発明が微生物，微生物学的方法又は微生物学的方法で取得される物に関連しており，また，その微生物が公衆が入手できないものであって，かつ，出願書類において，それに係わる発明を当該技術に熟練した者が実施することができる程度に明確かつ十分に説明することができないときは，次に掲げる条件を満たしているときに限り，その発明を(1)の規定に従って開示しているとみなす。1. 遅くとも出願日までに，当該微生物の培養物をブダペスト条約に定められている寄託機関に寄託していること2. 最初に提出した出願書類に，出願人が使用することのできる，寄託微生物の特性に関する信頼すべきデータを記載していること3. 出願公告について決定(第101条(1))がなされるまでに，特許庁に，培養物の寄託に係わる寄託機関及び受託番号を届け出ていること例文帳に追加

If an invention relates to a microorganism, a microbiological process or a product obtained by such process and if the microorganism is not accessible to the public and cannot be described in the application in such a manner as to enable the invention to be carried out by a person skilled in the art, the invention shall be deemed disclosed according to subsection (1) only if 1. a culture of the microorganism was deposited with a depositary institution as defined by the Budapest Treaty on the date of filing the application at the latest, 2. the application as originally filed contains the authoritative data available to the applicant concerning the features of the microorganism, and 3. if the Patent Office was notified of the depositary institution and the file number of the deposit of the culture prior to taking the publication decision (Sec. 101(1)).発音を聞く - 特許庁
