I was Minister for Financial Services, while Minister Yosano had the experience of serving as the Minister for International Trade and Industry. In relation to the support for Tokyo Electric Power, what kind of cooperation the company seeks from stakeholders and how stakeholders, including financial institutions, respond are matters to be determined through consultations between private business operators, so my understanding is that the Financial Services Agency is not in a position to make comments. In any case, regarding the compensation issue, it is important to pay damages compensation in a prompt and appropriate manner, and another important thing is, as you know, to avoid causing unnecessary, unexpected adverse effects on the stability of the financial and capital markets, on the principal premise that stable electricity supply should be ensured. We will continue to carefully monitor market developments.

Where the decision on the objection under Section 64 has not been made within six months from the date of filing, and where, after the expiry of this time limit, the person filing the objection has filed a request for decision, the appeal from a decision of the Trade Mark Section or Trade Mark Division is directly admissible, in derogation of subsection (1), sentence 1, if the decision on the objection is not made within a period of two months from the receipt of the request. If the person raising the objection is opposed by another party to the proceedings, sentence 1 shall be applicable provided that the period of six months after the objection was raised is replaced by a period of 10 months. If the other party has also raised an objection, the other party must give his consent to the appeal under sentence 2. The written declaration of consent shall be attached to the appeal. If the other party does not also lodge an appeal within one month after service of the appeal under subsection (4), sentence 2, his objection is deemed to have been withdrawn. The remaining periods of time under sentences 1 and 2 shall be interrupted if the proceedings are suspended or if, on request of a party to the proceedings, an extension of time has been granted. The remaining periods of time under sentences 1 and 2 shall recommence to run after the suspension of the proceedings has been terminated or the extension of time granted has expired. After a decision on the objection has been issued, an appeal under sentences 1 and 2 shall no longer be admissible.

When the SME Financing Facilitation Act was established just after the Lehman shock two years ago, it was given the duration of roughly one year. With Toyota suffering a 40 percent drop in car sales two years ago – my home prefecture, Fukuoka, Kyushu, produces more than one million cars and is the second largest car-producing prefecture after Aichi – one after another of the car makers, including Toyota and Nissan, fired temporary workers. It was under those circumstances that we launched this Act, but, at the same time, it is also true that in the context of a capitalist society and a free society, there is a concern that the Act might result in financial discipline deteriorating in the form of moral hazard on the part of borrowers. As it is, indeed, naturally an important factor in a free society, and the basic rule in borrowing money is to pay it back with interest, I do think it necessary to heed any impact of the Act.

(2) Until the date when the notification of the Patent Office regarding the grant of patent is published, the applicant, in accordance with Section 38, Paragraph one of this Law, without exceeding the extent of the patent application, may divide it in two or more applications, maintaining the filing and priority date of the initial application for each of them. (1) Where registered encumbrances exist in relation to a trademark or a claim of ownership is pending and the owner has not renewed the trademark, said trademark shall not lapse prior to the encumbrance being lifted or the claim being finally rejected. (2) For the time being, with regard to a child admitted in an institution for orthopedically impaired children pursuant to the provision of Article 27 paragraph (1) item (iii) or a child provided in Article 43-3 and hospitalized in a Designated Medical Institution based on an entrustment pursuant to paragraph (2) of the same Article whose level of the disability is serious, when a prefectural governor finds that welfare of the child is likely to be impaired unless his/her admission or hospitalization is continued, the prefectural government may, notwithstanding the provision of Article 31 paragraph (3), take a measure to continue his/her admission in the institution for orthopedically impaired children or the entrustment pursuant to the provision of Article 27 paragraph (2), or change either of these two measures to the other one, even after he/she attains the age of 20.

When making comparisons between two widely separated points in time, attention needs to be paid to changes in demographic structure and the number of persons in work by size of employer. Nevertheless, it is worth noting a number of points in relation to factors such as the ratio of employer to employee incomes35) and the risk aversion analyzed below. Article 15 (1) Among the employers with a contractor who carries out a part of the work in an undertaking executed at one place (where as there exists two or more contracts under which a part of the work in the undertaking is begun, there exist two or more such employers, employer who ordered the earliest contract; hereinafter referred to as the "Principal Employer"), one (hereinafter referred to as "Specified Principal Employer") who carries on an undertaking (hereinafter referred to as "Specified Undertaking") related to construction or other industries prescribed by Cabinet Order, shall, where workers employed by him/her and by his/her contractors (where the work in the said undertaking of the principal employer is carried out under subcontracts of several levels, subcontractors who are party to subsequent subcontractors shall be included; hereinafter referred to as "related contractors") perform work at the said place, appoint an overall safety and health controller in order to prevent industrial accidents which may occur as a result of the work carried out by these workers at the same place, and have him/her direct the work of Principal Safety and Health Supervisors, and at the same time exercise overall control over the matters provided for in each item of paragraph (1) of Article 30; provided that this shall not apply where the number of such workers does not reach the figure provided for by Cabinet Order.

