(4) 特許により保護されている発明が第8条の規定に合致していないと考える者は，特許所有者を相手として，特許の一部又は全部を取り消すための訴訟を提起することができる。特許所有者は，特許保護の範囲を減縮すれば発明が第8条の規定に合致するようになるときは，訴えに係る手続の過程で，その減縮をすることができる。登録簿への登録の請求書を，判決文の謄本及び，所定の事情においては，国の手数料の納付を証明する情報を添付して，判決が効力を生じてから1月以内に特許庁に提出しなければならない。特許の補正をするときは，特許所有者は，判決が効力を生じてから3月以内に，判決に従って補正した発明の説明及び特許クレームを特許庁に提出し，かつ，補正をするための国の手数料を納付しなければならない。(2004年3月10日。2004年5月1日施行－RT I 2004, 20, 141)例文帳に追加

(4) Any person who finds that an invention protected by a patent does not comply with the provisions of § 8 of this Act, may file an action in court against the proprietor of the patent for the revocation of the patent in part or in full. The proprietor of the patent may restrict the scope of patent protection in the course of proceedings in respect of the action if this will result in the invention complying with the provisions of § 8. A request for the making of a register entry together with a copy of the court judgment and, in the prescribed cases, information certifying payment of the state fee shall be filed with the Patent Office within one month after entry into force of the court judgment. Upon making amendments to the patent, the proprietor of the patent must file the description of the invention and patent claims amended pursuant to the court judgment with the Patent Office and pay the state fee for the making of amendments within three months from the date of the court judgment which has entered into force.
