(5) (1)にいう期間が規則108に基づいて延長された場合は，関連する書類は，延長期間が満了するまでは公衆の閲覧に供されないか，又は当該期間が満了と同時に延長された場合は，関連書類の公衆の閲覧は，当該延長期間が満了するまでは中止される。なお，当該指示を求める請求がなされた場合は，当該書類は，当該事項を登録官が決定するまでは，公衆の閲覧に供されない。 規則95 書誌的情報の公表 第108条(3)(a)の適用上，次の書誌的情報を定める。 (a) 出願番号 (b) 当該出願の出願日，並びに第17条(2)に基づく宣言が行われた場合は当該宣言の中で言及される各出願について，入手可能なときは出願日，出願国及び出願番号 (c) 第20条に基づく命令の結果出願人又は共同出願人となった者を含む出願人又は共同出願人の名称 (d) 規則56に基づく出願人又は共同出願人の名称変更 (e) 発明の名称，並びに (f) 出願が取り下げられ，取り下げられたものとして取り扱われ，放棄されたものとして取り扱われ，拒絶され又は拒絶されたものとして取り扱われる場合は，その事実 - 特許庁 - (20) With respect to the application of the provisions of paragraph (14) in the case where a person who intends to obtain the approval set forth in Article 5-2(5)(iv) of the Act with regard to book-entry transfer local government bonds has already obtained the approval set forth in paragraph (5)(iv) of the said Article with regard to other book-entry transfer local government bonds, in paragraph (14), the term "a document in which a specified book-entry transfer institution certifies that the person is a foreign account management institution prescribed in paragraph (5)(vii) of the said Article and any other document specified by an Ordinance of the Ministry of Finance" shall be deemed to be replaced with "a document that certifies that the person has obtained the approval set forth in paragraph (5) (iv) of the said Article with regard to other book-entry transfer local government bonds"; the term "submit such documents, in the case of book-entry transfer national government bonds, to the district director prescribed in paragraph (1)(i)(a) of the said Article via the specified book-entry transfer institution pertaining to the said book-entry transfer national government bonds, or in the case of book-entry transfer local government bonds, to" shall be deemed to be replaced with "submit such documents to"; the term "item (ii)(a) of the said paragraph" shall be deemed to be replaced with "paragraph (1)(ii)(a) of the said Article." In this case, where the written application set forth in paragraph (14) has been submitted, it shall be deemed that the approval set forth in Article 5-2(5)(iv) of the Act has been granted at the time of such submission.

In case of absence of such petition, preliminary patent of the Kyrgyz Republic shall be reregistered as a patent of the Kyrgyz Republic under the applicant’s responsibility for residuary terms; (3) effective preliminary patents of the Kyrgyz Republic for invention or industrial design, which five-year-period since the date of application filing is expired before entering into effect of the Law providing transition to unified protected document (patent), shall be reregistered as patents of the Kyrgyz Republic under the applicant’s responsibility for residuary terms; (4) regarding applications for granting of the certificate of the Kyrgyz Republic for utility model filed before entering into effect of the Law providing transition to unified protected document (patent), the decision on granting of the patent of the Kyrgyz Republic for utility model is made, provided that all appropriate fees are paid; (5) effective certificates of the Kyrgyz Republic for utility models shall be reregistered as the patent of the Kyrgyz Republic for utility model.
