(3) In addition to the provisions in the preceding paragraph, it is necessary for the State, local governments, business operators, and citizens to properly divide their respective roles in order to undertake in a proper and smooth manner the cyclical use of products, containers, etc. which have become circulative resources. In cases in which the roles of any particular business operators are deemed important in establishing a Sound Material-Cycle Society from the viewpoint of such considerations as the design and selection of raw materials for products, containers, etc. and the collection, etc. of products, containers, etc. that have become circulative resources, pursuant to the Basic Principles, the business operators undertaking the manufacture, sale, etc. of these products, containers, etc. are themselves responsible for collecting or delivering, or undertaking the proper cyclical use of, these products, containers, etc. which have become circulative resources, as their responsibility within the division of roles.

Having quoted the saying, "never invite suspicions needlessly," I find that idea to be quite natural as a course of action to gain higher trust and as a possible future issue. All in all, it’s common sense that an advisor is a high position in the FSA as a matter of course. What I consider constitutes a basic philosophy of conservatism is not to "help the weak and crush the strong," but rather to "help the weak and have the strong assume responsibility," which is an idea that the PNP supports. I believe that those in a position to lead others should exercise strict oversight that the public can feel satisfied with, be it in the capacity of a publicly-elected Diet member or Minister for Financial Services, in comprehensive consideration of ethics, morals, commonsense or, in some countries, religions, before law.

Article 1 Owing to the changes in the social and economic climate at home and abroad, alternative dispute resolution (procedures for resolution of a civil dispute between parties who seek, with the involvement of a fair third party, a resolution without using litigation; the same shall apply hereinafter) has become an important means of achieving prompt dispute resolution based on the specialized expertise of a third party and in accordance with the actual facts of the dispute. Bearing such in mind, the purpose of the Act on Promotion of Use of Alternative Dispute Resolution is to provide for the basic concepts of the Act and for the responsibilities of the government and other entities; and to establish a certification system and set special rules on nullification of prescription and other matters so as to make alternative dispute resolution procedures easier to utilize, thereby enabling parties to a dispute to choose the most suitable method for resolving a dispute with the aim of appropriate realization of the rights and interests of the people.

Article 7 (1) A nuclear operator shall, pursuant to the provisions of an ordinance of the competent ministry, prepare a nuclear operator emergency action plan with regard to its measures to prevent nuclear emergency, emergency response measures, and measures for restoration from nuclear emergency and other duties that are necessary for preventing the occurrence and progression (expansion) of a nuclear disaster and for promoting nuclear disaster recovery efforts, with respect to each of its nuclear sites, and review its nuclear operator emergency action plan every year and revise it if revision is found to be necessary. In this case, said nuclear operator emergency action plan shall not conflict with either any regional disaster prevention plan prescribed in Article 2, item (x) of the Basic Act on Disaster Control Measures or any disaster prevention plan for petroleum industrial complexes and other petroleum facilities prescribed in Article 31, paragraph 1 of the Act on the Prevention of Disasters in Petroleum Industrial Complexes and Other Petroleum Facilities (referred to as a "regional disaster prevention plan, etc." in the next paragraph).

I took questions in the Diet over and over again, and as I repeatedly said, the FSA does not handle policy-based finance or have jurisdiction over government-affiliated financial institutions. As you know, policy-based finance for SMEs is handled by the Ministry of Economy, Trade and Industry, while a housing financing scheme of Japan Housing Finance Agency, which was formerly known as Housing Loan Corporation, is under the jurisdiction of the Ministry of Land, Infrastructure, Transport and Tourism. Policy-based finance for agriculture, forestry and fisheries, which are fields where policy-based finance play a very large role, is handled by the Ministry of Agriculture, Forestry and Fisheries. Financial institutions under the jurisdiction of the FSA should not be treated in the same way as financing schemes under the jurisdiction of those ministries. Basically, the financial source of private financial institutions is deposits and their basic premise is that they repay deposits with interest. Therefore, we cannot universally require them to provide no-interest loans.

