第十八条　契約の更新の後において、借地権者が残存期間を超えて存続すべき建物を新たに築造することにつきやむを得ない事情があるにもかかわらず、借地権設定者がその建物の築造を承諾しないときは、借地権設定者が地上権の消滅の請求又は土地の賃貸借の解約の申入れをすることができない旨を定めた場合を除き、裁判所は、借地権者の申立てにより、借地権設定者の承諾に代わる許可を与えることができる。この場合において、当事者間の利益の衡平を図るため必要があるときは、延長すべき借地権の期間として第七条第一項の規定による期間と異なる期間を定め、他の借地条件を変更し、財産上の給付を命じ、その他相当の処分をすることができる。例文帳に追加
