第172条 文学的及び美術的著作物 172.1文学的及び美術的著作物(以下「著作物」という)とは，文学及び美術の領域において創作の時から保護される独創的な知的創作物をいい，特に次のものを含む。 (a)書籍，小冊子，論文その他の文書 (b)定期刊行物及び新聞 (c)口頭で行うために準備された講演，説教，演説及び学術論文(書面その他の形式にされるか否かを問わない) (d)書簡 (e)演劇用又は楽劇用の作品；舞踊の作品又は無言劇の演芸 (f)楽曲(歌詞を伴うか否かを問わない) (g)素描，絵画，建築，彫刻，版画，石版画その他の美術作品の著作物；美術作品のための模型又は下絵 (h)製造物品のための独創的な装飾的下絵又は模型(意匠として登録することができるものであるか否かを問わない)及び応用美術のその他の著作物 (i)地理学，地形学，建築学又は科学に関する図解，地図，図面，略図及び模型 (j)科学的又は技術的性質の図面又は模型 (k)写真の著作物(写真に類似する方法により製作された著作物を含む)；幻灯スライド (l)視聴覚著作物及び映画の著作物(映画に類似する方法又は視聴覚記録物を製作する方法により製作された著作物を含む) (m)絵画入りの図解及び広告 (n)コンピュータ・プログラム (o)その他の文学的，学術的，科学的及び美術的著作物 - 特許庁 - The following shall not be protected as utility models: a) inventions the commercial exploitation of which would be contrary to public order or morality, including inventions harmful to the health or life of persons, animals or plants or which are likely to seriously harm the environment, provided that said exception shall not depend merelyonthefactthatexploitationthereofisprohibitedbyalegalprovision; b) plant varieties and animal breeds; c) inventions having as a subject-matter biological material; d)inventionshavingasasubject-matteraproductconsistingofachemicalor pharmaceutical substance; e) inventions having as a subject-matter a process or a method.
次のものは，実用新案としての保護を受けることができない。(a) 発明であって，その商業的利用が公の秩序又は善良の風俗に反するもの。それには，人間，動物若しくは植物の健康若しくは生命にとって有害である発明，又は環境を深刻に害する虞のある発明を含める。ただし，前記の除外は，発明の利用が法的規定によって禁止されているという事実のみには準拠しないものとする。(b) 植物品種及び動物品種(c) 生物学的材料を主題とする発明(d) 化学的又は医薬的物質によって構成される生産物を主題とする発明(e) 方法又は手法を主題とする発明第2条実用新案についての権利は，発明者又はその権原承継人に属するものとする。 - 特許庁 - (1) A patent shall be revoked (Section 61) if it arises that 1. the subject matter of the patent is not patentable according to Sections 1 through 5; 2. the patent does not disclose the invention in a manner sufficiently clear and complete for it to be carried out by a person skilled in the art; 3. the essential contents of the patent have been taken from the descriptions, drawings, models, appliances or equipment of another, or from a process used by another, without the consent of said person (usurpation); 4. the subject matter of the patent extends beyond the content of the application as originally filed with the authority competent for the filing of the application; the same shall apply if the patent was based on a divisional application or on a new application filed in accordance with Section 7(2) and the subject matter of the patent extends beyond the content of the earlier application as originally filed with the authority competent for the filing of the earlier application.
(1) 次の事由が発生したときは，特許は取り消される(第 61条)。 1. 特許の対象が，第1条から第5条までの規定により，特許可能なものでないこと 2. 特許が，当該技術分野の熟練者が実施することができる程度に，明瞭かつ完全にその発明を開示していないこと 3. 特許の本質的内容が，他人の発明の説明，図面，ひな形，器具若しくは装置から，又は他人が使用する方法から，当該他人の同意を得ないで，取り出されていること(窃取)4. 特許の対象が，出願に係る権限を有する官庁に最初になされた形での出願の内容を超えていること。特許が分割出願又は第 7条(2)に従ってなされた新たな出願を基礎としており，かつ，特許の対象が，先の出願に係る権限を有する官庁に最初になされた形での先の出願の内容を超えている場合にも，同じ規定が適用される。 - 特許庁
