３ この法律において「消費者契約」とは、消費者と事業者との間で締結される契約をいう。

４ 消費者契約の成立について第七条の規定により消費者の常居所地法が選択された場合において、当該消費者契約の方式について消費者が専らその常居所地法によるべき旨の意思を事業者に対し表示したときは、前条第二項及び第四項の規定にかかわらず、当該消費者契約の方式は、専ら消費者の常居所地法による。
