Infringement where non-compliance with certain contractual requirements A registered trade mark is infringed if a purchaser or owner of goods and the owner or licensee of the registered trade mark have entered into a written contract that requires the purchaser or owner of the goods not to do, in relation to the goods, any of the acts listed in subsection (2); and the owner, for the time being, of the goods has notice of the contractual requirement; and does or authorizes, in the course of trade, or with a view to dealing with the goods in the course of trade, any of those listed acts; and did not purchase the goods for value and in good faith before receiving notice of the contractual requirement; and is not a successor in title to an owner to whom subparagraph (iii) applies. (2) 商標の登録が第三者の権利の不誠実な使用又は法律上若しくは契約上の義務の侵害によって出願された場合は，被害を受けた当事者は，裁判所において当該商標の所有権を主張することができる。ただし，当該当事者が，登録日前に時宜を得た方法で，又は登録の公告日若しくは第39条に従い登録商標の使用が開始された時から5年以内に，請求を提起することを条件とする。請求が提起された場合は，関連の裁判所は商標登録簿への記入を目的として，スペイン特許商標庁に対してその旨を通知し，かつ該当する場合は，商標登録手続を停止するよう命じるものとする。例文帳に追加

(2) Where the registration of a trademark has been applied for with the dishonest use of the rights of a third party or an infringement of a legal or contractual obligation, the injured party may claim ownership of the trademark in the courts, provided that he files a claim in timely fashion prior to the date of registration, or within five years of the publication of the registration or from the time when the registered trademark has begun to be used in accordance with Article 39.
