(1) 本規則の如何なる規定にも拘らず，かつ，法第39条(5)に従うことを条件として，何人も，係属中の登録出願の対象である商標に関して，出願人の代置を様式TM6により申請することができ，かつ，登録官は，当該申請を認めるための十分な理由があると判断するときは，登録官が必要とみなす条件に従うことを条件として，当該代置を承認することができる。例文帳に追加

(1) Notwithstanding anything contained in these regulations and subject to section 39(5) of the Act, any person may apply on Form TM6 for a substitution of applicant in respect of a trade mark which is the subject of a pending application for registration; and the Registrar may, if satisfied that there is good reason to grant the application, approve of the substitution subject to such conditions as he deems necessary. - 特許庁
