七条第一項第二号(広告等の規制)、第三十七条の二(取引態様の事前明示義務)、第三十七条の三第一項第二号及び第六号並びに第三項(契約締結前の書面の交付)、第三十七条の五から第三十七条の七まで(保証金の受領に係る書面の交付、書面による解除、指定紛争解決機関との契約締結義務等)、第三十八条第一号及び第二号並びに第三十八条の二(禁止行為)、第三十九条第三項ただし書及び第五項(損失補てん等の禁止)並びに第四十条の二から第四十条の五まで(最良執行方針等、分別管理が確保されていない場合の売買等の禁止、特定投資家向け有価証券の売買等の制限、特定投資家向け有価証券に関する告知義務)を除く。)(通則)及び第四十五条(第三号及び第四号を除く。)(雑則)の規定は、外国銀行代理銀行(第五十二条の二第一項の認可を受け、又は同条第二項の規定による届出をして外国銀行代理業務を営んでいる銀行をいう。以下同じ。)が行う外国銀行代理業務に係る特定預金等契約の締結の代理又は媒介について準用する。この場合において、これらの規定中「金融商品取引契約」とあるのは「特定預金等契約」と、「金融商品取引業」とあるのは「特定預金等契約の締結の代理又は媒介の業務」と、「締結の勧誘又は締結」とあるのは「締結の勧誘又は締結の代理若しくは媒介」と、これらの規定(同法第三十四条の規定を除く。)中「金融商品取引行為」とあるのは「特定預金等契約の締結」と、同法第三十四条中「顧客を相手方とし、又は顧客のために金融商品取引行為(第二条第八項各号に掲げる行為をいう。以下同じ。)を行うことを内容とする契約」とあるのは「銀行法第十三条の四に規定する特定預金等契約」と、「を過去に当該特定投資家との間で締結」とあるのは「の締結の代理又は媒介を過去に当該特定投資家との間で」と、「を締結する」とあるのは「の締結の代理又は媒介をする」と、同法第三十四条の二第五項第二号及び第三十四条の三第四項第二号中「締結する」とあるのは「締結の代理又は媒介をする」と、同条第二項第四号イ中「と対象契約」とあるのは「による代理若しくは媒介により対象契約」と、同法第三十七条の三第一項中「を締結しようとするとき」とあるのは「の締結の代理又は媒介を行うとき」と、「交付しなければならない」とあるのは「交付するほか、預金者等(銀行法第二条第五項に規定する預金者等をいう。以下この項において同じ。)の保護に資するため、内閣府令で定めるところにより、当該特定預金等契約の内容その他預金者等に参考となるべき情報の提供を行わなければならない」と、同項第一号中「金融商品取引業者等」とあるのは「外国銀行代理銀行(銀行法第五十二条の二の五に規定する外国銀行代理銀行をいう。)の所属外国銀行(同法第五十二条の二第一項に規定する所属外国銀行をいう。)」と、同法第三十九条第一項第一号中「有価証券の売買その他の取引(買戻価格があらかじめ定められている買戻条件付売買その他の政令で定める取引を除く。)又はデリバティブ取引(以下この条において「有価証券売買取引等」という。)」とあるのは「特定預金等契約の締結」と、「有価証券又はデリバティブ取引(以下この条において「有価証券等」という。)」とあるのは「特定預金等契約」と、「顧客(信託会社等(信託会社又は金融機関の信託業務の兼営等に関する法律第一条第一項の認可を受けた金融機関をいう。以下同じ。)が、信託契約に基づいて信託をする者の計算において、有価証券の売買又はデリバティブ取引を行う場合にあつては、当該信託をする者を含む。以下この条において同じ。)」とあるのは「顧客」と、「補足するため」とあるのは「補足するため、当該特定預金等契約によらないで」と、同項第二号及び第三号中「有価証券売買取引等」とあるのは「特定預金等契約の締結」と、「有価証券等」とあるのは「特定預金等契約」と、同項第二号中「追加するため」とあるのは「追加するため、当該特定預金等契約によらないで」と、同項第三号中「追加するため、」とあるのは「追加するため、当該特定預金等契約によらないで」と、同条第二項中「有価証券売買取引等」とあるのは「特定預金等契約の締結」と、同条第三項中「原因となるものとして内閣府令で定めるもの」とあるのは「原因となるもの」と、同法第四十五条第二号中「第三十七条の二から第三十七条の六まで、第四十条の二第四項及び第四十三条の四」とあるのは「第三十七条の三(第一項の書面の交付に係る部分に限り、同項第二号及び第六号並びに第三項を除く。)及び第三十七条の四」と、「締結した」とあるのは「締結の代理若しくは媒介をした」と読み替えるものとするほか、必要な技術的読替えは、政令で定める。 - 日本法令外国語訳データベースシステム

  • Article 69 (1) In a case when a Municipality issues a Certification of Needed Long-Term Care, a Renewal of Certification of Care Need, or Certification of Change of Condition of Need for Long-Term Care pursuant to the provisions of Article 27, paragraph (7) or Article 30, paragraph (1) as applied mutatis mutandis pursuant to Article 29, paragraph (2), a Certification of Needed Support, a Renewal of Certification of Needed Support, or a Certification of Change of Category of Needed Support Condition pursuant to the provisions of Article 32, paragraph (6) or Article 33-3, paragraph (1) as applied mutatis mutandis pursuant to Article 33-2, paragraph (2) (hereinafter referred to simply as "Certification" in this paragraph) and there is a period when the right to collect an insurance premium has extinguished (which means a period calculated pursuant to the provisions of a Cabinet Order regarding the period when the right to collect an insurance premium pertaining to said period has been