欧州の金融不安、相変わらず収まる兆しを見せず、特に金融危機の発火点となったギリシャがユーロからの離脱が浮かんでは消えという状況ですけれども、日本の金融機関が保有しておりますギリシャ向けの融資、あるいは取引、この規模と経営に与える影響をどのように考えていらっしゃるでしょうか。 - 金融庁 - (1) Unless the Act or any regulation made thereunder otherwise prescribes, or the Registrar otherwise directs, any person may be represented in proceedings before the Patent Registration Office by a patent agent who may attend, file documents and sign documents on that person's behalf.
(1) 特許法又は特許法に基づき制定される規則において別段の定めがなされない限り，又は登録官が別段の指示をしない限り，何人も，特許登録局における手続を特許代理人に委任することができ，委任を受けた特許代理人は，本人に代わって手続に出席し，書類を提出し，また書類に署名することができる。 - 特許庁 - Should an order of attachment be issued by the Hearing Officer, he shall sign and forward the order to the Director who shall direct, without delay, the officer or such other designated employee of the Bureau to attach so much of the property in the Philippines of the party against whom it is issued, not exempt from execution, as may be sufficient to satisfy the applicant's demand, unless such party makes deposit or gives a bond as hereinafter provided in an amount equal to that fixed in the order, which may be the amount sufficient to satisfy the applicant's demand or the value of the property to be attached as stated by the applicant, exclusive of costs.
ただし，当該当事者が，申請人の要求を満たすのに十分な額又は申請人が提示する差押財産の価額(費用を除く)に等しくなるように命令に定められた額又は当該額面の保証証書を，以下に規定するように供託した場合はこの限りではない。 - 特許庁 - trade mark means any sign capable of being represented graphically; and distinguishing the goods or services of 1 person from those of another person; and includes, except in sections 83 to 87, a certification trade mark; and except in sections 83 to 87, a collective trade mark
「商標」とは，標識であって，図形的に表示することができるものであり，かつ1の者の商品又はサービスをそれ以外の者の商品又はサービスから識別することができるものをいい，かつ次に掲げるものを含む。第83条から第87条までにおける場合を除き，証明商標，及び第83条から第87条までにおける場合を除き，団体商標 - 特許庁 - A person does not commit an offence under this section unless the goods are goods in respect of which the trade mark is registered; or the trade mark has a reputation in Brunei Darussalam and the use of the sign takes or would take unfair advantage of, or is or would be detrimental to, the distinctive character or the repute of the trade mark.
以下の場合を除き，本条に基づく犯罪をなしたものとしない。当該商品に関して当該商標が登録されている商品である場合，又は，当該登録商標がブルネイ・ダルサラーム国で名声を得ており，当該標識の使用がその商標の識別性又は名声を不正に利用する又は損なうもしくはそうなる場合。 - 特許庁 - The owner of a registered trademark shallhave the right to file a lawsuit to prevent others from using it or from using any other sign similar to it and liable to mislead the publicas to the products or services for which the trademark is registeredand as to similar products or services.
登録商標の所有者は，他の者が当該商標を使用すること又は当該商標に類似し，当該商標が登録されている製品若しくはサービス及び類似の製品若しくはサービスについて公衆に誤認を生じさせる虞があるその他の標識を使用することを防止するために訴訟を提起する権利を有する。 - 特許庁 - a) by the proprietor, if because of its identity with, or similarity to, the earlier trade mark and the identity or similarity of goods or services covered by the sign and the trade mark there exists a likelihood of confusion on the part of the public; the likelihood of confusion includes the likelihood of association with the earlier trade mark;
(a) 所有者。ただし，当該標識と先の商標との間に同一性又は類似性があり，かつ，当該標識及び商標の対象である商品又はサービスの間に同一性又は類似性があるために，公衆において混同の虞が存在する場合に限る。混同の虞には，先の商標との連想の虞が含まれる。 - 特許庁 - c) identical with, or similar to, the trade mark with the reputation in the territory of the Slovak Republic, not registered for identical or similar goods or services, if the use of that sign without due cause takes unfair advantage of, or is detrimental to, the distinctive character or the repute of the trade mark.
(c) スロバキア共和国の領域において評判を有する商標であって，同一の又は類似の商品又はサービスを登録の対象としていないものとの間に同一性又は類似性があるもの。ただし，当該標識の正当な理由がない使用により，商標の識別性又は評判が不当に利用されるか又は損なわれる場合に限る。 - 特許庁 - A sign may not be granted trademark protection: (a) if it would infringe earlier personal rights of others, in particular a right in a name or of personal portrayal; (b) if it would conflict with an earlier copyright or industrial property right of others, including conflict with the name of a protected plant variety.
標識は，次の場合は，商標保護を付与されない。(a) 当該標識が他人の先の人格権，特に名称又は個人の肖像における権利を侵害することになる場合(b) 当該標識が，保護された植物品種の名称との抵触を含めて，他人の先の著作権又は工業所有権と抵触することになる場合 - 特許庁 - If the applicant so requests specially in the request for accelerated procedure, the Hungarian Patent Office shall register the sign as a trademark simultaneously with the publication of the trademark application (particularly accelerated procedure), with the proviso that the provisions of Article 64(3) shall only apply after the expiry of the time limit fixed for submitting a notice of opposition [Article 61/B(1) and (2)].
ハンガリー特許庁は，出願人が加速手続の請求書で特にそのように請求する場合は，第64条(3)の規定を異議申立通知書の提出(第61/B条(1)及び(2))のために定める期限の到来後に限り適用する旨のただし書きを付して，商標出願の公告と同時にその標識を商標として登録する(特別加速手続)。 - 特許庁 - Any sign capable of being protected as a trade mark within the meaning of Section 3 and capable of distinguishing the goods or services of the members of the proprietor of the collective mark from those of other undertakings according to their origin from a given enterprise or their geographical origin, their nature, quality or other properties may be registered as a collective mark.
第3条にいう商標として保護することができるすべての標識であって，団体標章の所有者の構成員の商品又はサービスを，所定の企業による出所若しくは原産地，種類，品質又はその他の特性に従って，他の事業のそれから識別することができるものは，団体標章として登録することができる。 - 特許庁
