当業者とは、請求項に係る発明が属する技術分野における技術常識を有し、通常の技術手段を研究開発（実験、分析、製造等を含む。）に利用する能力を有する仮想人物であって、材料の選択及び設計変更、数値範囲の最適化及び均等物による要素の置換において通常の創作能力を発揮し、自身の知識に基づいて、請求項に係る発明が属する分野における特許出願時の技術水準にある技術事項をすべて理解できる仮想人物をいう。例文帳に追加