extinguished due to a legal proscription) with regard to an Insured Person Requiring Long-Term Care, etc., that is the Primary Insured Person pertaining to said Certification, a Municipality pursuant to the provisions of an Ordinance of the Ministry of Health, Labour, and Welfare shall enter on the Certificate of Insured Person of said Insured Person Requiring Long-Term Care, etc., in addition to the entry pursuant to the provisions of Article 27, paragraph (7), second sentence (including a case applied mutatis mutandis pursuant to Article 28, paragraph (4) and Article 29, paragraph (2)), Article 30, paragraph (1), second sentence, Article 35, paragraph (4), second sentence, Article 32, paragraph (6), second sentence (including a case applied mutatis mutandis pursuant to Article 33, paragraph (4) or Article 33-2, paragraph (2)), Article 33-3, paragraph (1), second sentence, Article 35, paragraph (2), second sentence, or paragraph (6) second sentence as pertaining to said Certification, that the amount of Long-Term Care Benefit, etc., (except for payment of an Allowance for In-Home Long-Term Care Service, Exceptional Allowance for an In-Home Long-Term Care Service Plan, Allowance for Preventive Long-Term Care Service Plan, Exceptional Allowance for a Preventive Service Plan of Long-term care, Allowance for High-Cost Long-Term Care Service, Allowance for High-Cost Preventive Long-Term Care Service, Allowance for Long-Term Care Service to a Person Admitted to a Specified Facility, Exceptional Allowance for Long-Term Care Service to a Person Admitted to a Specified Facility, Allowance for Preventive Long-Term Care Service to a Person Admitted to a Specified Facility, and Exceptional Allowance for Long-Term Care Preventive Service of a Person Admitted to a Specified Facility) shall be reduced and that the Allowance for High-Cost Long-Term Care Service, Allowance for High-Cost Preventive Long-Term Care Service, Allowance for Long-Term Care Service to a Person Admitted to a Specified Facility, Exceptional Allowance for Long-Term Care Service to a Person Admitted to a Specified Facility, Allowance for Preventive Long-Term Care Service to a Person Admitted to a Specified Facility, and Exceptional Allowance for Long-Term Care Preventive Service of a Person Admitted to a Specified Facility shall not be paid, and the period that these measures are applicable (which means a period that a Municipality determines pursuant to the provisions of a Cabinet Order according to the period during which the right to collect an insurance premium is extinguished; herein referred to as "Benefit Reduction Period" in this Article) (hereinafter said entry is referred to as "Entry of Benefit Reduction Amount, etc." in this Article), however, provided that this provision shall not apply to a case when it is determined that said Insured Person Requiring Long-Term Care, etc., suffers due to a disaster or other special circumstance provided by a Cabinet Order.