When the SME Financing Facilitation Act was established just after the Lehman shock two years ago, it was given the duration of roughly one year. With Toyota suffering a 40 percent drop in car sales two years ago – my home prefecture, Fukuoka, Kyushu, produces more than one million cars and is the second largest car-producing prefecture after Aichi – one after another of the car makers, including Toyota and Nissan, fired temporary workers. It was under those circumstances that we launched this Act, but, at the same time, it is also true that in the context of a capitalist society and a free society, there is a concern that the Act might result in financial discipline deteriorating in the form of moral hazard on the part of borrowers. As it is, indeed, naturally an important factor in a free society, and the basic rule in borrowing money is to pay it back with interest, I do think it necessary to heed any impact of the Act.

Regarding my duties as the Minister for Financial Services, the basic missions of the Financial Services Agency (FSA) are to ensure the stability of the financial system, protect users, improve the convenience of users, and establish a fair and transparent market. However, the facilitation of financing, regarding which I received an instruction from the Prime Minister today, is also important. As the global recession has continued since the Lehman shock, which occurred three years ago, Mr. Kamei, my predecessor as the Minister for Financial Services, put into force the SME Financing Facilitation Act (Act concerning Temporary Measures to Facilitate Financing for SMEs, etc.). After holding hearings with four associations of small and medium-size enterprises (SMEs) and regional financial institutions in various places across Japan, including Tokyo, Osaka, Nagoya, Fukuoka, Kitakyushu and Sendai, I concluded that it would be the right decision to extend this act for one year as the head of the administrative agency in charge of financial affairs. We will submit a relevant bill to the next ordinary session of the Diet and do all we can to have it enacted at an early date.

I will look into the fine details later, but basically, government offices are financed by taxes, and have authority based on the Constitution and laws, as a matter of course. The Cabinet is formed as a result of election by the people; then the Prime Minister comes forth, who appoints the Minister for Financial Services according to the Constitution. As this is an extremely democratic government office, it is common sense from my point of view to properly keep or publicly disclose the minutes regarding financial regulation and supervision which have a huge impact in ordinary circumstances as a basic rule, given that an executive branch of government is basically in the public domain. From what I have heard, minutes of seven or eight meetings were disclosed to the public after it was said that this would be done initially, but information on the progress in the interim was not disclosed at all. I think this is extremely odd in view of the rules of the executive branch of government. Basically, from the viewpoint of common sense, it is odd as a government in an open democratic nation that there are no minutes, especially on such a matter that has later had a significant impact on banking regulation and supervision, given the rules of government offices.

The parties may agree on the basic terms and conditions including the rate of royalties of a compulsory license. In the absence of agreement between the parties, the Director shall fix the terms and conditions including the rate of royalties of the compulsory license subject to the following conditions: (a) The scope and duration of such license shall be limited to the purpose for which it was authorized; (b) The license shall be non-exclusive; (c) The license shall be non-assignable, except with the part of the enterprise or business with which the invention is being exploited; (d) Use of the subject matter of the license shall be devoted predominantly for the supply of the Philippine market: Provided, that this limitation shall not apply where the grant of the license is based on the ground that the patentee’s manner of exploiting the patent is determined by judicial or administrative process to be anti-competitive. Simultaneously, how should insurance be regulated and supervised from now on? I believe insurance in China is not as advanced as in Japan yet. But then again, Japan’s insurance industry has experienced falling stock prices and interest rates over the past decade and suffered a long period of winter-like hardship: the insurance sector, where they have something called “expense profits”, “interest gain” and “mortality profits”, the interest gain was so squeezed that at one point, negative carry was more than 1 trillion yen. In the United States, the federal government will be establishing a division in charge of insurance for the first time within the federal government organization under the financial reform legislation. As you know, basic supervision of insurance in the United States is conducted on a state-by-state basis. Despite the fact that AIU—the world’s biggest private insurance company—was effectively nationalized in the United States, the insurance industry has been a bit of a blind spot in that any attempts in the past to negotiate with the central government often resulted in being told that it was a matter for the state government. The United States is a federal republic comprised of states, so in that sense, insurance varies from state to state in tax and other aspects.

