Where a plaintiff asserts claims on grounds of infringement of a registered trade mark within the meaning of Sections 14, 18 and 19 by bringing an action, he shall, in response to an objection by the defendant, establish proof that the trade mark has been put to use pursuant to Section 26 within a period of five years before the bringing of the action, for the goods or services on which the grounds for his claims are based, provided that the trade mark has, on that date, been registered at least for five years. Where the period of five years of non-use ends after the bringing of the action, the plaintiff shall, in response to an objection by the defendant, establish proof that the trade mark has been put to use pursuant to Section 26 within a period of five years preceding the conclusion of the oral proceedings.