    第六十九条 市町村は、要介護認定、要介護更新認定、第二十九条第二項において準用する第二十七条第七項若しくは第三十条第一項の規定による要介護状態区分の変更の認定、要支援認定、要支援更新認定、第三十三条の二第二項において準用する第三十二条第六項若しくは第三十三条の三第一項の規定による要支援状態区分の変更の認定(以下この項において単に「認定」という。)をした場合において、当該認定に係る第一号被保険者である要介護被保険者等について保険料徴収権消滅期間(当該期間に係る保険料を徴収する権利が時効によって消滅している期間につき政令で定めるところにより算定された期間をいう。以下この項において同じ。)があるときは、厚生労働省令で定めるところにより、当該要介護被保険者等の被保険者証に、当該認定に係る第二十七条第七項後段(第二十八条第四項及び第二十九条第二項において準用する場合を含む。)、第三十条第一項後段若しくは第三十五条第四項後段又は第三十二条第六項後段(第三十三条第四項及び第三十三条の二第二項において準用する場合を含む。)、第三十三条の三第一項後段若しくは第三十五条第二項後段若しくは第六項後段の規定による記載に併せて、介護給付等(居宅介護サービス計画費の支給、特例居宅介護サービス計画費の支給、介護予防サービス計画費の支給及び特例介護予防サービス計画費の支給、高額介護サービス費の支給及び高額介護予防サービス費の支給並びに特定入所者介護サービス費の支給、特例特定入所者介護サービス費の支給、特定入所者介護予防サービス費の支給及び特例特定入所者介護予防サービス費の支給を除く。)の額の減額を行う旨並びに高額介護サービス費及び高額介護予防サービス費並びに特定入所者介護サービス費、特例特定入所者介護サービス費、特定入所者介護予防サービス費及び特例特定入所者介護予防サービス費の支給を行わない旨並びにこれらの措置がとられる期間(市町村が、政令で定めるところにより、保険料徴収権消滅期間に応じて定める期間をいう。以下この条において「給付額減額期間」という。)の記載(以下この条において「給付額減額等の記載」という。)をするものとする。ただし、当該要介護被保険者等について、災害その他の政令で定める特別の事情があると認めるときは、この限りでない。 - 日本法令外国語訳データベースシステム

In such a case, the "one-third" in Article 28 of the Penal Code shall be, "one-third (including the number of days an incoming sentenced person has been detained in the enforcement of the foreign punishment as defined in Article 2, item (i) of the Act on the Transnational Transfer of Sentenced Persons (hereinafter referred to as the "foreign punishment"), rendered in the final and binding decision with regard to the offense that is the premise of the incoming transfer as defined in Article 2, item (xi) of the same act (hereinafter referred to as the "offense that is the premise of the incoming transfer") in a sentencing state as defined in Article 2, item (vii) of the same act (hereinafter referred to as the "sentencing state"))"; "10 years" shall be "10 years (including the number of days an incoming sentenced person has been detained in the enforcement of the foreign punishment rendered in the final and binding decision with regard to the offense that is the premise of the incoming transfer in the sentencing state)"; "after a sentence has become final and binding" in Article 32 of the same code shall be "after the surrender by a sentencing state in accordance with the order prescribed in Article 13 of the Act on the Transnational Transfer of Sentenced Persons"; "two or more" and "the greatest among the punishments" in Article 474 of the Code of Criminal Procedure shall be "assistance punishment as defined in Article 2, item (ii) of the Act on the Transnational Transfer of Sentenced Persons (hereinafter referred to as the "assistance punishment")"; "the other punishment" in the same Article shall be "the principal punishment"; "the public prosecutors office responding to the court that has rendered the punishment" in Article 480 and Article 482 of the same code shall be "the Tokyo District Public Prosecutors Office"; "category of punishment" in Article 487 of the same code shall be "types of assistance punishment"; "a person upon whom a decision is to be enforced" in Article 502 in the same code shall be "a person upon whom the assistance punishment is to be enforced"; "the court