I made a comment at the informal ministerial gathering today, which was obviously not a comment from the head of the administration, but I am Vice-Chief of the People's New Party (PNP), and the current government is, as you know, a coalition of the Democratic Party of Japan (DPJ) and the PNP. Accordingly, Prime Minister Kan, right after he assumed office, met with (PNP) Chief Shizuka Kamei to discuss how the two parties would cooperate in policymaking, at which meeting I was also present as the PNP Secretary-General at that time. Under the three-party coalition that preceded the current one, there was a committee called the Ministerial Committee on Basic Policies, which was set up as a forum for the parties to coordinate or match their policies, but then the Social Democratic Party left the coalition. That is why how the remaining parties should cooperate in policymaking afterwards was a subject of discussion at the party leader meeting right after Prime Minister Kan became the new Prime Minister, during which both leaders agreed to go about it properly. Then as it turned out, as you know, we had a House of Councilors election and the same subject also just came up again during the recent meeting of the two party leaders, who supposedly agreed to "do it (policy cooperation)." That is why I decided to make an elaborate comment on this subject to Prime Minister Kan at today's informal ministerial gathering, to which Prime Minister Kan responded by telling Mr. Gemba, who is a state minister and is also DPJ's Policy Research Committee Chair, to work on policy cooperation with the PNP in the proper way - therefore, Policy Research Committee Chair Gemba and I proceeded to discuss how it should be done, a task that I presume will basically be handled mainly by policy research committee chairs.

As you know, DPJ President and Prime Minister Kan and (PNP) Chief Kamei had a leader meeting the day following the day Prime Minister Kan assumed office, I believe, during which a decision to form a coalition was made. As I happened to be the Secretary General back then, I was also present at this meeting to witness, as I have explained, President Kan and Chief Kamei reach an agreement on creating an alternative to the Ministerial Committee on Basic Policies, which had been set up for the previous three-party coalition to coordinate their policies. This has not been done because everyone got a little busy in preparation for the election, as I have just talked about. Another point is that members of the PNP, being one of the parties in the coalition, have naturally raised voices requesting strongly that views of the party be reflected in the coalition. It is therefore not so much about the ceiling debate, although there are, of course, voices raised on the subject of ceilings, as it is simply natural that a coalition government should need to coordinate policies. That is what I reminded Prime Minister Kan of today, and he responded by saying that it is a matter of fact and telling Policy Research Committee Chair and Minister of State Gemba to create a proper system for it. While I did have a talk with Mr. Gemba later on, this is an issue between parties and I am sure that it will accordingly be handled properly, as it should be, by the Chief, or Secretary General or Policy Research Committee Chair of our party.
それはご存じのように、菅代表、総理と亀井(国民新党)代表との話し合いでも、これは総理大臣になった次の日でしたか、党首会談をやりましたね。そして、連立を組むということに決定したわけでございますが、そのとき私はたまたま幹事長でしたから、党首会談に同席させていただいておりまして、そのときも今さっき言いましたように、それまでは3党でしたから、基本政策閣僚会議というのが3党の政策のすり合わせでございましたが、そういったものにかわるものをつくろうということを菅代表と亀井代表と合意しておりまして、そういった意味で、これは今さっき話したような選挙で少しみんなお互いに忙しくなりましたので、やっておりませんし、また我が党内のこれはいろいろ当然連立政権でございますから、党内の意見も連立政権与党として反映したいという強い当然意見がございますので、そこら辺を踏まえてシーリングということよりも、シーリングにも当然意見があると思いますが、連立政権ですから、当然政策のすり合わせというのは、これは当然のことでございますから、そのことを改めて今日菅総裁に申し上げて、菅総理からも当然のことだし、きちっと玄葉政調会長、国務大臣にそのことをきちっとシステムをつくるようにということで、玄葉さんとあと話しましたけれども、党と党との話でもございますから、当然党首、あるいは幹事長、政調会長が我が党におりますから、そこら辺できちっとやっていこうといくというふうに思っていますよ。 - 金融庁
Article 58 (1) Where a person entitled to the right to receive a disability compensation pension has died, if the total of the amount of the disability compensation pension paid to said person (for the part of said disability compensation pension paid for the period until July of the fiscal year containing the day on which the person died (in cases where the month containing said day on which the person died falls on any of the months from April to July, the previous fiscal year; hereinafter the same shall apply in this paragraph), the amount obtained by making a calculation in accordance with the provisions of Article 16-6, paragraph (2) as provided for by an Ordinance of the Ministry of Health, Labour and Welfare) and the amount of the disability compensation pension advance lump sum payment pertaining to said disability compensation pension paid to said person (in cases where the grounds for the payment of said disability compensation pension advance lump sum payment arose in or before July of the fiscal year containing said day on which the person died, the amount obtained by making a calculation in accordance with the method of calculating the amount of the compensation pension for surviving family under the provision of said paragraph as provided for by an Ordinance of the Ministry of Health, Labour and Welfare) is less than the amount among those listed in the right-hand column of the following table corresponding to the grade of disability pertaining to the relevant disability compensation pension listed in the left-hand column of said table (in cases where said day on which the person died is August 1 of the fiscal year two years after the fiscal year the day of the occurrence of the grounds for calculation or any subsequent day, the amount to be obtained where the amount obtained by making a calculation in accordance with the provision of Article 8-3, paragraph (1) as applied mutatis mutandis pursuant to Article 8-4 as provided for by an Ordinance of the Ministry of Health, Labour and Welfare is regarded as the basic daily benefit amount in said table), the government shall, for the time being, pay a disability compensation pension balance lump sum payment equivalent to the amount of such balance as insurance benefits to the surviving family members of said person based on their claims.