統一保護証書(特許)への移行に関し本法になされた変更及び追加に従って，次のとおり定められた。 (1) 発明又は意匠についてのキルギス共和国予備特許の付与出願であって，統一保護証書(特許)への移行を規定する法律の施行前になされたものについては，出願人は，実体審査付きの発明又は意匠についてのキルギス共和国特許の付与又は出願人の責任に基づく特許付与を申請する権利を有する。ただし，適正な手数料が納付されることを条件とする。出願人が該当する措置を取らない場合は，出願は取下とみなされる。 (2) 発明及び意匠のキルギス共和国の有効な予備特許であって，出願日以後5年の期間が統一保護証書(特許)への移行を規定する法律の施行前に満了していないものについては，予備特許の所有者は，実体審査付きの発明又は意匠についてのキルギス共和国特許の付与を申請する権利を有する。この申請がない場合は，キルギス共和国予備特許は，残余期間について出願人の責任に基づくキルギス共和国特許として再登録される。 (3) 発明又は意匠についてのキルギス共和国の有効な予備特許であって，出願日以後5年の期間が統一保護証書(特許)への移行を規定する法律の施行前に満了しているものは，残余期間について出願人の責任に基づくキルギス共和国特許として再登録される。 (4) 統一保護証書(特許)への移行を規定する法律の施行前になされた実用新案についてのキルギス共和国登録証の付与出願については，実用新案のキルギス共和国特許付与の決定がなされる。ただし，すべての適正な手数料が納付されることを条件とする。 (5) 実用新案の有効なキルギス共和国登録証は，実用新案のキルギス共和国特許として再登録される。 - 特許庁 - (3) The applicant, who wishes to use the priority right, shall file a declaration of priority concurrently with the patent application, indicating the date of application for the claimed priority and the state in which it has been filed, as well as the number of application. The declaration of priority may be filed or corrected within a time period of 16 months after the date of the earliest priority. This declaration may not be submitted or corrected, if the applicant has filed a request in accordance with Section 35, Paragraph four of this Law. The document, which attests the priority right, shall be a copy of the previous application, the conformity of which with the original has been certified by the institution, which received this application. The document shall be submitted to the Patent Office within a time period of 16 months after the date of the earliest priority.
(3) 優先権を行使しようとする出願人は，特許出願と同時に，優先権宣言書を提出しなければならない。同書においては，主張している優先権に係る出願の日及び当該出願を行った国並びに出願番号を表示する。優先権宣言書は，最も早い優先日から16月以内に提出又は訂正することができる。出願人が第35条(4)に基づく請求を行った場合は，宣言書を提出又は訂正することができない。優先権を証明する書類は，先の出願を受領した機関により原本に合致することが認証された先の出願の写しとする。当該書類は，最も早い優先日から16月以内に特許庁に提出しなければならない。 - 特許庁 - The foreign language document includes a statement, "first circle is drilled through the substrate at 20% of the desired diameter for the hole, and another circle is then drilled at 30% of the full diameter. "A person skilled in the art would be able to recognize that the "first circle" and "another circle" are drilled with the same center in succession in order to form a single hole of accurate size, in view of the context of the descriptions in the foreign language document and the disclosed technological details. Accordingly, the above sentence should be translated as "first circle is drilled through the substrate at 20% of the desired diameter for the hole, and in succession, the circle is additionally drilled up to 30% of the full diameter" (in Japanese). However, a translator misunderstood that the 20%-diameter hole and the 30%-diameter hole were to be separately formed at different positions, and mistranslated the sentence as "first circle at 20% of the desired diameter is drilled through the substrate, and a different circle at 30% of the desired diameter is drilled" (in Japanese).
外国語書面中のfirst circle is drilled through the substrate at 20％ of the desired diameter for the hole, and another circle is then drilled at 30％ of the full diameterとの記載に対し、当業者であれば外国語書面中の他の個所の記載や前後の文脈、技術内容から見てfirst circleとanother circleとは正確な大きさの穴を形成するために同じ場所に連続して開けられるものであることが認識でき、「基板に対し、最初に所望の直径の20％の穴を開け、続いて直径の30％の穴を開ける。」と翻訳すべきところ、20％の穴と30％の穴は、別な場所に形成されるものと誤解して「基板に対し、所望の直径の20％の第一の穴を形成し、次に直径の30％の別の穴を開ける。」と誤訳している場合。 - 特許庁 - If the applicant is not domiciled or has no real and effective commercial establishment in the Philippines, he shall designate by a written document filed in the Office, the name and address of a Philippine resident who may be served notices or process in proceedings affecting the mark. The written document shall be submitted to the Office within sixty days from filing date without need of any notice from the Office.
