製品責任訴訟の英語

(1) 第29条に基づく特許侵害訴訟において，特許の対象が製品を得るための方法である場合において，製品が当該方法によって生産されたのではないことを証明する責任は，侵害者として申し立てられている者が負う。ただし，裁判所が次のことを認めることを条件とする。例文帳に追加

(2) If the subject-matter of the patent is a method for the obtaining a new product, it shall be deemed that same product has been obtained with the patented method without the consent of the proprietor of the patent. In such case, the proof of the non-existence of the patent infringement shall be the duty of the defendant. (2) 特許権者又は排他的実施権者が開始した特許に関する侵害訴訟において， (a) 被告が，特許を受けた方法によって取得される製品と同一の製品(「被告の製品」)を取得するために，特許を受けた方法とは異なる方法を使用したと主張し，かつ (b) 裁判所が，次の事項，すなわち， (i) 被告の製品が特許を受けた方法によって製造された可能性が極めて高いこと，及び (ii) 特許権者又は排他的実施権者が，被告が実際に使用した方法を発見するための合理的措置をとったが発見することができなかったこと， を認めた場合において，被告側に責任のある反証が挙げられないときは，被告の製品は，特許を受けた方法によって取得されたものとみなす。例文帳に追加

(2) If, in proceedings for infringement of a patent started by the patentee or the exclusive licensee: (a) the defendant alleges that he or she has used a process different from the patented process to obtain a product (defendant's product) identical to the product obtained by the patented process; and (b) the court is satisfied that: (i) it is very likely that the defendant's product was made by the patented process; and (ii) the patentee or exclusive licensee has taken reasonable steps to find out the process actually used by the defendant but has not been able to do so; then, in the absence of proof to the contrary the onus for which is on the defendant, the defendant's product is to be taken to have been obtained by the patented process.発音を聞く  - 特許庁
