A person who has neither a domicile nor an establishment in the Federal Republic of Germany may take part in proceedings under this Law before the Patent Office or the Patent Court and assert rights deriving from a design protected according to the provisions of this Law only if he has appointed a patent attorney or an attorney-at-law in the Federal Republic of Germany as his representative. The latter shall be authorized to represent him in proceedings before the Patent Office and the Patent Court and in civil litigation in respect of the design; he may also file requests for the institution of criminal proceedings. The place where the representative has his business premises shall be deemed, within the meaning of Section 23 of the Code of Civil Procedure, to be the place where the assets are located; if there are no business premises, the place where the representative has his domicile shall be relevant or, in the absence thereof, the place where the Patent Office has its seat. 例文帳に追加