that rendered such decision" in the same Article shall be "the Tokyo District Court"; and "a judgment of guilty has become final and binding against an individual in the course of enforcement of a protective measure" in Article 27, paragraph (1) of the Juvenile Act and "a sentence of imprisonment with or without work, or of penal detention has become final and binding in the course of enforcement of a protective measure" in Article 57 in the same code shall be "a person with regard to whom assistance punishment as defined in item (ii) of Article 2 of the Act on the Transnational Transfer of Sentenced Persons is to be enforced and who is currently undergoing a protective measure"; additional technicalities requiring alternative readings in connection with the application of these provisions shall be determined by a Cabinet order.

mutatis mutandis pursuant to Article 27-29(1), or the procedures pursuant to the provision of Article 10(1) (excluding the second sentence of the same paragraph) (including submission of the documents to be attached in the case of submission of the documents under these procedures; hereinafter referred to as "Electronic Disclosure Procedures" in this Chapter) or the procedures under Article 4(5) (including the cases where it is applied mutatis mutandis pursuant to Article 23-8(4) (including the cases where it is applied mutatis mutandis pursuant to Article 27), the procedures prescribed in Article 27-5(ii) and other procedures specified by a Cabinet Order (including submission of the documents to be attached in the case of submission of the documents under these procedures); hereinafter referred to as "Discretionary Electronic Disclosure Procedures" in this Chapter).

the term "Sales, etc. (meaning sales or other type of transfer for value; hereinafter the same shall apply in this Section)" shall be deemed to be replaced with "Sales, etc."; the term "the following matters" in Article 27-3(2) shall be deemed to be replaced with "the matters listed in items (i) and (iii) below"; the part "period of Purchase, etc. (including the statement included in the public notice under the second sentence of the preceding paragraph)" in Article 27-3(2)(i) shall be deemed to be replaced with "period of Purchase, etc."; the part "The Tender Offeror, Persons in Special Relationship with the Tender Offeror (meaning Persons in Special Relationship as defined in Article 27-2(7); hereinafter the same shall apply in this Section), or other person concerned as specified by a Cabinet Order" in Article 27-3(3) shall be deemed to be replaced with "the Tender Offeror or other person concerned as specified by a Cabinet Order"; the part "to the Issuer of the Share Certificates, etc. to which the Tender Offer is made (and the person who has already submitted a Tender Offer Notification with regard to any Share Certificates, etc. issued by the Issuer as of the day on which the Tender Offer Notification is submitted, if any), and, if the Share Certificates, etc. for which the Tender Offer is made fall under any of the categories listed in the following