２ 第三十八条第三項、第三十九条第二項、第四十条、第四十六条、第四十七条第一項、第四十九条、第五十条、第五十一条第二項、第四項及び第五項並びに第五十四条の二第一項の規定は、国土交通大臣が飛行場又は航空保安施設を設置し、又はその施設に変更を加える場合に準用する。但し、第三十九条第二項については、国土交通大臣が飛行場を設置する場合において、当該飛行場の敷地が従前、適法に航空機の離陸又は着陸の用に供せられており、且つ、当該飛行場の進入表面、転移表面又は水平表面の上に出る高さの建造物、植物その他の物件がないときは、準用しない。 - 日本法令外国語訳データベースシステム
