Any person wishing to have a sample made available (“the requester”) shall apply to the Controller in Form No. 8 (which shall be filed in duplicate together, in the case of a deposit which is deposited under the Budapest Treaty with an international depositary authority, with the form provided for by he Regulations under the Budapest Treaty) nominating the person (“the expert”) to whom he, she, they or it wishes the sample to be made available. The requester shall at the same time file undertakings by the expert in the terms set out in paragraph (8) and shall pay the prescribed fee.