items, also send a copy of the Tender Offer Notification to the exchange or association specified in the following items for each kind of Share Certificates, etc. set forth in the respective items" in the first sentence of Article 27-3(4) shall be deemed to be replaced with "to the exchange or association specified in the following items for each kind of Securities set forth in the respective items, and also send a copy of the Tender Offer Notification to the person who has already submitted a Tender Offer Notification with regard to any Share Certificates, etc. issued by the Issuer as of the day on which the Tender Offer Notification is submitted, if any"; the term "Share Certificates, etc." in the items of Article 27-3(4) shall be deemed to be replaced with "Listed Share Certificates, etc."; the part "lower the price for Purchase, etc. (excluding those implemented in cases where the Public Notice for Commencing Tender Offer and the Tender Offer Notification state as one of the Terms of Purchase, etc. that the price for Purchase, etc. may be lowered according to standards specified by a Cabinet Office Ordinance if the Subject Company (meaning Subject Company defined in Article 27-10(1)) conducts share split or other act specified by a Cabinet Order.)" in Article 27-6(1)(i) shall be deemed to be replaced with "lower the price for Purchase, etc."; the part "the details of the change in the Terms of Purchase, etc. (excluding the extension of the period for Purchase, etc. made under Article 27-10(3))" in Article 27-6(2) shall be deemed to be replaced with "the details of the change in the Terms of Purchase, etc."; the part "any change in the Terms of Purchase, etc. (excluding the extension of the period for Purchase, etc. made under Article 27-10(3))" in Article 27-8(2) shall be deemed to be replaced with "any change in the Terms of Purchase, etc."; the part "the Tender Offeror states as one of the Terms of Purchase, etc. in the Public Notice for Commencing Tender Offer and Tender Offer Notification that the Tender Offer may be withdrawn if there occurs any important change in the business or property of the Issuer of the Share Certificates, etc. for which the Tender Offer is made or its Subsidiary (meaning Subsidiary as defined in Article 2(iii) of the Companies Act) or there occurs any other circumstance that would significantly impede the achievement of the purpose of the Tender Offer (limited to those specified by a Cabinet Order), or where a decision of commencement of bankruptcy proceedings is made against the Tender Offeror or there occurs any other material change in circumstances as specified by a Cabinet Order" in the proviso to Article 27-11(1) shall be deemed to be replaced with "Purchase, etc. of Listed Share Certificates, etc. conducted through the Tender Offer violates other laws and regulations or where there occurs any circumstances specified by a Cabinet Order as those involving the risk of violation of other laws and regulations"; the part "states any of the following as one of the Terms of Purchase, etc. in the Public Notice for Commencing