(2) Notwithstanding subsection (1), the Board of Appeal of the Federal Patent Court shall issue a decision 1. if a party requests the decision and no other party has filed an opposition within two months after service of the request, or 2. upon the request of only one party if at least 15 months have lapsed since expiry of the opposition time limit, or in the case of a request of an intervening party if at least 15 months have lapsed since declaration of intervention. This also affected the real economy – for instance, production in Toyota's factory in Fukuoka Prefecture, my home prefecture, dropped by 40 percent two years ago and occurrences like that explain why Japan has been in the situation that it is in now since then. It was against this background that the Dodd-Frank Act was implemented in the U.S. And, at that very time of historical significance, I met with FRB Chairman Bernanke and Mr. Volcker. Under the Volcker Rule, commercial banks may engage in a high-risk, high-return business on demand from customers, but not for their own accounts. In my view, this is the very core of the new Dodd-Frank Act. This is another case of a significant sea change. It was by luck that I had an opportunity to visit the U.S. in those days in the capacity of the Minister for Financial Services.

(2) Notwithstanding the provisions of the preceding paragraph, where terms of trust contain a provision concerning the division of duties among the trustees, when either of these trustees has assumed an obligation to a third party in the course of administering trust affairs pursuant to such provisions, the other trustees shall be liable only by using property that belongs to the trust property to perform the obligation; provided, however, that where the third party knew, at the time of the act causing the assumption of the obligation, that said act was conducted in the course of administering trust affairs and that there were two or more trustees for the trust, and did not know and was not negligent in failing to know that the terms of trust contained provisions concerning the division of duties among the trustees, the other trustee(s) may not duly assert such provisions on the division of duties against the third party.

(a) If an applicant fails to prosecute his application within the required time as provided in these Regulations, the application shall be deemed withdrawn. (b) The time for reply may be extended only for good and sufficient cause, and for a reasonable time specified. Mr. Yoshiro Mori (a former Prime Minister) supported the umbrella organization for kindergartens, while nursery schools basically had the support of Mr. Ryutaro Hashimoto. As I mentioned several times, I was a member of the Hashimoto Cabinet when Hokkaido Takushoku Bank and Yamaichi Securities failed in 1997 as a result of a financial crisis, and when Nippon Credit Bank and Long-Term Credit Bank of Japan failed in 1998. At that time, banks engaging in overseas business were required to have a minimum capital adequacy ratio of 8%, and banks focusing on domestic business were required to have a minimum capital adequacy ratio of 4%. Generally speaking, the higher capital adequacy ratio a bank has, the more sound it is. However, if it goes too far, a credit crunch will occur. During the financial crisis, two big department stores located in front of the railway station in my hometown of Kitakyushu failed-a loan buyback provision was also a factor behind this-, and thus, I learned first-hand about the soundness of banks and the impact on the real economy. I related my experiences like this to Ms. Lagarde and Mr. Noyer.

While my predecessor was in office, a law called the SME Financing Facilitation Act (Act concerning Temporary Measures to Facilitate Financing for SMEs, etc.) was established. In Japan, 99.7% of all companies are small and medium-sized enterprises, or SMEs, which employ 28 million people. Now, faced with growing economic globalization, especially since the Lehman crisis two years ago, SMEs have been suffering considerably from hardships. At the same time, though, SMEs have the advantage of being flexible and resilient and, from the viewpoint, the FSA considers SMEs to be extremely important. My hometown is the city of Kitakyushu, where Yahata Steel Works, initially a government-owned company, was founded 100 years ago, and served as the base for the creation of a large number of SMEs there. Fukuoka Prefecture, also home to factories of Toyota and Nissan, is the second-largest car-producing prefecture after Aichi, which explains the large number of modest-size companies and SMEs there.

According to what I have heard from the administrative staff, the Incubator Bank of Japan was inspected twice before the latest inspection for the fiscal year ended March 31, 2009, as I just mentioned: the previous inspection was for the fiscal year ended March 31, 2007 and the one before that was for the fiscal year ended March 31, 2005. My understanding is that as at the end of the fiscal year subject to each of the previous two inspections, the Bank’s financial position was assets in excess of liabilities according to the results of these inspections. Also, my understanding is that there were no material violations of laws and regulations, inadequacies in systems or other such problems in its business operations that would lead to administrative actions as found in the latest inspection. As I have repeatedly stated, at the time of the first inspection, the Bank engaged in operations allegedly based on a new business model targeted at small and medium-sized enterprises (SMEs). The Lehman Brothers shockwave that struck at the time may have been one of the factors. That said, then-Chairman Takeshi Kimura is an extremely capable person, who, according to what I have been told, had an authoritarian management style, so I suspect overambitious business expansions gave rise to the present outcome.

