７　特別審理官は、口頭審理の結果、第七条第四項の規定による引渡しを受けた外国人が、第六条第三項各号のいずれにも該当しないと認定したときは、当該外国人に対し、速やかにその旨を知らせて、本邦からの退去を命ずるとともに、当該外国人が乗つてきた船舶等の長又はその船舶等を運航する運送業者にその旨を通知しなければならない。ただし、当該外国人が、特別審理官に対し、法務省令で定めるところにより、電磁的方式によつて個人識別情報を提供したときは、この限りでない。例文帳に追加

第十三条の二　特別審理官又は主任審査官は、それぞれ第十条第七項若しくは第十一項又は第十一条第六項の規定により退去を命ずる場合において、当該外国人が船舶等の運航の都合その他その者の責めに帰することができない事由により直ちに本邦から退去することができないと認めるときは、法務省令で定めるところにより、当該外国人に対して、その指定する期間内に限り、出入国港の近傍にあるその指定する施設にとどまることを許すことができる。例文帳に追加
