(1)商標侵害に関する訴訟において、原告の商標登録が無効であると被告が主張する、又は被告の商標登録が無効であると原告が主張する場合、当該訴訟を審理する裁判所(以下「裁判所」という。)は、次のとおりとする。(a)原告又は被告の商標について登録簿の是正に係る手続きが登録官又は高等裁判所において係属中である場合、当該手続きの最終処分まで当該訴訟の審理を中止する。(b)当該手続きが係属中でなく登録官が原告又は被告の商標登録に係る無効性の主張を一見して維持できると確信する場合、当該無効性の主張を争点として取り上げ、関係当事者が高等裁判所に登録簿の是正を申請することができるようにするため、当該争点を設定した日から3月間休廷する。例文帳に追加
(1) Where in any suit for the infringement of a trademark, the defendant pleads that the registration of the plaintiff's trademark is invalid; or the plaintiff pleads the invalidity of the registration of the defendant's trademark, the Court trying the suit hereinafter referred to as the Court, shall- (a) if any proceedings for rectification of the Register in relation to the plaintiff's or defendant's trademark are pending before the Registrar or the High Court Division, stay the suit pending the final disposal of such proceedings. (b) if no such proceedings are pending and the Registrar is satisfied that the plea regarding the invalidity of the registration of the plaintiff's or defendant's trademark is prima facie tenable, raise an issue regarding the same and adjourn the case for a period of 3 (three) months from the date of framing of the issue in order to enable the party concerned to apply to the High Court Division for rectification of the Register.発音を聞く - 特許庁
