そのような梱包若しくは包装が，[2]及び[3]の規定により第三者が当該標識を使用することが禁じられている商品若しくはサービスの梱包若しくは包装のために使用され，又は標識媒体がかかる商品若しくはサービスの識別のために使用される虞が存在する場合には，禁止される。 - 特許庁 - if it conflicts with a non-registered trademark or with any other distinctive sign or feature used in the course of trade which confers upon its owner the right to prohibit the use of any later trademark, provided such rights have been acquired prior to the date of the application for the later trademark, taking into account any priorities claimed;
後発商標の使用を禁止する権利のある所有者が取引において使用している未登録の商標又はその他の顕著性のある標識若しくは特徴を侵犯する場合。ただし，主張される優先権を斟酌した上で，かかる権利が後発商標の出願日前に取得された場合に限る。 - 特許庁 - For greater certainty, in determining for the purposes of this Ordinance whether the use of a sign is likely to cause confusion on the part of the public, the Registrar or the court may take into account all factors relevant in the circumstances, including whether the use is likely to be associated with a registered trade mark.
念の為であるが，本条例の適用上標識の使用が公衆の間に混同を生じさせる虞があるか否かを決定するに際し，登録官又は裁判所は，使用が登録商標と関連する虞があるか否かを含めて，当該事情に関連するすべての要因を考慮することができる。 - 特許庁 - An application for the registration of a geographical indication shall be refused by the Directorate General, if the sign concerned: a. is against morality of religion, public order, likely to deceive or mislead people as to the characteristics, such as features, quality, source of origin, process of production or use; b. is not qualified to be registered as a geographical indication.
地理的表示の登録出願は，当該標識が次の場合，総局によって拒絶される。 (a) 宗教規範，道徳，公共の秩序に反するか，特質，品質，原産地，生産工程，使用法等の特徴について社会を誤認混同させる。 (b) 地理的表示として登録される要件を備えていない。 - 特許庁 - Any person who deliberately and without right uses a sign which is protected under source of origin of goods or services that are likely to deceive or mislead people as to the origin of the goods or services concerned shall be sentenced to imprisonment for a maximum period of 4 (four) years and/or a fine of a maximum amount of Rp. 800,000,000.00 (eight 43 hundred million rupiahs).
何人も，故意にかつ権利なく，商品又はサービスの原産地表示に基づき保護されている標識を当該商品又はサービスの原産地に関して公衆を欺き，又は誤認させるように使用する者は，最長 4年の禁錮及び／又最高額800,000,000(8億)ルピアの罰金に処する。 - 特許庁 - “Import or export of goods” means the actual carrying across the border of the Republic of Bulgaria of goods bearing a sign which is identical with or similar to a registered mark or a registered geographical indication, or an imitation thereof, regardless of whether the customs regime has been operated with respect to such goods.
「商品の輸入又は輸出」とは，登録標章若しくは登録された地理的表示と同一又は類似の標識が付されている商品又はその模倣をブルガリア共和国の国境を越えて実際に輸送することをいい，税関当局がその商品の取扱いに関与していたか否かを問わない。 - 特許庁
