(5) When the underwriting of the insurance whose insurance amount exceeds the amount specified by a Cabinet Order provided in the Article 2, paragraph (17) of the New Insurance Business Act pursuant to the provision of paragraph (1) is performed, the provision of the paragraph (2) shall not apply to a Small Amount and Short Term Insurance Provider for whom the effecting reinsurance pertaining to such insurance with a Foreign Insurer was approved by the Prime Minister as falling under any of the following cases.