Tender Offer and Tender Offer Notification (with regard to the term specified in item (ii), limited to cases where the Share Certificates, etc. Holding Rate (meaning Share Certificates, etc. Holding Rate as defined in Article 27-2(8)) of Share Certificates, etc. in possession by the Tender Offeror after the Tender Offer, or, in cases where there are Persons in Special Relationship as specified in Article 27-2(1)(i) with the Tender Offeror, the Share Certificates, etc. Holding Rate calculated by adding the Share Certificates, etc. Holding Rate of the Persons in Special Relationship as defined in Article 27-2(8) to that for the person who conducted the Purchase, etc.) will not exceed the rate specified by a Cabinet Order)" in Article 27-13(4) shall be deemed to be replaced with "states the term specified in item (ii) below as one of the Terms of Purchase, etc. in the Public Notice for Commencing Tender Offer and Tender Offer Notification";     2 第二十七条の二第二項から第六項まで、第二十七条の三(第一項後段及び第二項第二号を除く。)、第二十七条の四、第二十七条の五(各号列記以外の部分に限る。第五項及び第二十七条の二十二の三第五項において同じ。)、第二十七条の六から第二十七条の九まで(第二十七条の八第六項、第十項及び第十二項を除く。)、第二十七条の十一から第二十七条の十五まで(第二十七条の十一第四項並びに第二十七条の十三第三項及び第四項第一号を除く。)、第二十七条の十七、第二十七条の十八、第二十七条の二十一第一項及び前条第一項の規定は、前項の規定により公開買付けによる買付け等を行う場合について準用する。この場合において、これらの規定(第二十七条の三第四項及び第二十七条の十一第一項ただし書を除く。)中「株券等」とあるのは「上場株券等」と、第二十七条の二第六項中「売付け等(売付けその他の有償の譲渡をいう。以下この章において同じ。)」とあるのは「売付け等」と、第二十七条の三第二項中「次に」とあるのは「第一号及び第三号に」と、同項第一号中「買付け等の期間(前項後段の規定により公告において明示した内容を含む。)」とあるのは「買付け等の期間」と、同条第三項中「公開買付者、その特別関係者(第二十七条の二第七項に規定する特別関係者をいう。以下この節において同じ。)その他政令で定める関係者」とあるのは「公開買付者その他政令で定める関係者」と、同条第四項前段中「当該公開買付けに係る株券等の発行者(当該公開買付届出書を提出した日において、既に当該発行者の株券等に係る公開買付届出書の提出をしている者がある場合には、当該提出をしている者を含む。)に送付するとともに、当該公開買付けに係る株券等が次の各号に掲げる株券等に該当する場合には、当該各号に掲げる株券等の区分に応じ、当該各号に定める者」とあるのは「次の各号に掲げる当該公開買付けに係る上場株券等の区分に応じ、当該各号に定める者に送付するとともに、当該公開買付届出書を提出した日において、既に当該公開買付者が発行者である株券等に係る公開買付届出書の提出をしている者がある場合には、当該提出をしている者」と、同項各号中「株券等」とあるのは「上場株券等」と、第二十七条の五ただし書中「次に掲げる」とあるのは「政令で定める」と、第二十七条の六第一項第一号中「買付け等の価格の引下げ(公開買付開始公告及び公開買付届出書において公開買付期間中に対象者(第二十七条の十第一項に規定する対象者をいう。)が株式の分割その他の政令で定める行為を行つたときは内閣府令で定める基準に従い買付け等の価格の引下げを行うことがある旨の条件を付した場合に行うものを除く。)」とあるのは「買付け等の価格の引下げ」と、同条第二項中「買付条件等の変更の内容(第二十七条の十第三項の規定により買付け等の期間が延長された場合における当該買付け等の期間の延長を除く。)」とあるのは「買付条件等の変更の内容」と、第二十七条の八第二項中「買付条件等の変更(第二十七条の十第三項の規定による買付け等の期間の延長を除く。)」とあるのは「買付条件等の変更」と、第二十七条の十一第一項ただし書中「公開買付者が公開買付開始公告及び公開買付届出書において公開買付けに係る株券等の発行者若しくはその子会社(会社法第二条第三号に規定する子会社をいう。)の業務若しくは財産に関する重要な変更その他の公開買付けの目的の達成に重大な支障となる事情(政令で定めるものに限る。)が生じたときは公開買付けの撤回等をすることがある旨の条件を付した場合又は公開買付者に関し破産手続開始の決定その他の政令で定める重要な事情の変更が生じた」とあるのは「当該公開買付けにより当該上場株券等の買付け等を行うことが他の法令に違反することとなる場合又は他の法令に違反することとなるおそれがある事情として政令で定める事情が生じた」と、第二十七条の十三第四項中「次に掲げる条件を付した場合(第二号の条件を付す場合にあつては、当該公開買付けの後における公開買付者の所有に係る株券等の株券等所有割合(第二十七条の二第八項に規定する株券等所有割合をいい、当該公開買付者に同条第一項第一号に規定する特別関係者がある場合にあつては、当該特別関係者の所有に係る株券等の同条第八項に規定する株券等所有割合を加算したものをいう。)が政令で定める割合を下回る場合に限る。)」とあるのは「第二号に掲げる条件を付した場合」と、第二十七条の十四第一項中「、意見表明報告書及び対質問回答報告書(これらの」とあるのは「(その」と、同条第三項中「並びに第二十七条の十第九項(同条第十項において準用する場合を含む。)及び第十三項(同条第十四項において準用する場合を含む。)の規定」とあるのは「の規定」と、第二十七条の十五第一項中「、公開買付報告書、意見表明報告書又は対質問回答報告書」とあるのは「又は公開買付報告書」と、同条第二項中「公開買付者等及び対象者」とあるのは「公開買付者等」と、前条第一項中「公開買付者若しくはその特別関係者」とあるのは「公開買付者」と読み替えるものとする。 - 日本法令外国語訳データベースシステム
