(c) (4)に基づいて当該申請に付与されるライセンスには，当該ライセンスは，実施権者の正当な利害に適切な保護が与えられることを条件として，付与の基礎となった状況が消滅し，かつ，裁判所の意見では再び生じる見込みが小さい場合は，登録意匠の登録所有者による申請に基づき終了する旨の規定を含めるものとする。 - 特許庁 - (a) where any agreement or arrangement has been made between the government of the Republic and the government of the convention country for the supply or mutual exchange of information or articles, provide, either generally or in any class of case specified in the regulations that an extension of time shall not be granted under this section unless the design has been communicated in accordance with the agreement or arrangement;
(a) 共和国政府と条約国の政府との間で情報又は物品の供給又は相互交換に係る協定又は取決めが締結された場合，一般的に又は規則に定める何れかの事例において，当該意匠が当該協定又は取決めに基づいて通知されたのでない限り，期間延長は本条に基づいて認められない旨規定することができ， - 特許庁 - The Registrar may, on a request made in accordance with the regulations by any of the persons, make any determinations the Registrar thinks fit for either or both of the following purposes: enabling the application to specify which of those persons is an entitled person in relation to a design disclosed in the application; regulating the manner in which the application is to proceed.
それらの者のうち何れかが規則に従って請求したときは，登録官は，次の目的の何れか又は両方について自己が適切と考える決定を行うことができる。出願において開示された意匠に関連して，それらの者のうち何れが権原者であるかを出願に明記することができるようにするため出願の進行の態様を規制するため - 特許庁 - If: a converted application is amended under section 28 of this Act to exclude one or more of the designs disclosed in the converted application; and the applicant files a design application under section 23 of this Act in respect of one or more of the excluded designs; the term of registration of the excluded designs starts from the date of the conversion request under subsection 159(1).
次の場合，すなわち，変更された出願において開示される1又は2以上の意匠を除外するために，本法第28条に基づいて変更された出願が補正され，かつ1又は2以上の除外意匠に関して，出願人が本法第23条に基づく意匠出願をする場合は，除外意匠の登録期間は，第159条(1)に基づく変更請求の日より開始する。 - 特許庁 - The court may infer for the purpose of this section that such an offence has been committed in relation to any goods, material or articles if it is satisfied that such an offence has been committed in relation to goods, material or articles which are representative of them, whether by reason of being of the same design, or part of the same consignment or batch, or otherwise.
裁判所は，本条の適用上，同一の意匠，又は同一の積送品もしくはバッチの一部であるか，又はその他の理由によるかを問わず，かかる犯罪が商品，素材又は物品を代表する商品，素材又は物品に関してなされたと認める場合に，かかる犯罪がこの商品，素材又は物品に関してなされたと推定することができる。 - 特許庁 - The brief description of the industrial design or model shall be made directly on the application or the signed and stamped appendices and shall exclusively contain the new characteristic features of the outer aesthetic appearance which occur in the reproductions appended to the application (maximum 100 words).
工業意匠又はひな形に関する簡潔な説明は，願書又は署名捺印した添付書類上に直接記載するものとし，かかる説明には，願書に添付された複製物に当てはまる美的外観に関する新規な特徴的要素(最大100語)のみを記すものとする。製品名称のみによる認識が不可能である工業意匠又はひな形については，その実用性について陳述する。 - 特許庁 - If, after hearing the applicant in cases where the applicant so desires or the Controller thinks fit, the Controller is satisfied that the failure to pay the fee for extension of the period of copyright was unintentional and that there has been no undue delay in the making of the application, the Controller shall upon payment of any unpaid fee for extension of the period of copyright together with prescribed additional fee restore the registration of design.
申請人が希望し又は長官が適当と認める場合において，申請人を聴聞した後，長官が意匠権期間の延長手数料の不納付が故意でなく，かつ，申請をするのに不当な遅延がなかったことに納得するときは，未納付の意匠権期間延長手数料及び所定の追加手数料の納付があれば，意匠登録を回復することができる。 - 特許庁 - Notwithstanding anything contained in the second proviso to sub-section (2), where any ground on which the registration of a design may be cancelled under section 19 has been availed of as a ground of defense under sub-section (3) in any suit or other proceeding for relief under sub-section (2), the suit or such other proceedings shall be transferred by the Court in which the suit or such other proceeding is pending, to the High Court for decision.
(2)の第 2ただし書に拘らず，第19条により意匠登録が取り消される理由が，(2)による救済を求める訴訟又はその他の手続において，(3)による抗弁の理由として援用された場合は，当該訴訟又は前記その他の手続については，当該訴訟又は当該他の手続が係属している裁判所から判決を得るため高等裁判所に移管される。 - 特許庁 - For the purposes of this section, the expression “security of India” means any action necessary for the security of India which relates to the application of any design registered under this Act to any article used for war or applied directly or indirectly for the purposes of military establishment or for the purposes of war or other emergency in international relations.
本条に言う「インドの安全保障」とは，インドの安全保障上必要な何らかの行動であって，戦争に使用されるか，又は軍事施設の目的，若しくは戦争目的，若しくは国際関係上その他の緊急事態の目的で直接，間接に適用される物品に対して本法により登録された何らかの意匠の適用に関係するものを意味する。 - 特許庁 - Where a person in the course of a business, trade or profession has in his or her possession, custody or control infringing products or articles the registered proprietor of the design may apply to the appropriate court for an order that the infringing products or articles be delivered up to him or her or to such other person as the court may direct.
ある者がその事業，取引又は職業活動の過程において登録意匠の侵害製品又は物品を占有，保管又は管理している場合は，当該意匠の登録所有者は適合裁判所に対して当該侵害製品又は物品を自己，又は適合裁判所が指定するその他の者に引き渡すべき旨を命じるよう申請することができる。 - 特許庁 - Until an application has been made for registration of a transaction referred to in this section under section 41-- (a) the transaction shall be ineffective as against a person acquiring a conflicting interest in or under the design right in ignorance of it; and (b) a person claiming to be a licensee by virtue of the transaction shall not be entitled to the rights and remedies conferred by sections 63 and 65.
本条にいう取引についての登録申請が第41条に基づいてされるまでは，(a) 当該取引は，それを知らずに当該意匠権に抵触する利害を取得した者に対しては効力を有さず，かつ(b) 取引によって実施権者であると主張する者は，第63条及び第65条によって与えられる権利及び救済手段を認められない。 - 特許庁 - In case of a dispute as to the use of a design under this section, the terms therefor or as to the existence or scope of any record referred to in subsection (3), the matter shall be referred to the High Court for decision, and the High Court shall have the power to refer the whole matter or any question or issue of fact thereon to be heard by an arbitrator upon such terms as it may direct.
本条に基づく意匠の実施，その条件又は(3)にいう記録の存在若しくは範囲に関して争いが生じた場合は，当該事項は高等裁判所の決定に委ねられるものとし，高等裁判所は争い全体又は争われている特定の問題若しくは事実をその指示する条件の下に仲裁人によって審理させる権限を有する。 - 特許庁 - The employer of a creator of an industrial design, for which an application has been filed, created under the provisions of Act No. 84/1972 Coll., shall be entitled to file the application if he submits a request to be entered as the applicant within three months of the entry into force of this Act. The creator shall be entitled to receive from the employer remuneration in accordance with Section 44(4) of this Act.
