(3) A person against whom the action is brought to court in relation to an illegal use of the patent may not object against the action, based only on the fact that the patent is not used or the activity thereof has to be discontinued due to other reasons. The defendant may bring a counter-claim to court regarding the invalidation of the patent in conformity with Section 56, Clauses 1, 2 and 3 of this Law.
