９　農林水産大臣は、第二項第四号又は第五号に掲げる事項に関する農林水産省令又は規則であつて、河川法（昭和三十九年法律第百六十七号）が適用され、若しくは準用される河川（以下「河川」という。）又は砂防法（明治三十年法律第二十九号）第二条（指定土地）の規定により国土交通大臣が指定した土地（以下「指定土地」という。）に係るものを定め又は認可しようとするときは、あらかじめ、国土交通大臣に協議しなければならない。例文帳に追加

３　国土交通大臣、都道府県知事又は市町村長は、河川若しくは指定土地に関する第一項に掲げる工事をし、若しくはさせようとする場合又はこれらの工事について河川法第二十三条から第二十七条まで若しくは第二十九条（河川使用の許可等）の規定による許可若しくは砂防法第四条（指定土地における一定行為の禁止、制限）の規定による制限に係る許可をしようとする場合において、当該工事が保護水面の区域内においてされるものであるときは、政令の定めるところにより、あらかじめ、当該保護水面を管理する都道府県知事又は農林水産大臣に協議しなければならない。例文帳に追加
