The date of file of an application with Kyrgyzpatent is set as of the date of receipt of the documents necessary to establish the priority pursuant to the requirement of paragraph 1, Article 21 of the present Law, but if these documents are not presented simultaneously, than it is established on the date of receipt of the last one of the documents presented.
出願は，当該書類が定められた期間に提出されない場合は，取下とみなされる。 キルギス特許庁での出願日は，第21条第1段落の要件に従って優先権を確定するために必要な書類の受領日現在で定めるが，当該書類が同時に提出されない場合は，最後の提出書類受領日を出願日とする。 - 特許庁 - (5) If the applicant - (a) fails to file either a request under subsection (1) for a substantive examination or a request under subsection (2) for a modified substantive examination; or (b) fails to provide the information or document referred to in subsection (4) as required by the Registrar, within the prescribed period, the application for a patent shall, subject to subsection (6), be deemed to be withdrawn at the end of that period.

If the original is not available, an authenticated copy thereof in duplicate may be submitted instead. After recording, the Office shall retain the signed duplicate or one of the authenticated copies, as the case may be, and return the original or the other authenticated copy to the party who filed the same, with a notation of the fact of recording.

The requirements for the format and procedure for the completion of documents certifying priority shall be established by the Minister of Economic Affairs and Communications.
(4) 出願人又は特許所有者の書面による請求があり，かつ，国の手数料が納付されたときは，特許庁は，特許出願の謄本及び特許庁による公式の確認を内容とする，発明の優先権を証明する書類を発行する。優先権を証明する書類の作成に係る様式及び手続の要件は，経済通信大臣が定めるものとする。 - 特許庁 - In the cited document, facts “the terminal is used in the telephone mode when opened with the first hinge” and “the whole keypad may be used in the computer mode but in the general phone mode, only the necessary number keys and control keys can be used” are stated as different embodiment, which are approved as being matters used to specify the cited inventions for different cited inventions.
ここで、引用文献において「フォルダカバーを第一のヒンジに対して開いたときには端末は電話モードで利用されること」、及び、「コンピュータモードではフルキーボードを利用可能であるが、電話モードでは、必要な数字キーとコントロールキーだけ使えるようにしてあること」はそれぞれ異なる実施形態として記載されており、これらは異なる引用発明の発明特定事項と認められる。 - 特許庁 - However, in this case, in the case where 34 kinds of salts, for example, hydrochloride, hydrosulfate, tertrate or citrate, etc., which are widely used as pharmaceutically acceptable salt are simply exemplified in equal rank and hydrochloride is not listed as a particularly preferred salt, it is not deemed that hydrochloride of compound A is stated in the cited document to a identifiable degree by a person skilled in the art.
しかしながら、本事例の場合、塩酸塩、硫酸塩、酒石酸塩、クエン酸塩などの薬理学的に許容される塩として汎用される34種の塩が同列的に例示列挙され、塩酸塩は特に好ましい塩として挙げられておらず、引用文献には、化合物Aの塩酸塩は当業者が把握できる程度に記載されているとは考えられない。 - 特許庁 - However, KIPO is of the opinion that the material of the dispensing top and the combination structure between a dispensing top and a container in the claimed invention obviously differ from that of the cited document, whereas, JPO and SIPO does not regard the material of the dispensing top and the combination structure between a dispensing top and a container as factors which render the claimed invention novel.