The FSA will continue to closely monitor the developments in markets including foreign exchange and stock markets, and respond properly according to the economic and financial climate from the viewpoint of sufficiently demonstrating financial intermediation functions. In fact, at today’s informal gathering with Cabinet ministers, financial measures for SMEs were brought up by the Minister of State for Economic and Fiscal Policy, if I am not mistaken. As you may already know, the Act concerning Temporary Measures to Facilitate Financing for SMEs, etc. was established based on the agreement among the three ruling parties when Shizuka Kamei served as Minister for Financial Services. I am paying very close attention to the Act, which covers a period of two years including two year ends and two fiscal year ends; I believe this is groundbreaking legislation in Japan. The perspectives of megabanks seems to have somewhat changed, as I have been told by a staff member at one of the local financial bureaus that a megabank started participating in conventions of shinkin banks and credit unions since the establishment of the Act for the first time ever. It may be common knowledge, but 99.7% of companies in Japan are SMEs, and 42 million people work for SMEs. SMEs are rather agile, flexible and extremely precious. As I may have mentioned previously, in my hometown Kitakyushu City, which is a city dominated by SMEs, I have been told by businesspeople that their companies have actually managed to survive due to the establishment of the Act. Then again, I have also heard cries from them that what they want now is work, so we intend to execute appropriate policies in a timely manner by taking these matters into consideration as well.

(1) A trademark or application therefor may belong pro indiviso to two or more persons. The resulting common property shall be governed by the terms of agreement between the parties, failing that by the provisions of this section and, in the final instance, by the provisions of common law on common ownership of property. I made a comment at the informal ministerial gathering today, which was obviously not a comment from the head of the administration, but I am Vice-Chief of the People's New Party (PNP), and the current government is, as you know, a coalition of the Democratic Party of Japan (DPJ) and the PNP. Accordingly, Prime Minister Kan, right after he assumed office, met with (PNP) Chief Shizuka Kamei to discuss how the two parties would cooperate in policymaking, at which meeting I was also present as the PNP Secretary-General at that time. Under the three-party coalition that preceded the current one, there was a committee called the Ministerial Committee on Basic Policies, which was set up as a forum for the parties to coordinate or match their policies, but then the Social Democratic Party left the coalition. That is why how the remaining parties should cooperate in policymaking afterwards was a subject of discussion at the party leader meeting right after Prime Minister Kan became the new Prime Minister, during which both leaders agreed to go about it properly. Then as it turned out, as you know, we had a House of Councilors election and the same subject also just came up again during the recent meeting of the two party leaders, who supposedly agreed to "do it (policy cooperation)." That is why I decided to make an elaborate comment on this subject to Prime Minister Kan at today's informal ministerial gathering, to which Prime Minister Kan responded by telling Mr. Gemba, who is a state minister and is also DPJ's Policy Research Committee Chair, to work on policy cooperation with the PNP in the proper way - therefore, Policy Research Committee Chair Gemba and I proceeded to discuss how it should be done, a task that I presume will basically be handled mainly by policy research committee chairs.

I spoke with FRB (Federal Reserve Board) Chairman Bernanke two weeks ago and also had a chance to speak with People's Bank of China Governor Zhou Xiaochuan this week. Frankly speaking, this is, as a matter of fact, a kind of issue to be decided on by the global forum of the G20, as it relates to stability of financial institutions worldwide and, at the same time, the definition of capital adequacy, and the quality and quantity debate, among other things. A dozen years or so ago, Japan was hit by a financial crisis. When I was previously a minister, I witnessed something similar – the failure of the Hokkaido Takushoku Bank – which resulted in a credit crunch and credit withdrawal that, as many of you must remember, indeed caused a large number of companies to go under one after another. In that sense, it is not necessarily a positive thing to make a capital adequacy ratio higher and higher.

If a person sells, or exposes for sale, or has in his possession for sale or for any purpose of trade or manufacturer any goods or things to which a false trademark or a false trade description is applied or which, being required under section 108 to have applied to them an indication of the country or place in which they were made or produced or the name and address of the manufacturer or producer or the person for whom the goods are manufactured or produced are without the indication so require, he shall, unless the proves (a) that, having taken all reasonable precautions against committing an offence against this section, he had at the time of the commission of the alleged offence no reason to suspect the genuineness of the trademark or trade description or that any offence had been committed in respect of the goods; and (b) that, on demand by or on behalf of the prosecutor he gave all the information in his power with respect to the person from whom he obtained such goods or things; or (c) that otherwise he acted innocently, be punished with imprisonment of either description for a term which may extend to 2 (two) years, or with fine, or with both, and in case of a second or subsequent conviction, with imprisonment of either description for a term which may extend to 3 (three) years, or with fine, or with both.