第百七十一条の三 第五十条の三、第五十条の四、第五十条の五、第五十条の六第一項、第五十条の七、第五十条の八第二項、第五十条の十及び第五十条の十一の規定は、法第七十八条第四項において準用する法第二十九条第四項の規定による運航管理者の養成施設について準用する。この場合において、第五十条の三第一項中「航空従事者養成施設指定申請書(第十九号の四様式)」とあるのは「運航管理者養成施設指定申請書(第二十九号の二様式)」と、同条第三項第二号中「法第二十五条第一項、第二項及び第三項の限定、法第二十九条の二第一項の変更に係る限定、法第三十三条第一項の航空英語能力証明、法第三十四条第一項の計器飛行証明又は別表第三の一等航空整備士、二等航空整備士、一等航空運航整備士、二等航空運航整備士及び航空工場整備士の資格についての技能証明に係る整備の基本技術の科目の別ごとに定める過程」とあるのは「法第七十八条第一項の運航管理者技能検定に係る過程」と、第五十条の四第一号イ中「法第二十九条第一項(法第二十九条の二第二項、法第三十三条第三項又は法第三十四条第三項において準用する場合を含む。)の試験」とあるのは「法第七十八条第四項において準用する法第二十九条第一項の試験」と、第五十条の六第一項中「法第二十九条第四項」とあるのは「法第七十八条第四項において準用する法第二十九条第四項」と、第五十条の七中「航空従事者養成施設指定書(第十九号の五様式)」とあるのは「運航管理者養成施設指定書(第二十九号の三様式)」と、第五十条の八第二項中「前項」とあるのは「技能審査員」と、第五十条の十中「第五十条の二第五項」とあるのは「第百六十八条第一項第六号」と、「第五十条の二第三項及び第四項」とあるのは「第百七十条の六」と読み替えるものとする。 - 日本法令外国語訳データベースシステム
